Phillips V. Awh, Corp., A Doctrine Of Equivalents Case?, Natalie Sturicz
Phillips V. Awh, Corp., A Doctrine Of Equivalents Case?, Natalie Sturicz
Marquette Intellectual Property Law Review
For a number of years, U.S. courts have noted that the doctrine of equivalents has been unworkable. This article explains that as American courts move toward a more holistic approach to claim interpretation, the doctrine of equivalents will become increasingly unnecessary as a means of expanding patent scope. The author asserts that adopting a "person having ordinary skill in the art" approach to claim interpretation and eliminating the doctrine of equivalents in patent infringement cases would benefit patent law in several ways: (1) when courts interpret patent claims from the perspective of a person reasonably skilled in the art, patentees …

Transnationalism And Migration: Chinese Migrants In New Zealand, Raymond C.F. Chui
Transnationalism And Migration: Chinese Migrants In New Zealand, Raymond C.F. Chui
Global Asia Journal
Transnational migration is an integral part of the modern world. Immigration policies, economic initiatives and international agreements of modern natiion-states have shaped the growth of transnational migration. Nation-states classify migrants into different categories for the purpose of border control; they have favoured some groups of migrants over the others. This is particularly true for New Zealand, which has maintained close connections with the United Kingdom and preferred British migrants to other peoples since the nineteenth century. New Zealand has always emphasized the economic integration of migrants into the society. Against this background, Chinese migrants arrived and developed their transnational networks …

Imsa360: Summer 2008, Imsa Fund
IMSA Fund Reports
Often when I speak to parents, students and educators, I share one of my core beliefs: there is no ceiling on human potential. Though perhaps a bit overstated, as I fully realize my limited singing ability elicits monumental groans and sends animals scurrying for cover, it is true that often when we think an individual has reached his or her “potential,” we are astounded by a new accomplishment. As I look back on my first year as IMSA’s second president, I am humbled and amazed by IMSA’s truly unlimited potential for advancing the human condition and living into our aspiration …

Don’T Call Me “Hawaiian-At-Heart”: Self-Determination And Identity Theft, Kelly Rae Kraemer

This paper presents a major lesson I learned from my research on the roles of non-natives in the Kanaka Maoli (Native Hawaiian) sovereignty movement, one that should prove instructive for activists in other movements: when the federal and state governments, immigrants and settlers, and the Kānaka Maoli people compete to define Hawaiian identity and control access to Hawaiian people, land, and culture, who counts as “Native Hawaiian” matters. Yet, with so much at stake, even when common sense tells nonnatives we know what “native” means and it is not us, many forces collude to encourage nonnative appropriation of Hawaiian identity—identity …
An Uphill Battle: Incorporating Cooperative Learning Using A Largely Individualized Curriculum, Anna Anderson
An Uphill Battle: Incorporating Cooperative Learning Using A Largely Individualized Curriculum, Anna Anderson
Action Research Projects
In this action research study of my classroom of 8th grade mathematics, I investigated if cooperative learning could be an effective teaching method with the Saxon curriculum. Saxon curriculum is largely individualized in that most lessons could be completed without much group interaction. I discovered that cooperative learning was very successful with the curriculum as long as it was structured. Ninety-five percent of the students in the study preferred to work in groups, and I observed mathematical communication grow with most of the students. As a result of this research, I plan to continue to incorporate cooperative learning into my …

Identifying State Variables In Multivariate Hydrological Time Series Using Time Series Knowledge Mining, O. Gronz, M. C. Casper, P. Gemmar

The challenge of modeling rainfall-runoff processes is to define a suitable functional relationship between input variables representing precipitation measurements and the output runoff. Depending on the system’s state, the amount of precipitation resulting in direct flow varies strongly. Thus, state variables indicating the system’s actual state can enhance the accuracy of rainfall-runoff models significantly. Fuzzy models of Takagi-Sugeno-type are one of the effective approaches to simulate rainfall-runoff processes regarding the different system states. The design of a fuzzy rainfall-runoff model consists of two essential steps: the definition of the structure (input quantities, state variables, rules) and the identification of parameters …

Entropy-Based Fuzzy Set Optimisation For Reducing Ecological Model Complexity, A. M. Mouton, Bernard De Baets, A. Peter, G. Holzer, R. Müller, Peter L. M. Goethals
International Congress on Environmental Modelling and Software
In recent years, fuzzy logic has been acknowledged as a suitable approach for species distribution modelling due to its transparency and its ability to incorporate the ecological gradient theory. Specifically, the overlapping class boundaries of a fuzzy model are similar to the transitions between different environmental conditions. However, the need for ecological expert knowledge is an important constraint when applying fuzzy species distribution models. Recent research has shown that data-driven fuzzy models may solve this ‘knowledge acquisition bottleneck’ and this paper is a further contribution. The aim was to reduce the complexity of a data-driven fuzzy habitat suitability model for …
Unlocking The Power Of Multidimensional Literacy In A Language Arts Classroom: A Middle School Language Arts Curriculum, Andrew Raymond Kostelnik
Unlocking The Power Of Multidimensional Literacy In A Language Arts Classroom: A Middle School Language Arts Curriculum, Andrew Raymond Kostelnik
All Graduate Projects
A curriculum project that incorporates a multidimensional and multicultural point of view is created for a middle school language arts classroom in a rural community. Multiculturalism theories and underpinnings are examined and critically analyzed. Materials are identified and examined to determine the appropriateness in relation to the demographics and nature of the Kayman School District. Multiple sources and materials were established as a permanent curricular component to ensure an education that incorporates multiple perspectives and viewpoints.

Benefits Of A Parent Involvement Plan For Second Grade Students, Mila Hart
All Graduate Projects
The benefits of a parent involvement plan for second grade students were researched. Students, whose parents were actively involved in their education, did better in school (Henderson & Mapp, 2002). Most parents want what is best for their child and will provide the support needed when encouraged and shown how to be involved with their child in school. Active parent involvement can be facilitated by a parent handbook combined with an open house, follow-up workshops that provide helpful information to parents, and frequent and regular communication via phone, progress reports, e-mail, home visits, and formal or informal conferences (Epstein et …

We examined the differential item functioning (DIF) of Rosenberg's (1965) Self-Esteem Scale (RSES) and compared scores from U.S. participants with those from 7 other countries: Canada, Germany, New Zealand, Kenya, South Africa, Singapore, and Taiwan. Results indicate that DIF was present in all comparisons. Moreover, controlling for latent self-esteem, participants from individualistic countries had an easier time reporting high self-esteem on self-competence-related items, whereas participants from communal countries had an easier time reporting high self-esteem on self-liking items (Tafarodi & Milne, 2002). After adjusting for DIF, we found larger mean self-esteem differences between the countries than observed scores initially indicated. …

Perinatal Arterial Ischaemic Stroke: An Update With Literature Review, S. H. Ibrahim, Zafar Abdul Mueed
Department of Paediatrics and Child Health
Perinatal arterial ischaemic strokes are a major cause of morbidity in the neonatal period and leads to significant neurological morbidity. It is however under recognized as an entity and usually missed till the baby is 3-4 months of age when they first present with hemiplegia. Perinatal arterial ischaemic strokes are not reported from our country and this may be due to the fact that neurodiagnostic modalities were not available until the last few years. Even now this is not available in the smaller cities of our country. In this review we will discuss the common issues related to etiology and …

History Of Mathematics In Mathematics Education: A Saussurean Perspective, Michael Fried
History Of Mathematics In Mathematics Education: A Saussurean Perspective, Michael Fried
The Mathematics Enthusiast
It is not only because of a certain eclecticism in mathematics education research that semiotic ideas have begun to take root there: it is also because of the dawning recognition that key areas of interest in mathematics education genuinely have a semiotic nature. For this, one need only point to research focused on meaning, communication, language, and culture (e.g., Presmeg, 1997; Ernest,1997; Radford, 2001; Brown, 2001). The ways in which semiotics informs cultural aspects of mathematics education, particularly those connected with the history of mathematics, were highlighted in a discussion session at the 2003 meeting of the International Group for …

The Acoustic Correlates Of Atr Harmony In Seven- And Nine-Vowel African Languages: A Phonetic Inquiry Into Phonological Structure, Coleen Grace Anderson Starwalt
Linguistics & TESOL Dissertations - Archive
This study compares eleven Niger-Congo languages with [ATR] harmony and seeks to determine especially whether the acoustic properties of the "voice quality" differences associated with [ATR] in nine-vowel languages, such as Akan, are present or absent in all, some or none of the seven-vowel languages. Of particular interest is the nature of the height 2 and 3 vowels of the nine- and degree 2 vowels of seven-vowel systems. First, this study corroborates previous work on nine-vowel systems by demonstrating that height 2 vowels [-ATR] [? ?] frequently overlap with height 3 vowels [+ATR] [e o]. Next, it considers the question …

Bell Atlantic Corp. V. Twombly: Mere Adjustment Or Stringent New Requirement In Pleading?, Amber A. Pelot
Mercer Law Review
In Bell Atlantic Corp. v. Twombly, the United States Supreme Court seemingly tightened general federal pleading requirements, expressly abrogating a much-cited linguistic formula from Conley v. Gibson and making the avoidance of early dismissals more difficult for plaintiffs. To avoid dismissal for failure to state a claim, plaintiffs filing antitrust suits alleging conspiracy must set forth enough facts in the pleadings to suggest a preceding agreement, as distinct from parallel, independent action-at least where the parallel conduct is readily explained by lawful business motivations. The Court further declared that to withstand a motion to dismiss for legal insufficiency, a …

Evolvable Biological Interfaces: An Outline Of The New Computing System, Igor Balaž, Dragutin T. Mihailović
International Congress on Environmental Modelling and Software
In this paper, we represent architecture of a new individual-based model of evolvable biological interfaces. The model is based on three parts: mutable coding sequence, individual agents produced by the coding sequence and external environment represented by various virtual substances. Agents are able to recognize external substances and to perform transformations on them. However, unlike general computational scheme currently used in evolutionary computation which is based on predefined list of actions, where each action have predefined fitness value defined strictly within current problem, the recognition and corresponding transformation in this model are organized in completely different way. Here we merged …

The quality of discovered knowledge is highly depending on data quality. Unfortunately real data use to contain noise, uncertainty, errors, redundancies or even irrelevant information. The more complex is the reality to be analyzed, the higher the risk of getting low quality data. Knowledge Discovery from Databases (KDD) offers a global framework to prepare data in the right form to perform correct analyses. On the other hand, the quality of decisions taken upon KDD results, depend not only on the quality of the results themselves, but on the capacity of the system to communicate those results in an understandable form. …

Decision making in spatial planning often takes place in a complex and illdefined context. It includes a large number of actors, factors and –often uncertain– relations. Each of the actors or stakeholders has his or her individual perceptions, values and priorities. This paper presents the TOPIC system, which aims to support this process by interactively collecting and managing the information in a participatory stakeholder process. We focus on a specific version of TOPIC – named COHESIE – which includes functionality for qualitative, participatory modelling. By representing actor perspectives in an explicit and transparent way, the modelling process facilitates the discussion …

In the “Alien Invaders!” program, students use the Forever Earth vessel to investigate how quagga mussels might affect Lake Mead. Students collect water quality data such as clarity, pH, and temperature to determine whether current habitat conditions would allow quagga mussels to survive and thrive. Students learn about the consequences the quagga mussels could have on the lake and its living and non-living resources. Using the knowledge they’ve gained, students create their own management plans to prevent the spread of quagga mussels to other waterways.
