Contact With Nature, Sense Of Humor, And Psychological Well-Being, Thomas R. Herzog, Sarah J. Strevey Nov 2008

Contact With Nature, Sense Of Humor, And Psychological Well-Being, Thomas R. Herzog, Sarah J. Strevey

Peer Reviewed Articles

We administered a questionnaire measuring contact with nature, sense of humor, and psychological well-being. Factor analysis of the humor items yielded four factors: humor production, humor appreciation, coping humor, and humor tolerance. Factor analysis of 14 well-being measures yielded three factors: emotional well-being, personal development, and effective functioning. The best sense-of-humor predictor of the well-being measures and factors was humor appreciation. Regression models for each of the well-being factors as dependent variables with humor appreciation and contact with nature as independent variables showed that additive models with both predictors were appropriate for personal development and effective functioning and that a …

What Story Got Wrong - Federalism, Localist Opportunism And International Law, Paul B. Stephan Nov 2008

What Story Got Wrong - Federalism, Localist Opportunism And International Law, Paul B. Stephan

Missouri Law Review

I first explain the theoretical underpinning of the argument against the inevitability of localist opportunism. I then illustrate the general theory with three examples where the international obligations of the United States can be met without the strong federal supervision that Story deemed necessary and that latter-day nationalists embrace. I first discuss the body of law that was the subject of Swift v. Tyson, namely the rules governing negotiable instruments. Story thought that developing a federal common law was necessary to thwart idiosyncratic, and presumably opportunistic, state decisions. Yet both before and after the overthrow of Swift v. Tyson in …

Does It Make A Difference - Granting Public Employees The Right To Collectively Bargain, Amanda Stogsdill Nov 2008

Does It Make A Difference - Granting Public Employees The Right To Collectively Bargain, Amanda Stogsdill

Missouri Law Review

In Independence-National Education Ass'n v. Independence School District, the Missouri Supreme Court granted public employees the right to collectively bargain. This holding breathed new life into an argument more than sixty years old: that the Missouri Constitution grants both public and private sector employees the right to collectively bargain. However, a close reading of this seemingly landmark case shows that Missouri's highest court smothered the numerous possibilities afforded by this holding before they could be tested by both public employers and public employees. This Note will argue that the Missouri Supreme Court's holding was unnecessary and affords no new rights …

The Quiet Revolution Revived: Sustainable Design, Land Use Regulation, And The States, Sara C. Bronin Nov 2008

The Quiet Revolution Revived: Sustainable Design, Land Use Regulation, And The States, Sara C. Bronin

Cornell Law Faculty Publications

Thirty-seven years ago, a book called The Quiet Revolution in Land Use Control argued that states would soon take over localities' long-held power over land use regulation. In the authors' view, this quiet revolution would occur when policymakers and the public recognized that certain problems - like environmental destruction - were too big for localities to handle on their own. Although the quiet revolution has not yet occurred, this Article suggests that it will, and should, occur alongside the ever-growing green building movement. This movement presents practical and ideological challenges to our current system of regulating land use. This Article …

Direct Threat Defense Under The Ada: Posing A Threat To The Protection Of Disabled Employees, The, Rene L. Duncan

Missouri Law Review

The Americans with Disabilities Act was passed with intentions of eliminating stereotypes and fear towards disabled individuals and their ability to function and contribute to society. In the employment context, the Act will not permit an employer to refuse to hire an individual solely because of that person's disability. However, it will permit the employer to defend such action when limitations caused by an individual's disability rise to the level of a direct threat to the safety of others. When an employer raises such a defense, circuit courts are split as to whether the burden of proving the existence or …

Federalism And International Law Through The Lens Of Legal Pluralism, Paul Schiff Berman Nov 2008

Federalism And International Law Through The Lens Of Legal Pluralism, Paul Schiff Berman

Missouri Law Review

In this brief Essay, then, I wish to engage in a thought experiment by looking at both federalism and international law through a pluralist rather than a sovereigntist lens. First, I summarize the pluralist literature and some of its core insights and suggest that scholars interested in international law (and its relationship with domestic law) would do well to consider this literature. Second, I provide a few examples of jurisdictional redundancy operating in the transnational, international, and federalist realm and show how the existence of multiple fora can both empower voices that might otherwise be silenced and effect changes of …

Dental Hygiene Master's Papers and Projects

This document presents a review of the literature addressing education, healthcare, healthcare delivery and finance in Pakistan and the oral health status of the Pakistani people. Moreover, it offers recommendations for competency-based dental hygiene education and practice, professional licensing, a practice act, and a dental hygiene scope of practice to help protect the welfare of the Pakistani public, i.e., increasing the …

Centralized College Client Database Creation From Diverse Interrelated Sources, George Hogan Nov 2008

Centralized College Client Database Creation From Diverse Interrelated Sources, George Hogan

Masters Theses & Doctoral Dissertations

This "Centralized College Client Database Creation from Diverse Interrelated Sources" project was undertaken as a solution for a requirement that exists for the college that I am employed. This requirement was to provide a complete (technology asset wise) profile of college employees, administrative and faculty, which I have called "clients". This is due to the fact that they are clients for the services of the Information Technology Department, for which this system was designed. The main problem to address is that there is no concise information readily available to the Help Desk and Technical Support areas, for which I am …

The Persistence Of Sleep Disturbance In Children Evaluated For Autism Spectrum Disorders: Predictive Factors And The Impact Of Co-Occurring Diagnoses, Celeste Elana Flachsbart Nov 2008

The Persistence Of Sleep Disturbance In Children Evaluated For Autism Spectrum Disorders: Predictive Factors And The Impact Of Co-Occurring Diagnoses, Celeste Elana Flachsbart

Doctor of Psychology (PsyD)

Mounting research suggests that children with autism spectrum disorders (ASDs) and other clinical diagnoses demonstrate a higher prevalence of sleep problems than typically-developing children. Additionally, sleep problems are related to a number of cognitive, emotional, and behavioral concerns in pediatric populations. Limited research exists comparing sleep problems in children with ASDs with sleep problems in other clinical populations, or exploring the length of these sleep problems.

The current study sought to explore the development and improvement of sleep problems over one year, as well as predictors to help identify children at high risk for persistent sleep problem. Impact of age, …
