A Comparison Of Labor Arbitration Procedures In The U.S. And China, Yang Xinjiletu, Carl F. Jenks Purdue, Han Weihong
Mountain Plains Journal of Business and Technology
The purpose of this paper is threefold: 1) compare the labor arbitration procedures of the U.S. and China; 2) identify labor issues that may be problematic for China in the future; and 3) recommend how China may address future workplace problems in its emerging economy. It is generally accepted that American labor arbitration is not a perfect process, but it is a reasonable Alternate Dispute Resolution (ADR) Procedure. More importantly, it is less expensive than litigation, and it provides finality to workplace disputes. In the volatile industrial economy of China, one could reasonably expect that there is the potential for …

The authors of this article analyzed the differences in output when searching MEDLINE direct and MEDLINE via citation management software, EndNoteX1®, EndNoteWeb®, and RefWorks. Several searches were performed on Ovid MEDLINE and PubMed directly. These searches were compared against the same searches conducted in Ovid MEDLINE and PubMed using the search features in EndNote X1, EndNote Web, and RefWorks. Findings indicated that for in-depth research, users should search the databases directly rather than through the citation management software interface. The search results indicated it would be appropriate to search databases via citation management software for citation …

Introduction To Ethanol: Salvation Or Damnation?, Joe Starita
College of Journalism and Mass Communications: Student Media
For nine months, a team of UNL student journalists — six print and four broadcasting — went looking for the answers to these questions. The students read hundreds of pages of background material, interviewed scores of scientists, researchers, professors and energy experts by phone and e-mail, grilled a number of ethanol advocates in person, participated in an energy symposium at Stanford University, traveled to Berkeley, Chicago and Kansas City, and visited ethanol plants, rural communities and cattle country to try to get to the bottom of this elusive, complex issue. The results of their months-long research can be found in …

Uneasy Lies The Tiara: Crowns, Contracts, And The Rebekah Revels Litigation, Amanda Harmon Cooley
William & Mary Journal of Race, Gender, and Social Justice
In the last five years, news of various scandals in the pageant industry has inundated media outlets. These recent incidents are by no means outliers in the history of pageantry. This article explores the significance of one of these controversies - the Rebekah Revels litigation, which stemmed from the disputed 2002 Miss North Carolina pageant.
For context, this article first outlines allegations of wrongdoing in early pageants. It proceeds with an analysis of how the Revels litigation serves as an exemplar of the types of contract lawsuits that may continue to entangle pageant organizations in the future. Finally, the article …

The Parent Trap: Differential Familial Power In Same-Sex Families, Deirdre M. Bowen
William & Mary Journal of Race, Gender, and Social Justice
Do intact same-sex couples where one member of the couple became pregnant with assisted reproduction or was the primary adopter, and the other member became a parent through second parent adoption, understand the legal protections afforded them? In short the answer is no. An interesting family dynamic arises around those who can claim the true status as parent based on their legal understandings of parenthood and their interactions with the dominant culture. While high profile custody cases on this issue have been decided in the United States with varying results, no research has examined the impact of uneven legal protections …

Creeping By Moonlight: A Look At Civil Commitment Laws For Sexually Violent Predators Through The Lens Of The Yellow Wallpaper, Heather R. Willis
William & Mary Journal of Race, Gender, and Social Justice
This note examines the constitutional and social implications of the civil commitment of sexually violent predators in the United States. These commitments are implemented on sexual offenders deemed too dangerous to be placed back into society after serving prison sentences and have been gaining popularity across the United States. Currently, these commitments are considered constitutional in limited circumstances by the Supreme Court, but while these commitments are meant for only the most dangerous and least controllable individuals, the public reaction to sexual offenses increases the possibility these commitments will be misused. As a part of examining this commitment process, this …
The Facade Of Neutrality: Uncovering Gender Silences In International Trade, Barnali Choudhury
The Facade Of Neutrality: Uncovering Gender Silences In International Trade, Barnali Choudhury
William & Mary Journal of Race, Gender, and Social Justice
International trade policies have traditionally been measured in terms of net economic benefit and market-based criteria. For the most part, these policies have largely ignored any of the societal effects that a liberalized trade regime may cause. Recently, however, the environmental, health, and labor impacts of trade agreements have slowly gained recognition as areas of concern. This recognition has led to an overall growing trend towards acknowledging the linkages between trade and non-trade issues.
One area that has been relatively untouched by any new developments is the issue of gender. Trade theories proceed from the premise that trade agreements are …

When Is Antipsychotic Polypharmacy Supported By Research Evidence? Implications For Qi, Jessica L. Gören, J. Parks, Frank A. Ghinassi, Celeste G. Milton, John M. Oldham, Pablo Hernandez, Jeffrey Chan, Richard C. Hermann
Pharmacy Practice and Clinical Research Faculty Publications
Background: Concurrent use of multiple standing antipsychotics (antipsychotic polypharmacy) is increasingly common among both inpatients and outpatients. Although this has often been cited as a potential quality-of-care problem, reviews of research evidence on antipsychotic polypharmacy have not distinguished between appropriate versus inappropriate use.
Methods A MEDLINE search from 1966 to December 2007 was completed to identify studies comparing changes in symptoms, functioning, and/or side effects between patients treated with multiple antipsychotics and patients treated with a single antipsychotic. The studies were reviewed in two groups on the basis of whether prescribing was concordant with guideline recommendations for multiple-antipsychotic use.

Alcohol Consumption By Aging Adults In The United States: Health Benefits And Detriments, Maria Pontes Ferreira, M. K. Suzy Weems
Alcohol Consumption By Aging Adults In The United States: Health Benefits And Detriments, Maria Pontes Ferreira, M. K. Suzy Weems
Nutrition and Food Science Faculty Research Publications
The most rapidly growing segment of the US population is that of older adults (≥65 years). Trends of aging adults (those aged ≥50 years) show that fewer women than men consume alcohol, women consume less alcohol than men, and total alcohol intake decreases after retirement. A U- or J-shaped relationship between alcohol intake and mortality exists among middle-aged (age 45 to 65 years) and older adults. Thus, alcohol can be considered either a tonic or a toxin in dose-dependent fashion. Active areas of research regarding the possible benefits of moderate alcohol consumption among aging individuals include oxidative stress, dementia, psychosocial …

Defense Costs And Insurer Reserves In Medical Malpractice And Other Personal Injury Cases: Evidence From Texas, 1988-2004, Bernard Black, David A. Hyman, Charles Silver, William M. Sage
Defense Costs And Insurer Reserves In Medical Malpractice And Other Personal Injury Cases: Evidence From Texas, 1988-2004, Bernard Black, David A. Hyman, Charles Silver, William M. Sage
Faculty Scholarship
We study defense costs for commercially insured personal injury tort claims in Texas over 1988–2004, and insurer reserves for those costs. We rely on detailed case-level data on defense legal fees and expenses, and Texas state bar data on lawyers’ hourly rates. We study medical malpractice (“med mal”) cases in detail, and other types of cases in less detail. Controlling for payouts, real defense costs in med mal cases rise by 4.6 percent per year, roughly doubling over this period. The rate of increase is similar for legal fees and for other expenses. Real hourly rates for personal injury defense …

Dances With Elephants: Administrative Resolution Of Medical Injury Claims By Medicare Beneficiaries, Eleanor D. Kinney, William M. Sage
Faculty Scholarship
In our judgment, Hoffmann and Rowthorn's research clearly demonstrates that the QIO-based complaint review process does not provide genuine relief to beneficiaries. People who complain typically want an explanation of their bad experience, compensation for harm they may have suffered, and assurance that future experiences will be better for themselves and for others. Medicare beneficiaries, however, receive minimal information about the resolution of their complaints and no substantive relief whatsoever.
As Hoffmann and Rowthorn point out, several reform proposals are now before Congress, including moving the beneficiary complaint function from QIOs to new "Medicare Provider Review Organizations." It is not …

Common Grounds, Common Waters: Towards A Water Ethic - Roundtable Discussion, Gabriel Eckstein, Irene Klaver
Faculty Scholarship
The purpose of this roundtable discussion is to continue the dialogue but in a more informal setting, and to allow people to develop some of the ideas and concepts that they started earlier but could not finish because of the time limits.
It is also to get the audience and the panelists to ask questions of each other and to participate in more of a dialogue. To start this discussion I want to raise, at least to the panelists, this issue of wants versus needs, and I am actually going to add one more-versus rights-because I thought that was very …

Statement of problem
Acrylic resins are prone to microbial adherence, especially by Candida albicans. Surface-charged resins alter the ionic interaction between the denture resin and Candida hyphae, and these resins are being developed as a means to reduce microbial colonization on the denture surface.
Purpose
The purpose of this study was to investigate the physical and mechanical properties of phosphate-containing polymethyl methacrylate resins for their suitability as a denture material.
Material and methods
Using PMMA with cross-linker (Lucitone 199) as a control, 4 experimental groups containing various levels of phosphate with and without cross-linker were generated. The properties examined …
A Technique For Duplicating A Fixed Complete Denture, Soni Prasad, Edward A. Monaco, Jr.
A Technique For Duplicating A Fixed Complete Denture, Soni Prasad, Edward A. Monaco, Jr.
School of Dentistry Faculty Research and Publications
The fixed implant prosthesis often requires repair due to fracture and/or wear of acrylic resin teeth. Repair of such a prosthesis, although simple, requires retaining the prosthesis to be revised in the laboratory. In order to reveneer the implant prosthesis, a provisional restoration should be fabricated for the patient that provides similar function and esthetics. This article presents a technique for duplicating the existing fixed implant-supported prosthesis prior to repair/reveneer, thus providing a smooth transition from the provisional to the definitive prosthesis.
