This paper examines a recent twist in EU data protection law. In the 1990s, the European Union was still primarily a market-creating organization and data protection in the European Union was aimed at rights abuses by market actors. Since the terrorist attacks of New York, Madrid, and London, however, cooperation on fighting crime has accelerated. Now, the challenge for the European Union is to protect privacy in its emerging system of criminal justice. In 1996, Congress passed the Telecommunications Act, substantially revising the Communications Act of 1934 to reflect technological advances, including the Internet, and Congress's deregulatory goals. Currently, however, new technologies are challenging the viability of the statutory definitions and regulatory schemes of the statute. Internet telephony, commonly called Voice over Internet Protocol (VoIP), is both a replacement for traditional telephone service and a new web-based technology. Given the current competitive political climate and the magnitude of the interests involved, Congress is unlikely to succeed in altering the telecommunications regime. Clinical Treatment Provider Attitudes Toward Sexual Offender Management Within An Outpatient Treatment Center : Treatment Provider Attitude Survey, Dustan A. Barabas

The present study's foundation is based on research suggesting that the attitudes of clinicians regarding their clients have profound effects on therapeutic alliances, empathy, and staff burnouts, which may contribute to treatment barriers. Because professionally appropriate behavior often conceals stigma, misconceptions, and negative feelings that clinicians may have toward sexual offenders, an anonymous survey of attitudes, job burnout, and empathy was conducted in an outpatient setting. The survey instruments tap into some latent factors concerning the attitudes of clinicians, their perceptions of burnout, and their abilities to empathize with their clients. Unintended Effects Of Corporate Social Responsibility On Corporate Reputation: When Is Doing "Good" Not Good For Business?, Eloy L. Nuñez

Companies often consider corporate social responsibility as a means of contributing to the public good, while simultaneously improving their image and reputation among its stakeholders. While the literature is replete with examples of CSR leading to improved corporate reputation, there are some notable and striking exceptions. This study examines the unintended consequences of CSR and proffers three possible explanations for why corporate social responsibility sometimes leads to negative reputation targeting.

Whether a federal statute preempts state law has important implications for the allocation of power between the federal and state governments. One aspect of preemption doctrine that has received relatively little scholarly attention is whether the federal government's failure to act is capable of preempting state law and, if so, when. In the regulatory context, Congress must first decide whether as a normative matter it should preempt state law despite its decision not to regulate activities regulated by states. Once Congress has done so, the courts may need to interpret federal legislation to determine whether Congress has decided to preempt …

Post A Message And Go To Jail: Criminalizing Internet Libel In Japan And The United States, Salil K. Mehra

University of Colorado Law Review

In the United States, criminal libel is all but dead. American law professors only write about it to denounce the continued existence of rarely enforced criminal libel statutes. In Japan, however, criminal libel laws have become vital tools in policing injurious speech on the Internet. Defamatory posts lead to police intervention and even arrest. Because the United States is considering regulation of online speech, potentially including criminal penalties, we can learn from the experience of Japan. From a positive perspective, this Article explains why Japan applies such laws to the Internet. From a normative perspective, the Article addresses why broadly …
