Undermining Individual And Collective Citizenship: The Impact Of The Exclusion Laws On The African-American Community, S. David Mitchell Jan 2007

Undermining Individual And Collective Citizenship: The Impact Of The Exclusion Laws On The African-American Community, S. David Mitchell

Fordham Urban Law Journal

The purpose of this Article is to demonstrate that felon exclusion laws are not race neutral and that the application of the laws has a racially discriminatory effect, and to call for their abolition. The laws contribute to the erosion of citizenship rights for the individual African-American ex-felon, and the undermining of the collective citizenship rights of the larger African-American community. Part II discusses the conceptualization of citizenship that underscores the premise of the Article. Part III discusses the exclusions that ex-felons encounter and the resulting impact on the individual and the community. Using Alabama as a case study, Part …

The Role Of The Federal Government In Overseeing Medical Research, Gil Van Bokkelen Jan 2007

The Role Of The Federal Government In Overseeing Medical Research, Gil Van Bokkelen

Journal of Law and Health

The United States enjoys a unique position among the world community in a number of respects. Although it is not the largest or most populated country in the world, the United States is considered one of the wealthiest. Our significant national wealth affords us with some interesting opportunities. In particular, it allows us to devote a portion of those resources towards causes that we as a nation feel are worthy and significant. For example, such causes include charitable aid programs, in the name of promoting global economic development and world peace. The United States leads in this category as well, …

Restricting Access To Unapproved Drugs: A Compelling Government Interest , Peter M. Currie Jan 2007

Restricting Access To Unapproved Drugs: A Compelling Government Interest , Peter M. Currie

Journal of Law and Health

The prospective review and approval of drugs is central to the public health mission of the United States Food and Drug Administration (FDA). Requiring pharmaceutical manufacturers to generate information about their products' safety and efficacy enables the agency to evaluate the risks and benefits associated with their use, thereby preventing overly harmful products from reaching the market. The majority of consumers benefit from this intervention by gaining access to an array of drugs that are proven to be safe and effective. Thus, governmental regulation in this area is arguably justified because the aggregate social welfare is substantially improved. However, this …

Equal Access To Post-Secondary Education: The Sisyphean Impact Of Flagging Test Scores Of Persons With Disabilities , Helia Garrido Hull Jan 2007

Equal Access To Post-Secondary Education: The Sisyphean Impact Of Flagging Test Scores Of Persons With Disabilities , Helia Garrido Hull

Cleveland State Law Review

In view of the social stigma associated with disabilities, and the inherent costs of providing accommodations to disabled students, the opportunity for bias within the admissions selection process is clear. As a result, the practice of flagging standardized tests has come under increasing scrutiny. The practice of distinguishing test takers having a disability from those who do not runs counter to the social policy of inclusion, and prevents disabled individuals from enjoying the benefits of equal citizenship. Part II of this paper provides a brief overview of the prejudice disabled individuals have endured throughout history, and discusses some early movements …

Law As Symbol: Appearances In The Regulation Of Investment Advisers And Attorneys , Larry D. Barnett Jan 2007

Law As Symbol: Appearances In The Regulation Of Investment Advisers And Attorneys , Larry D. Barnett

Cleveland State Law Review

From a macrosociological perspective, law is an institution of society, is shaped by conditions in society, and facilitates social life by interalia producing symbols. Law accordingly adopts concepts and principles that focus on the appearance to society of certain phenomena and that are symbols when the phenomena are socially significant. To illustrate symbols in law, the article examines (i) the "hold oneself out" standard in defining an investment adviser under the federal Investment Advisers Act and (ii) the standard for ethical conduct that requires attorneys to avoid appearances of impropriety. If symbolic concepts and principles are tied to the properties …

Leadership, Communication And Religiosity In Higher Education Administration: Distinctions That Make A Difference, G. L. Forward, Kathleen Czech, Patrick Allen

Faculty Publications - College of Education

This project investigated the communicative and religious components of transformational leadership and job satisfaction in the context of higher education. Specifically, 224 CAO members of the Council of Independent Colleges completed a survey assessing their own leadership style, communication behavior, and religiosity. A stepwise multiple regression procedure revealed seven significant predictors of transformational leadership. The most important variables included attentiveness, openness, role negotiation, and intrinsic religious orientation. Additionally, a t-test compared a subset of CAOs from institutions affiliated with the Council of Christian Colleges and Universities with CAOs in non-affiliated institutions. Results revealed statistically significant differences in attentiveness, information support, …

Pyruvate Transport In Isolated Cardiac Mitochondria From Two Species Of Amphibian Exhibiting Dissimilar Aerobic Scope: Bufo Marinus And Rana Catesbeiana, Jeff Duerr, Kristina Tucker Jan 2007

Pyruvate Transport In Isolated Cardiac Mitochondria From Two Species Of Amphibian Exhibiting Dissimilar Aerobic Scope: Bufo Marinus And Rana Catesbeiana, Jeff Duerr, Kristina Tucker

Faculty Publications - Department of Biological & Molecular Science

Cardiac mitochondria were isolated from Bufo marinus and Rana catesbeiana, two species of amphibian whose cardiovascular systems are adapted to either predominantly aerobic or glycolytic modes of locomotion. Mitochondrial oxidative capacity was compared using VO2 max and respiratory control ratios in the presence of a variety of substrates including pyruvate, lactate, oxaloacetate, b-hydroxybutyrate, and octanoyl-carnitine. B. marinus cardiac mitochondria exhibited VO2 max values twice that of R. catesbeiana cardiac mitochondria when oxidizing carbohydrate substrates. Pyruvate transport was measured via a radiolabeled-tracer assay in isolated B. marinus and R. catesbeiana cardiac mitochondria. Time-course experiments described both a-cyano-4- hydroxycinnamate-sensitive (MCT-like) and phenylsuccinate-sensitive …

Three-Dimensional Kinematics Of Hummingbird Flight, Bret W. Tobalske, Douglas R. Warrick, Christopher J. Clark, Donald R. Powers, Tyson L. Hendrick, Gabriel A. Hyder, Andrew A. Biewener

Faculty Publications - Department of Biological & Molecular Science

Hummingbirds are specialized for hovering flight, and substantial research has explored this behavior. Forward flight is also important to hummingbirds, but the manner in which they perform forward flight is not well documented. Previous research suggests that hummingbirds increase flight velocity by simultaneously tilting their body angle and stroke-plane angle of the wings, without varying wingbeat frequency and upstroke: downstroke span ratio. We hypothesized that other wing kinematics besides stroke-plane angle would vary in hummingbirds. To test this, we used synchronized highspeed (500·Hz) video cameras and measured the threedimensional wing and body kinematics of rufous hummingbirds (Selasphorus rufus, 3·g, N=5) …

The Aerodynamics Of Hummingbird Flight, Douglas R. Warrick, Bret W. Tobalske, Donald R. Powers, Michael H. Dickenson Jan 2007

The Aerodynamics Of Hummingbird Flight, Douglas R. Warrick, Bret W. Tobalske, Donald R. Powers, Michael H. Dickenson

Faculty Publications - Department of Biological & Molecular Science

Hummingbirds fly with their wings almost fully extended during their entire wingbeat. This pattern, associated with having proportionally short humeral bones, long distal wing elements, and assumed to be an adaptation for extended hovering flight, has lead to predictions that the aerodynamic mechanisms exploited by hummingbirds during hovering should be similar to those observed in insects. To test these predictions, we flew rufous hummingbirds (Selasphorus rufus, 3.3 g, n = 6) in a variable–speed wind tunnel (0-12 ms-1) and measured wake structure and dynamics using digital particle image velocimetry (DPIV). Unlike hovering insects, hummingbirds produced 75% of their weight support …

“Carbachol Regulation Of Erk And The Transcription Factor Elk-1 In Mcf-7 Breast Cancer Cells, John M. Schmitt, Andrea Wagner

Faculty Publications - Department of Biological & Molecular Science

Abstract Cancer has numerous molecular, biochemical and physiological hallmarks including uncontrolled cell growth and proliferation. Previous studies on MCF-7 breast cancer cells have shown that both intracellular calcium levels and the extracellular signal-regulated protein kinase (ERK) is activated downstream of the G-protein coupled receptor (GPCR) agonist, carbachol. Calcium/calmodulin regulate the calcium/calmodulin-dependent kinase (CaM Ks) family of proteins that have been proposed to regulate ERK and transcription. Our goal was to determine the mechanism of carbachol activation on ERK and the transcription factor Elk-1 in MCF-7 cells. Our results suggest that 10 μM carbachol treatment of MCF-7 cells triggers ERK1/2 phosphorylation …

Predictors Of Middle School Girls' Engagement In Suspendable School Offenses., Barbara Harlow Cavanaugh Jan 2007

Predictors Of Middle School Girls' Engagement In Suspendable School Offenses., Barbara Harlow Cavanaugh

Walden Dissertations and Doctoral Studies

Despite research evidence that social context and personal characteristics are related to girls' violent behavior, little is known about the relative contribution of such antecedents. Therefore, the purpose of this study was to assess the relative strength of predictors of school violence among a sample of middle school girls. Of special interest were the intervening variables, because knowledge of their relative strength could enable schools to design targeted interventions to reduce school violence. Social learning theory formed the theoretical foundation for the study. A four-part survey consisting of sociodemographic items, the Rosenberg Self-Esteem Scale, an amended version of the Attitudes …

Effects Of Density And Habitat Structure On Growth And Survival Of Harvested Coral Reef Fishes, Clare Louise Wormald Jan 2007

Effects Of Density And Habitat Structure On Growth And Survival Of Harvested Coral Reef Fishes, Clare Louise Wormald

Open Access Dissertations

This study examines four species of ecologically similar, harvested coral-reef fishes to evaluate the influences of habitat on density, growth, and survival and tests for density dependence in growth and survival. I studied populations of Lutfanus apodus, L. synagris, Haemulon flavolineatum and H. plumierii on 8 coral reefs in the Bahamas using underwater visual surveys and mark-recapture studies. For L. apodus I used a large-scale density manipulation experiment to uncouple the relationship between density and habitat. I conducted field and laboratory tests of some of the critical assumptions of mark-recapture methods to ensure that my estimates of growth and survival …

Managing Marine Resource Use Conflicts: Marine Sand Mining In Korea, Tae-Goun Kim Jan 2007

Managing Marine Resource Use Conflicts: Marine Sand Mining In Korea, Tae-Goun Kim

Open Access Dissertations

Management of conflicts between resources uses is a major focus of research in environmental economics and a major concern for decision makers and affected parties. While economic simulation models and quantitative methods can be used to improve the information available to decision makers regarding efficient resource uses and the distribution of gains and losses, the analysis of natural resource systems and the services they provide raises very complex issues. This is because such analysis must include not only an appropriate economic framework but also must integrate economics with relevant information from related disciplines, such as fisheries, aspects of geology, and …

Korean Fisheries: Policies, Stock Assessment And Compliance Issues, Jong-Oh Nam

Open Access Dissertations

The first manuscript examines the status and trends of the current Korean fisheries management regime. Specifically, this paper describes the Korean conventional fisheries management regime and discusses its problems and limitations. In describing policy evolution, I find reasons why the Korean government has chosen a TAC system, an output control approach, besides input control approaches which have been in force for almost a century. Also described is evolution of the Korean TAC system, which plays a pivotal role in Korean fisheries development. Finally, I give a perspective on expanding the Korean TAC system toward Output Control Systems. This second manuscript …

The Destruction Of Skeletal Elements By Carnivores: The Growth Of A General Model For Skeletal Element Destruction And Survival In Zooarchaeological Assemblages, Naomi Cleghorn, Curtis W. Marean

Sociology & Anthropology Faculty Publications - Archive

In the 1960s, Brain published on a series of taphonomic studies in which he observed the destruction of goat bones by pastoralists and domestic dogs. Those studies were notable and novel for a variety of reasons: 1) the attempt to control for complex parameters through the use of what we now recognize as experimental and naturalistic actualism, 2) documentation of the destructive impact on skeletal element abundance by secondary carnivore consumers, and 3) the attempt to understand the mechanical aspects of this process, and thus establish the foundation for justifiable uniformitarianism. This work set the stage for a proliferation of …

New Ways Of Thinking About Cultural Property: A Critical Appraisal Of The Antiquities Trade Debates, Alexander A. Bauer Jan 2007

New Ways Of Thinking About Cultural Property: A Critical Appraisal Of The Antiquities Trade Debates, Alexander A. Bauer

Fordham International Law Journal

In debates over the trade in archaeological objects or antiquities, on one end are those who believe that everyone has a shared interest in and claim to the common heritage of humanity, and thus support a vibrant and legal trade in cultural materials. On the other end are those who believe that cultural objects have special significance for specific groups and thus support the efforts of such groups to regulate their trade and seek their repatriation. The aim of this Essay is to critically examine the components of each group's arguments--their goals, assumptions, and inconsistencies--and try, where possible, to identify …
