Smith, Stormans, And The Future Of Free Exercise: Applying The Free Exercise Clause To Targeted Laws Of General Applicability, Mark L. Rienzi
Smith, Stormans, And The Future Of Free Exercise: Applying The Free Exercise Clause To Targeted Laws Of General Applicability, Mark L. Rienzi
Scholarly Articles
Does the Free Exercise Clause extend to situations where the legislature deliberately targets a religious practice, but does so for neutral reasons and is willing to extend the ban to people who happen to engage in the same practice for non-religious reasons? While one can imagine reasonable arguments on both sides about the constitutionality of the Sunday morning alcohol ban, it seems absurd to say that the Free Exercise Clause is not part of the equation. Yet under the First Amendment analysis presently employed by many courts, that result is entirely likely.

Directors' Liability For Corporate Faults And Defaults—An International Comparison, Helen Anderson
Directors' Liability For Corporate Faults And Defaults—An International Comparison, Helen Anderson
Washington International Law Journal
Australia’s new Rudd Government has indicated to business leaders that it intends to review various aspects of corporate law, including the imposition of personal liability on directors for corporate fault. Their concern is that the present corporate law regime is causing directors to be overly cautious in making decisions, to the detriment of the efficient operation of companies and the well-being of our economy. At the same time, the government acknowledges the importance of imposing appropriate sanctions where a company or its officers fail to meet required standards. These are universal concerns. To inform this debate, this article will look …

Entitled Against None: How The Wrongly Decided Croker Island Case Perpetuates Aboriginal Dispossession, Siiri Aileen Wilson
Washington International Law Journal
Australia’s 1992 landmark case of Mabo v. The State of Queensland [No. 2] revoked the concept of terra nullius and for the first time since European colonization of the continent allowed indigenous Australians to obtain legal ownership of their traditional lands. The following year this groundbreaking decision became statutory law with the enactment of the Native Title Act (NTA) of 1993. The case law and the statutory act both failed, however, to adequately address the question of Aboriginal claims to sea properties. For many Australian Aboriginal groups, ownership of traditional lands does not abruptly end at a shoreline but extends …
China's Environmental Problems: Is A Specialized Court The Solution?, Darcey J. Goetz
China's Environmental Problems: Is A Specialized Court The Solution?, Darcey J. Goetz
Washington International Law Journal
China’s economic growth has come at a high price: environmental and natural resource destruction. Presently, China’s legal system is not prepared to protect China’s environmental resources. China’s State Council has expressed an interest in establishing a civil and administrative system to manage environmental matters. Some of the objectives expressed by the State Council could be achieved by creating a special tribunal to address environmental issues, similar to New Zealand’s Environment Court. A specialized court promotes environmental protection, and specialization creates experts in a specific field, allowing for consistency among decisions. An environmental court will fit into China’s current legal system …
Bankruptcy Law Dilemma: Appraisal Of Corporate Value And Its Distribution In Corporate Reorganization Proceedings, Jongho Kim
Northwestern Journal of International Law & Business
This article will analyze issues arising in reorganization proceedings with which the bankruptcy court has not yet grappled. If the questions arising in the remainder of this article can be clearly answered, then to a certain extent numerous arguments about Chapter 11 can be settled. This article will also analyze both Korean and U.S. bankruptcy law and will maintain a comparative approach with a critical perspective. Though Korean bankruptcy law indirectly adopted11 that of the United States in 1962, the actual application and interpretation of Korean bankruptcy law is quite different and I will accurately compare and contrast the two …
Indian Patent Law: Walking The Line, Johanna Sheehe
Indian Patent Law: Walking The Line, Johanna Sheehe
Northwestern Journal of International Law & Business
This comment proposes that cultural preferences have had a strong influence over the development of Indian patent law, and that these preferences influenced the court decision against Novartis. Part I will introduce TRIPS and international patent law, discuss the development of Indian patent law in the context of its colonial past and WTO membership, and explain the decisions by the Indian Patent Office and the Court of Madras in the context of Glivec's development. Part II will explore WTO attitudes and approaches to TRIPS and argue that if Switzerland were to bring India to the WTO's Dispute Settlement Board (DSB), …
Sophistry, Situational Ethics, And The Taxation Of The Carried Interest, Darryll K. Jones
Sophistry, Situational Ethics, And The Taxation Of The Carried Interest, Darryll K. Jones
Northwestern Journal of International Law & Business
This Article is, in essence, a strident expression of indignation about what a majority of tax scholars and, indeed, legislators consider a glaring yet persistent inequity in the tax code. In short, sometimes extraordinarily well-paid fund managers receive compensation taxed at capital gains rates. All other, usually very much lower-compensated, service providers are taxed at ordinary rates. The result is clearly regressive and yet, as of late, even some respected and knowledgeable scholars-though still in the minority-have unabashedly set forth sophisticated-sounding justifications. Objections based on unfairness, real, or even merely perceived, are difficult to express without a tone of indignation, …

Canada-United States Cooperative Approaches To Shared Marine Fishery Resources: Territorial Subversion?, Ted L. Mcdorman
Canada-United States Cooperative Approaches To Shared Marine Fishery Resources: Territorial Subversion?, Ted L. Mcdorman
Michigan Journal of International Law
This Essay will focus on how Canada and the United States have both succeeded and failed in adopting cooperative approaches to managing ocean fishery resources. A critical factor that has influenced these efforts is the introduction of an international legal construct dictating that States have exclusive sovereign rights respecting all marine living resources within 200 nautical miles of their shores. Cooperative approaches to managing transboundary marine living resources between Canada and the United States are necessary for two reasons. First, in the case of marine living resources, the resource pays scant attention to human-constructed national boundaries. Put another way, marine …
The Civilizing Of Hurling In Ireland, Paddy Dolan, John Connolly
The Civilizing Of Hurling In Ireland, Paddy Dolan, John Connolly
Articles
This essay examines the sport of hurling in Ireland through the theoretical framework of sport and leisure developed by Elias and Dunning. Through an analysis of newspaper reports of games, of rulebooks and codes of play, as well as historical data on increasing social differentiation and integration, we argue that hurling has undergone sportization and civilizing processes. However, due to the unevenness of wider figurational shifts these processes have been non-linear and fragile. Gradually, we see increasing numbers of rules, as well as increasing severity of punishment for the breaking of specific rules relating to violent play. The level and …
An Analogy Based Costing System For Injection Molds Based Upon Geometry Similarity With Wavelets, Cyrus Clinton Hillsman
An Analogy Based Costing System For Injection Molds Based Upon Geometry Similarity With Wavelets, Cyrus Clinton Hillsman
Electronic Theses and Dissertations
The injection molding industry is large and diversified. However there is no universally accepted way to bid molds, despite the fact that the mold and related design comprise 50% of the total cost of an injection-molded part over its lifetime. This is due to both the structure of the industry and technical difficulties in developing an automated and practical cost estimation system. The technical challenges include lack of a common data format for both parts and molds; the comprehensive consideration of the data about a wide variety of mold types, designs, complexities, number of cavities and other factors that directly …

The article links Galdós's review of Meyerbeer's opera La Africana, published in La Nación in 1865, with his reference to that opera in the "Viaje de novios" [Honeymoon] chapter of Fortunata y Jacinta. The romantic triangle of Sélica, Vasco de Gama, and Inés is compared to that of Fortunata as ambiguous examples of the Orientalized "Other."

The wolf spider genus Zoica Simon 1898 is currently known only from the Indo-Australasian region, including India in the west to northern Western Australia and Papua New Guinea in the east. Here we extend the known distribution of the genus into the Pacific region by describing two new species, Z. carolinensis new species from the Caroline Islands, Federated States of Micronesia, and Z. pacifica new species from the Republic of the Marshall Islands.
Ephemeral Mechanisms And Historical Explanation, Stuart Glennan
Ephemeral Mechanisms And Historical Explanation, Stuart Glennan
Scholarship and Professional Work - LAS
While much of the recent literature on mechanisms has emphasized the superiority of mechanisms and mechanistic explanation over laws and nomological explanation, paradigmatic mechanisms—e.g., clocks or synapses – actually exhibit a great deal of stability in their behavior. And while mechanisms of this kind are certainly of great importance, there are many events that do not occur as a consequence of the operation of stable mechanisms. Events of natural and human history are often the consequence of causal processes that are ephemeral and capricious. In this paper I shall argue that, notwithstanding their ephemeral nature, these processes deserve to be …

Basking Behavior Of Emydid Turtles (Chysemys Picta Marginata, Graptemys Geographica, And Trachemys Scripta Elegans) In An Urban Landscape, W. E. Peterman, Travis J. Ryan

Basking is common in emydid turtles and is generally accepted to be in thermoregulatory behavior. In 2004, we quantified and described the basking behavior of turtles in the Central Canal of Indianapolis. This canal system runs through an urban landscape that is dominated by fragmented woodlots, residential areas. and commercial areas. We observed that basking turtles exhibited variable basking behavior. with spatial and temporal shins in basking behavior from east-facing banks in the morning to west-facing banks in the afternoon. Turtles in the Central Canal are subject to frequent disturbance, which altered basking behavior. Many turtles forewent aerial basking on …
From Hiroshima To Baghdad: Military Hegemony Versus Just Military Preparedness, Harry Van Der Linden
From Hiroshima To Baghdad: Military Hegemony Versus Just Military Preparedness, Harry Van Der Linden
Scholarship and Professional Work - LAS
In this paper I question the morality of U.S. military supremacy or hegemony in terms of what constitute the legitimate use of military force and the proper preparation for using such force. I first discuss in a somewhat synoptic fashion how American hegemonic military force (from its very beginning with the dropping of the atomic bomb on Hiroshima) has been justified in dishonest ways and wrongly executed. Next, I show that Just War Theory (JWT) needs to be revised in order to come to a convincing assessment of U.S. military hegemony and its use of military force. This leads me …

Objective
The goal of this study was to explore the relationship between language and memory lateralization in patients with epilepsy undergoing the intracarotid amobarbital procedure.
Methods
In 386 patients, language lateralization and memory lateralization as determined by laterality index (LI) were correlated with each other.
Results
Language lateralization and memory lateralization were positively correlated (r = 0.34, P < 0.01). Correlations differed depending on the presence and type of lesion (χ2 = 7.98, P < 0.05). LIs correlated significantly higher (z = 2.82, P < 0.05) in patients with cortical dysplasia (n = 41, r = 0.61, P < 0.01) compared with the group without lesions (n = 90, r = 0.16, P > 0.05), with patients with hippocampal sclerosis falling between these two groups. Both memory (P < 0.01) and language (P …

This paper reports outcomes of our first Action Research study involving implementing Second Life [SL] in a graduate distance course on exploring community online. Participant blog entries and transcripts of ‘in-world’ class sessions were analyzed to determine: how well the participants learned to be successful SL residents; whether observations and meeting discussions reflected themes of community and experiential learning; and how participants evaluated their experiences and the educational potential of SL. Results indicate that SL is a complex environment requiring much practice to develop competencies for navigating inworld. Once accomplished, however, participants reported that although SL did not replicate real …
