Sales Of Personal Property As Secured Transactions Under Article 9 Of The Uniform Commercial Code, D. Fenton Adams Oct 2008

Sales Of Personal Property As Secured Transactions Under Article 9 Of The Uniform Commercial Code, D. Fenton Adams

University of Arkansas at Little Rock Law Review

The principal focus of Article 9 of the Uniform Commercial Code (UCC) has always dealt with transactions intended by the parties to create security interests in personal property. In 1998, the sponsors of the UCC approved a sweeping revision of Article 9; however, the main focus of the Article was not changed. § 9-109(a)(1) of revised Article 9 provides: "[e]xcept as otherwise provided in subsection (c) and (d), this Article applies to (1) a transaction, regardless of its form, that creates a security interest in personal property or fixtures by contract," and § 1-201(37) of the Code, although modified to …

Putting It All Together: Law Schools' Role In Improving Appellate Practice, Stella J. Phillips Oct 2008

Putting It All Together: Law Schools' Role In Improving Appellate Practice, Stella J. Phillips

University of Arkansas at Little Rock Law Review

Lawyers make four critical mistakes in current appellate practice. First, many appellants' lawyers do not seem to understand that only some orders may be appealed. Second, appellants often lose their appeals because of the issues about which they argue have not been preserved in the lower court for appellate review. Third, many appellants are unsuccessful because they frame their argument without reference to the appropriate standard of review. Finally, the pressure of client’s expectations and filing deadlines often leads lawyers to become careless when preparing their briefs.

Appellants must know and adhere to court rules about the content, composition, and …

Securities Law—The Securities Exchange Act Of 1934—'Round And 'Round We Go: The Supreme Court Again Limits The Circumstances In Which Federal Courts May Hold Secondary Actors Liable Under Section 10(B) And Sec Rule 10b-5. Stoneridge Investment Partners, Llc V. Scientific-Atlanta, Inc., 128 S. Ct. 761 (2008)., W. Taylor Marshall

University of Arkansas at Little Rock Law Review

In Stoneridge Investment Partners, LLC v. Scientific-Atlanta, Inc., the Supreme Court addressed the plaintiffs' bar's most recent theory for recovery against secondary actors under section 10(b): "scheme liability." Rejecting the theory as beyond the scope of liability intended by Congress, the court sharply narrowed the circumstances under which courts may hold secondary actors liable under section 10(b) and SEC Rule 10b-5. Although Stoneridge clearly limits the circumstances in which federal courts may hold secondary actors liable under section 10(b) and SEC Rule 10b-5, lower federal courts have historically alleviated the harshness of the Supreme Court's approach to securities litigation by …

Review Of Ethnomedicinal Uses And Pharmacology Of Evolvulus Alsinoides Linn., Amritpal Singh

Ethnobotanical Leaflets

Evolvulus alsinoides L. (Convolvulaceae) is used as nootropic or brain-tonic in traditional systems of medicine like Ayurveda and Unani. The plant is used by certain ethnic races across India, Africa and Philippines to cure fever, cough and cold, venereal diseases, azoospermia, adenitis, and depression. Pre-clinical (in vivo and vitro) investigations have demonstrated anti-amnesic, antistress (adaptogenic), antimicrobial and gastro protective activity. Although clinical-studies are warranted for potential use of E. alsinoides in treating dementia, pre-clinical research has justified the ancient claim of ‘brain-tonic.' The review summarizes ethno medicinal uses and pharmacological investigations carried on the medicinal plant.

Working Papers

This paper seeks to expand upon what we know regarding the structure of interest group networks. To explore the potential for Social Network Analysis in the larger context of group behavior and information sharing, we make use of existing federal contribution data to explore how non-corporate political action committees are linked to one another at the federal level via regulated campaign finance. Thus, we explore the density of networks, who the central players are and group relationships with respect to investment behavior. Here, we make use of FEC contribution data from the 2000 electoral cycle to describe and explore the …

Faculty, Staff and Student Publications

Attention has recently been drawn to Enterococcus faecium because of an increasing number of nosocomial infections caused by this species and its resistance to multiple antibacterial agents. However, relatively little is known about the pathogenic determinants of this organism. We have previously identified a cell-wall-anchored collagen adhesin, Acm, produced by some isolates of E. faecium, and a secreted antigen, SagA, exhibiting broad-spectrum binding to extracellular matrix proteins. Here, we analysed the draft genome of strain TX0016 for potential microbial surface components recognizing adhesive matrix molecules (MSCRAMMs). Genome-based bioinformatics identified 22 predicted cell-wall-anchored E. faecium surface proteins (Fms), of which 15 …

Educating The Whole Child: The Real Story Of Wholeness And Belonging, Stephanie Pace Marshall Oct 2008

Educating The Whole Child: The Real Story Of Wholeness And Belonging, Stephanie Pace Marshall

Publications & Research

In her 2008 keynote address to the Massachusetts ASCD, Dr. Stephanie Pace Marshall outlines why we--as leaders, storytellers and mapmakers--must ensure that the story, map, and landscape of schooling does not constrain our children’s potentials, silence their spirit, demean their passion, ridicule their dreams, or deny them access to wisely learn whatever it is that they want to know.
