Project54 is a research and development effort to integrate embedded and wireless technologies into both NH State Police and local police cruisers. One of the features of the Project54 system, is the ability to query motor vehicle data. This is done through a Motorola APCO Project 25 digital voice/data radio in the cruiser and a digital voice/data base station at headquarters. An APCO Project 25 base station is a central hub for the transmission and reception of digital voice/data packets. The local police departments have the requisite radio infrastructure, but do not have the budget to purchase and support a …

Planning As Public Use?, Nicole Stelle Garnett

This short Essay explores the Supreme Court's suggestion in Kelo v. New London that public, participatory planning may be a constitutional safe harbor that separates impermissible private takings from presumptively valid public ones. After briefly reviewing the Court's discussion of the planning that preceded the Kelo litigation, the Essay examines how Kelo's emphasis on planning departs from standard rational basis review of economic policies and asks what such a departure means for future public-use litigants. The Essay then explores three possible practical benefits of a constitutional rule that encourages the government to engage in detailed planning before exercising the power …

At the present time, it seems safe to assume that in any case in which the President defied a direct judicial order, Congress and the people would begin with strong presumptions that it was lawless and unconstitutional for the President to disobey and that a lawless President cannot be tolerated. In acceding to direct judicial mandates in nearly all cases in constitutional history, presidents have probably made political as well as legal calculations in at least some instances. In other words, they have likely complied with judicial orders, not only because they felt that the Constitution obliged them to do …

The purposes of this study are to explore who the pioneers of youth related delinquency theories are and to examine these theories in depth to identify their importance to society as a whole and to discuss the contributions these theories have made as well as future directions of these theories pertaining to criminology and sociology. Also explored in this study are the many factors that contribute to youth becoming delinquent and characteristics of delinquent behavior.

A Spatial Model Of Regional Variations In Business Growth In Appalachian States, Gebremeskel H. Gebremariam, Tesfa Gebremedhin, Peter V. Schaeffer, Tim Phipps, Randall Jackson

In this study, a spatial growth equilibrium model of business growth is developed and empirically estimated by Generalized Spatial Two-Stage Least Squares (GS2SLS) estimator using cross-sectional data from Appalachian States counties for 1990-2000. Beside the existence of spatial spillover effects, the results suggest that agglomerative effects that arise from both the demand and the supply sides were active in contributing to business growth in the study area during the study period. The policy implications of these findings are: (1) Regional cooperation of counties and communities is advisable and may even in fact be necessary to design appropriate policies that encourage …

This article describes the complex issues facing the energy needs and policies of the United States. The article notes that the role of the United States on the world stage and the health of the public and the environment depend on successfully solving the energy puzzle to harmonize economic development, sustainable use of the resources, and public safety. The article concludes that part of the difficulty of the debate may arise from an assumption that a single solution to the problem awaits and suggests that instead the only way forward is a policy of diversification and multiple strategies, encouraging conservation …

Today, much public attention and litigation in the wake of the government's response to the September 11, 2001 attacks centers on one or another claims about the government's substantive illegality (such as claims based on the Due Process Clause). This is a mistake. Instead of focusing on the ultimate individual liberty questions, challenges should first focus on equality.
Since the terrorist attacks, the government has repeatedly singled out aliens for special disfavor. For example, the Military Commissions Act blatantly discriminates against aliens - shunting the 20 million green-card holders and 5 billion people across the planet into a different, and …

To advance social work practice and decrease the research practice gap, this dissertation followed a model development paradigm consisting of several phases. Based on the task-centered model of social work practice and motivational interviewing, a new combined model was construed. The two underlying models were analyzed and synthesized, using technical eclecticism as the integrative approach. The resulting combined model was described by guidelines and manualized. To test the combined model in an applied setting, a study was designed in collaboration with social workers at a substance abuse counseling center. For almost six years, the habeas corpus petitions brought by foreign detainees held by the United States at Guantanamo Bay, Cuba, have stalled because the courts have struggled to answer a single question: whether the detainees possess enforceable rights. Although that question remains unresolved, the courts have uniformly concluded that the Guantanamo habeas claims, as well as the habeas claims brought by other accused enemy combatants, require a showing that the detainees possess cognizable rights violated by the detentions, most especially constitutional rights.
