Biofuels, especially ethanol, are gaining attention as partial replacements of imported fuels and to offset CO2 emissions from the burning of fossil fuels. Consequently, legislation is being proposed to mandate a significant increase in ethanol usage as a fuel over the next 20 years. The planned wide-spread usage of ethanol will require an efficient and reliable transportation and storage system that encompasses both the existing infrastructure and new construction. The fuels are currently being transported by rail, truck, and ship; however, in order to economically transport biofuels from producers to users on a large scale, safe and reliable transportation by …

At a Bio-Terrorism Conference at Case Western Reserve University School of Law on March 31, 2006, the government participants were asked what they would do if a superior instructed them not to disclose information to the public about the likely grave health affects of an ongoing bio-terrorist attack. In response, they indicated that they would be reluctant to become a "whistleblower." This is not surprising since, despite the federal and state laws that purport to facilitate such whistleblowing for the public good, government whistleblowers routinely have faced loss of promotion, harassment, firing, and in some instances criminal prosecution when they …

Visual Representations Of The Spatial Relationship Between Bermuda High Strengths And Hurricane Tracks, Jason T. Knowles, Michael Leitner

The 2004 and 2005 hurricane seasons dramatically demonstrated the magnitude of the societal significance of hurricanes, negatively impacting on all scales from the personal to the national. Although definitive identification of the forcing mechanisms controlling hurricane tracks and landfall patterns remains elusive, increasing evidence supports the hypothesis that the increase in hurricane activity along the Gulf Coast is due to a southwestward shift in the position of the Bermuda High. This research uses multiple visualization techniques to explore the spatial correlation between Bermuda High strengths - as interpreted from the North Atlantic Oscillation (NAO) index - and hurricane tracks. Accounts of powerful new forensic technologies such as DNA typing, data mining, biometric scanning, and electronic location tracking fill the daily news. Proponents praise these techniques for helping to exonerate those wrongly accused, and for exposing the failings of a criminal justice system that previously relied too readily upon faulty forensic evidence like handwriting, ballistics, and hair and fiber analysis. Advocates applaud the introduction of a "new paradigm" for forensic evidence, and proclaim that these new techniques will revolutionize how the government investigates and tries criminal cases. Over the past two decades, drug treatment courts have gained traction as popular alternatives to the conventional war on drugs (and to its onedimensional focus on incarceration). Specifically, the courts are meant to divert addicts from jails and prisons and into coerced treatment. Under the typical model, a drug offender enters a plea of guilty and is enrolled in a longterm outpatient treatment program that is closely supervised by the drug court. If the offender completes treatment, his plea is withdrawn and the underlying charges are dismissed. But, if he fails, he receives an alternative termination sentence. My premise is …

Abstract
Background
Offering specialized programming at substance abuse treatment facilities can help diversify clientele and funding sources, potentially enhancing the facilities' ability to survive and/or expand. Past research has shown that facilities only offering specialized programming for driving under the influence/driving while intoxicated offenders (DUI) are predominately private-for-profit owned. As criminal justice populations, both DUI and other criminal justice offenders, comprise a large proportion of those in community-based substance abuse treatment knowing facilities' characteristics would be important for administrators and policymakers to consider when updating programming, training staff or expanding capacity to ensure efficient use of scarce resources. The State Secrets Privilege: What's Wrong With It, How It Got That Way, And How The Courts Can Fix It, Christohper D. Yamaoka

The state secrets privilege shields evidence from discovery at trial where disclosure of the evidence would threaten national security. It is an important privilege, allowing the government to protect potentially dangerous information from being exposed by way of litigation. But it is also a powerful privilege; when accepted, it often leads to outright dismissal of the case. Given its nuclear effect, expansion of the doctrine beyond its legitimate bounds is constitutionally troubling. And indeed, over the last half century, the privilege has expanded far beyond its original form: courts have grown increasingly likely to use it to dismiss litigation before …

Prototype Mixed-Signal Hardware For Public Safety Radio Interoperability, Timothy Edwood Bond

In performing their required duties public safety personnel from differing departments often need to communicate with one another using their in-car radios. However, in many cases, especially involving small departments, this interoperability doesn't exist.
A prototype circuit design has been developed and tested within the laboratory using two common radio systems: EFJohnson and Motorola. The preliminary results have shown successful operation as a system gateway between the two radio systems with good performance regarding audio signal latency and minimizing the push-to-talk signal generation delay.

This Comment first examines the issues presented in Bauer (including the holding that the Americans with Disabilities Act does not protect these volunteers from discrimination) and the court’s rationale for finding that volunteers are not protected under Title III. Part II explores the requirements and differences between Title I and Title III and provides some history of the definitions of “volunteer” and “employee.” Part III presents a public duty thesis arguing that the responsibility of providing accommodations should not belong solely to employers in the context of employees, or public accommodations in the context of patrons, but to all factions …

Mentally Ill Prisoners In The California Department Of Corrections And Rehabilitation: Strategies For Improving Treatment And Reducing Recidivism, W. David Ball

The California state prison system is proving ill-equipped to deal with the state's mentally ill prisoner population. This paper examines the ways in which mentally ill felons are not receiving adequate care while in prison as well as appropriate preparation for life after their release. The paper argues that the result is an avoidable drain on the state's budget as well as unnecessarily high recidivism rates for this population. Accordingly, constructive policy recommendations for ameliorating this shortcoming of the prison system are proposed.
