Real Property, Linda S. Finley Dec 2007

Real Property, Linda S. Finley

Mercer Law Review

Each year, as the number of cases involving real property reported by Georgia's appellate courts continues to increase, it becomes more and more difficult to determine which cases to include in this survey Article. Nevertheless, this Article discusses case law and legislative developments in Georgia real property law from June 1, 2006 through May 31, 2007, selected either for their significance to real property law, to update attorneys who either regularly or from time to time practice or render opinions regarding real property, or to survey trends. However, as the reader may see, at times the cases surveyed were selected …

Business in Nebraska

The crisis in the housing and financial sectors has led to a dramatic slowdown in U.S. economic growth. Fourth quarter GDP growth and job growth are expected to be anemic and the economy may fall into recession in 2008. Indeed, several of the dozen members of the Nebraska Business Forecast Council do believe that the U.S. economy will likely slip into recession during 2008. However, the overall consensus of the Council is that the U.S. economy will avoid a recession. Economic growth will be slow in the first three quarters of 2008 before recovering in late 2008 and 2009.

Justice For None: The Fourth Circuit's Decision In Denny V. Elizabeth Arden Salons, Inc. Undermines The Civil Rights Act Of 1964., Sarah Martinez Dec 2007

Justice For None: The Fourth Circuit's Decision In Denny V. Elizabeth Arden Salons, Inc. Undermines The Civil Rights Act Of 1964., Sarah Martinez

The Scholar: St. Mary's Law Review on Race and Social Justice

Since Congress passed the Civil Rights Act of 1964, courts continue to grapple with identifying what establishments qualify as public accommodations. More specifically, the most contested section covers places of entertainment. There is a split in interpretation regarding whether to include establishments not expressly listed. The Fourth Circuit Court of Appeals, in Denny v. Elizabeth Arden Salons, Inc., ruled to exclude establishments not expressly listed, applying a strict textual approach. This Court’s ruling directly undermines the Civil Rights Act’s purpose of affording equal protection by drawing arbitrary distinctions between full-service spas and other spas. The Fourth Circuit Court’s narrow interpretation …

A Discrete Event Based Stochastic Simulation Approach For Studying The Dynamics Of Biological Networks, Samik Ghosh

Computer Science and Engineering Dissertations - Archive

With increasing availability of data resources on the molecular parts of a living cell, biologists are focusing on holistic understanding of cellular mechanisms and the emergent dynamics arising out of their complex interactions. Comprehending the fine-grained signal specificity, gene regulation and feedback mechanisms of molecular interactions at a network level forms a central theme of systems biology. With the speed and sophistication of computational methods, in silico modeling and simulation techniques have become a powerful tool for biologists challenged with understanding the system complexity of biological networks. Numerical simulation of classical chemical kinetics (CCK), agent-based simulations of biological processes, and …

Industrial And Competition Policies In Mexico, Eduardo Perez Motta Dec 2007

Industrial And Competition Policies In Mexico, Eduardo Perez Motta

Chicago-Kent Law Review

Until the 1980s, the Mexican economy was closed and strongly directed and controlled by the central government. However, starting with the second half of this decade and continuing into the 1990s, a marked change in industrial policy sought to create conditions that would open the economy and foster competition and economic efficiency. This process was undertaken by implementing a first generation of reforms, which included policies designed to attain macroeconomic stability, trade openness, and a modernization of the regulatory framework. A second generation of reforms included the application of horizontal instruments, like standardization and metrology; the passing of new laws, …

What Is The Point Of International Criminal Justice?, Mirjan Damaška Dec 2007

What Is The Point Of International Criminal Justice?, Mirjan Damaška

Chicago-Kent Law Review

The first part of the article discusses the goals international criminal courts have set for themselves. The author believes that these goals are too numerous, that they are often in conflict, and that the courts are not well suited for the achievement of some of them. This situation generates disparity between the courts' aspiration and achievement, a degree of disorientation, and difficulty in assessing the courts' performance. Disillusionment stemming from unfulfilled expectations, and inconsistencies springing from disorientation, are harmful to any system of justice, and especially to international criminal courts whose legitimacy is still fragile.

In the second part of …

Transmission Scheduling In Sensor Networks Via Directed Edge Coloring, Maggie Xiaioyan Cheng, Li Yin Dec 2007

Transmission Scheduling In Sensor Networks Via Directed Edge Coloring, Maggie Xiaioyan Cheng, Li Yin

Computer Science Faculty Research & Creative Works

This paper presents a transmission scheduling scheme in sensor networks. Each node is assigned a list of time slots to use for unicasting and broadcast communication. the algorithm employs edge coloring on a directed graph for transmission scheduling. It is different from previous works that use vertex coloring of a graph for node scheduling, or those that use edge coloring of undirected graphs for link scheduling. the proposed algorithm uses the least number of time slots compared to its counterparts and it avoids both the hidden terminal problem and the exposed terminal problem in both unicast and broadcast communication. ©2007 …

The Relationship Between Length Of Kindergarten Day And Student Literacy And Math Achievement, Cheri Nicole Oliver Dec 2007

The Relationship Between Length Of Kindergarten Day And Student Literacy And Math Achievement, Cheri Nicole Oliver

Dissertations

With the demands of increased student achievement and the reauthorization of No Child Left Behind (NCLB), educators and policy-makers alike are questioning the effect of full-day kindergarten. The purpose of this study was to determine the relationship between students who attended full-day kindergarten and their second grade literacy and math achievement and students who attended half-day kindergarten and their second grade literacy and math achievement.

Results from the Stanford Achievement Test administered in the fall of 2007 were analyzed for statistically significant differences between the two second grade groups of students. Analysis of the data showed no statistical difference between …

Phylogeny Of The Grasses (Poaceae) Revisited, Melvin R. Duvall, Jerrold I Davis, Lynn G. Clark, Jeffrey D. Noll, Douglas H. Goldman, J. Gabriel Sánchez-Ken Dec 2007

Phylogeny Of The Grasses (Poaceae) Revisited, Melvin R. Duvall, Jerrold I Davis, Lynn G. Clark, Jeffrey D. Noll, Douglas H. Goldman, J. Gabriel Sánchez-Ken

Aliso: A Journal of Systematic and Floristic Botany

The most robust previously published phylogeny for the overall structure of the grass family (Poaceae) shows three early diverging lineages and two major derived clades, the BEP clade and the PACCAD clade (Grass Phylogeny Working Group 2001). A few key taxa were incompletely sampled, however, and support for the BEP clade was moderate at best and relationships among the major lineages within the PACCAD clade remained unresolved. In addition, recent studies indicated that the sister group to Poaceae may be Joinvilleaceae and/or Ecdeiocoleaceae, the latter of which were not previously sampled. In this study, missing structural data were determined and …

Phylogeny And Biogeography Of Endemic Festuca (Poaceae) From New Zealand Based On Nuclear (Its) And Chloroplast (Trnl–Trnf) Nucleotide Sequences, Kelvin M. Lloyd, Angela M. Hunter, David A. Orlovich, Suzanne J. Draffin, Alan V. Stewart, William G. Lee Dec 2007

Phylogeny And Biogeography Of Endemic Festuca (Poaceae) From New Zealand Based On Nuclear (Its) And Chloroplast (Trnl–Trnf) Nucleotide Sequences, Kelvin M. Lloyd, Angela M. Hunter, David A. Orlovich, Suzanne J. Draffin, Alan V. Stewart, William G. Lee

Aliso: A Journal of Systematic and Floristic Botany

We investigated the phylogenetic relationships of the endemic New Zealand (NZ) species of Festuca (Poaceae, Pooideae) by assessing sequence variation from the nuclear internal transcribed spacers (ITS) and a chloroplast intergenic spacer (trnL–trnF) and by measuring DNA content using flow cytometry. The ITS and trnL–trnF data sets were congruent in showing that the NZ species of Festuca have two origins. One group, containing F. coxii, F. luciarum, F. multinodis, and F. ultramafica, is closely related to Festuca sect. Aulaxyper. The other group includes a clade of five endemic …

Relationships Among Some Populations Of Anthoxanthum Alpinum And A. Odoratum (Poaceae, Pooideae): A Morphological/Anatomical Approach, Manuel Pimentel, Elvira Sahuquillo

Aliso: A Journal of Systematic and Floristic Botany

The genus Anthoxanthum s.l. (including Hierochloë) (Poaceae, Pooideae, Aveneae) comprises 35–50 species and has a cosmopolitan distribution. Anthoxanthum alpinum was described as a diploid perennial that is distributed in northern Eurasia and in the high mountains of central and eastern Europe. Difficulties in finding reliable morphological differences between this taxon and the widespread tetraploid A. odoratum have resulted in taxonomists treating them as conspecific, despite the cytological differentiation. The purpose of this study was to provide information that may help clarify the relationships between these taxa. Macromorphologial, micromorphological, and anatomical data were gathered and analyzed for 14 populations representing …

Systematics Of Bromelioideae (Bromeliaceae)—Evidence From Molecular And Anatomical Studies, Ralf Horres, Katharina Schulte, Kurt Weising, Georg Zizka

Aliso: A Journal of Systematic and Floristic Botany

A reconstruction of the phylogeny of Bromeliaceae based on sequence data from three noncoding chloroplast DNA markers (trnL intron, trnT–trnL, and trnT–trnF intergenic spacer [IGS]) is presented, including 26 genera and 33 species. Relationships of Bromelioideae and phylogeny within this subfamily were analyzed in more detail on the basis of two of these markers (trnL intron and trnL–trnF IGS) using a set of 37 genera/74 species of Bromeliaceae, including 28 genera/60 species of Bromelioideae. Sister group relationships of Bromelioideae were not resolved with sufficient reliability, but the …

Phylogeny Of Abildgaardieae (Cyperaceae) Inferred From Its And Trnl–F Data, Kioumars Ghamkhar, Adam D. Marchant, Karen L. Wilson, Jeremy J. Bruhl Dec 2007

Phylogeny Of Abildgaardieae (Cyperaceae) Inferred From Its And Trnl–F Data, Kioumars Ghamkhar, Adam D. Marchant, Karen L. Wilson, Jeremy J. Bruhl

Aliso: A Journal of Systematic and Floristic Botany

Within the tribe Abildgaardieae, the relationships between Fimbristylis and its relatives have not been certain, and the limits of Fimbristylis have been unclear, with Bulbostylis and Abildgaardia variously combined with it and each other. The relationships and limits of tribes Abildgaardieae and Arthrostylideae and their genera were evaluated across 49 representative species using parsimony and maximum likelihood analyses of ITS (nuclear ribosomal) and trnL–F (plastid) DNA sequence data separately and combined. The evolutionary reconstructions derived from sequences of cpDNA and nrDNA disagree about the position of tribe Arthrostylideae relative to Abildgaardieae; Arthrostylis and Actinoschoenus are either nested within Abildgaardieae …

Phylogeny And Historical Ecology Of Rhodocoma (Restionaceae) From The Cape Floristic Region, Christopher R. Hardy, H. Peter Linder Dec 2007

Phylogeny And Historical Ecology Of Rhodocoma (Restionaceae) From The Cape Floristic Region, Christopher R. Hardy, H. Peter Linder

Aliso: A Journal of Systematic and Floristic Botany

A macroevolutionary analysis of macroecological relationships in Rhodocoma revealed a complex history of rapid ecological divergence, as well as genetic isolation via shifts in flowering times. The rate and extent of divergence observed among even the youngest of species pairs indicated that the selective forces driving these processes are strong enough to effect substantial amounts of ecological change in relatively short periods of time, and are potentially important factors promoting the origin and persistence of species diversity not only in Rhodocoma, but also the African Restionaceae as a whole. These results also suggest that the rate and extent of …

Large Trees, Supertrees, And Diversification Of The Grass Family, Trevor R. Hodkinson, Nicolas Salamin, Mark W. Chase, Yanis Bouchenak-Khelladi, Stephen A. Renvoize, Vincent Savolainen Dec 2007

Large Trees, Supertrees, And Diversification Of The Grass Family, Trevor R. Hodkinson, Nicolas Salamin, Mark W. Chase, Yanis Bouchenak-Khelladi, Stephen A. Renvoize, Vincent Savolainen

Aliso: A Journal of Systematic and Floristic Botany

Phylogenetic studies of grasses (Poaceae) are advanced in comparison with most other angiosperm families. However, few studies have attempted to build large phylogenetic trees of the family and use these for evaluating patterns of diversification or other macroevolutionary hypotheses. Two contrasting approaches can be used to generate large trees: supermatrix analyses and supertrees. In this paper, we evaluated the suitability of each of these methods for the study of patterns and processes of evolution in the grasses. We collected data from DDBJ/EMBL/GenBank to determine sequence availability and asked how far we are from a complete generic-level phylogenetic tree of the …
