Ritual Rhetoric In Ancient Near Eastern Texts, James W. Watts Jan 2009

Ritual Rhetoric In Ancient Near Eastern Texts, James W. Watts

Religion - All Scholarship

Many ancient Near Eastern texts reflect a concern for ritual accuracy. They depict ancient kings justifying their ritual practices on the basis of supposedly invariable tradition and, frequently, on the basis of old ritual texts. They also invoke ritual acts and omissions to explain the course of past history and to promise future punishments and rewards. In fact, very many texts assert that ritual performance is the most determinative factor in the success or failure of rulers and nations. The rhetoric of ritual therefore pervaded royal propaganda as well as temple texts. It also provided the principal rationale for criticizing …

Teach The Children: Education And Knowledge In Recent Children's Fantasy, Elisabeth Rose Gruner Jan 2009

Teach The Children: Education And Knowledge In Recent Children's Fantasy, Elisabeth Rose Gruner

English Faculty Publications

This essay is an investigation into how learning is portrayed in children's books. It starts from two premises: first, that at least one origin of children's literature is in didacticism, and that learning and pedagogy continue to be important in much of the literature we provide for children today. Thus, for example, David Rudd claims that most histories of children's literature on "the tension between instruction and entertainment," and that the genre as we know it develops within, among other things, "an educational system promoting literacy" (29, 34). Seth Lerer's recent Children's Literature: A Reader's History similarly traces the origins …

Good Faith Rejection Of Goods In A Falling Market Note, Jeffrey M. Dressler Jan 2009

Good Faith Rejection Of Goods In A Falling Market Note, Jeffrey M. Dressler

Connecticut Law Review

This Note analyzes the intersection of two fundamental components of American sales law under the Uniform Commercial Code: the perfect tender rule and the duty of good faith. It focuses on cases in which buyers of goods use their right to perfect tender to avoid purchasing goods that have become diminished in value. Some commentators, and, indeed, some courts, have argued that such conduct runs afoul of parties’ underlying duty of good faith in the performance of contracts. This Note rejects this position, and, instead, argues that if goods are truly non-conforming—even if only “trivially” non-conforming—buyers should retain their right …

Sexual Politics And Social Change Commentary, Deborah N. Pearlstein Jan 2009

Sexual Politics And Social Change Commentary, Deborah N. Pearlstein

Connecticut Law Review

Since Alexander Hamilton first wrote of the functional virtues of the presidency in matters of foreign affairs, his claim that a unitary executive is specially blessed with advantages of “[d]ecision, activity, secrecy, and dispatch” has been invoked regularly to argue for a limited role for Congress in national security decision-making, and even more rigorous deference to executive preferences by the courts. The Hamiltonian virtues have proven particularly compelling to a modern set of functionalist scholars, from Bruce Ackerman to John Yoo, who rely on the same metrics of institutional competence to defend executive-heavy security detention programs (and other initiatives) against …

The Last Minstrel Show - Racial Profiling, The War On Terrorism And The Mass Media, John Tehranian

Connecticut Law Review

This Article examines and critiques media portraits of the Middle East and Middle-Eastern Americans by tracing the alarming impact of this last minstrel show on public policy and the war on terrorism The Article begins by analyzing racial profiling’s problematic discourse of legitimation, deracinating its unsound roots and charting the intricate relationship between representation and reality in the narration of the Middle-Eastern threat, especially after 9/11. The Article then examines the instrumental role of the mass media in both ossifying and perpetuating stereotypes that have rationalized policies targeting individuals of MiddleEastern descent. Drawing on specific examples from the movies, television, …

Treating Animals Right : Introducing A New Fairness Approach, Xenia Corali Schneider Jan 2009

Treating Animals Right : Introducing A New Fairness Approach, Xenia Corali Schneider

Honors Theses

The purpose of this thesis, thus, is to provide a convincing account of the proper ethical treatment of animals. I will discuss some of the most popular theoretical frameworks, utilitarianism, Kantianism, and contractarianism, and see how they apply to animals. After explaining and critiquing these theories I will provide an alternative theory for the ethical treatment of animals, which should serve as the basis for our actions and guide our behavior towards animals, especially the eating of meat.

The argument I will be defending is neither abolitionist-granting animals the same rights as human beings and therefore rejecting all institutions involving …
