Relevance: Definition And Limitations-Conforming The California Evidence Code To The Federal Rules Of Evidence, Miguel A. Méndez

University of San Francisco Law Review

This Article examines from a comparative perspective the rules of evidence relating to relevance and its limits. The Article compares the approaches of the California Evidence Code ("Code") and the Federal Rules of Evidence ("Rules") to challenges to the introduction of evidence on the grounds of irrelevance or on the basis of limits placed on the introduction of relevant evidence.

The oral delivery of therapeutic compounds, from small molecules to proteins, is one of the most desirable routes of administration. Its advantages reside in low cost, patient compliance and ease of use. The major challenge associated to such a delivery route is the transport through the gastrointestinal tract (GIT). In the case of complex and fragile molecules such as proteins, this particular step is the source of multiple challenges. Among the approaches developed to protect the therapeutic compound, the use of polymeric carriers is the most promising. The strain and difficulties that plague the inner city continue to mount. As a result, youth who grow up in this environment are exposed to violence, substance abuse, inadequate education, and poverty. Although some youth become a part of the cycle that produces these unfortunate events, some are able to make it out and become assets to society. This occurrence has been termed resilience. The study of resilience continues to grow as researchers attempt to provide information for school officials, communities, and mental health practitioners about how to promote resilience in inner city youth.

This essay discusses the grounds for due process rights (DPRs) and the permissibility of suspending them during terrorist and other emergencies. The two topics are profitably treated together because DPRs - along with freedoms of movement, expression, and political participation - are often suspended or restricted when national emergencies occur. Although I present a strong case for DPRs as human rights, this justification does not settle their priority during emergency situations. That issue raises additional questions, and I discuss some of them. The overall thrust of the essay is to defend the importance of respecting DPRs during troubled times. The …

White Challengers, Black Majorities: Reconciling Competition In Majority-Minority Districts With The Promise Of The Voting Rights Act, Janai S. Nelson

Majority-minority districts have been the subject of extensive, and often rancorous, critique and debate. In their prime, these districts nearly single-handedly changed the face of American politics by enabling racial minorities to elect their preferred candidates who reflected both their interests and identity. However, precisely at the point when these districts achieve an optimal balance of majority and minority populations and host multi-candidate competition, they reveal a frailty that not only thwarts their immediate purpose but contradicts both the express and implicit goals of their source: The Voting Rights Act of 1965. This is a secondary analysis of a larger project entitled "Breast-feeding Services for LBW Infants-Outcomes and Costs" (L. Brown, RN, Ph.D., Principal Investigator), funded by NINR at NIH, (NR 03881). The larger project was a randomized clinical trial, of women planning to breast-feed their LBW infant. The control group received routine breast-feeding care and an intervention group received a structured program of breast-feeding services provided by an advanced practice nurse.

Healthy premature LBW infants from the control group were selected as subjects for this secondary analysis. One question of this secondary analysis was to describe the nutrition of healthy premature …

Even though we are discussing a case that was not decided on the merits, Nike v. Kasky is an important case because it crystallizes two of the essential critiques about the commercial speech doctrine, critiques that have run through this doctrine from before its advent in 1976 to today. The fundamental debate Nike triggered over what constitutes "commercial speech" and how strictly commercial speech should be regulated is still being played out - not just in the academy, but also in the courts on a day-to-day basis. So this is a timely and important topic.

Post-Traumatic Stress Disorder (Ptsd) In Children Following Acute Injuries Requiring Emergency Medical Care, Virginia Depp Cline

Unfortunately, one rite of passage of childhood is often serious injury that carries psychological impact along with the obvious physical repercussions. Prior studies have found conflicting results for protective/risk factors, thus this study attempted to explore PTSD in a sample of children ages seven to thirteen years of age with moderate to severe injuries. In this study (N = 32), 31.3% of children experiencing such a sudden injury requiring hospitalization at the University of Kentucky Childrens Hospital demonstrated significant indications of post-traumatic stress disorder (PTSD) following the injury. This paper outlines some aspects of process control in semiconductor manufacturing. Starting with an outline of the semiconductor manufacturing process, the contribution will discuss temperature control of the chemical vapour deposition stage and the control of the wafer etching process, based on the industrial experience of the first two authors. Subsequently, the authors draw the attention of the semiconductor manufacturing community to the potential of properly tuned PID controllers for the achievement of simple and high performance control solutions.

Recent media reports, commentators and editorials have raised questions about the growing trade deficit faced by Pakistan in the current fiscal year, as well as, about the rise in the absolute level of External Debt. In raising these issues, a serious concern has been expressed about Pakistan's ability to pay its external obligations and the impact on foreign reserves in the future. Alternatively, it is argued, that these obligations can be paid only by incurring higher debt from abroad and thus increasing debt burden.

It is time to rethink the role of Institutional Review Boards (IRBs) in approving social science research. While most law professors conduct their research in an almost unregulated environment - pouring through cases, statutes, and each other's articles, all without the kind of human interaction subject to IRB regulation - their colleagues elsewhere in the university have been coping for decades with an increasingly intrusive bureaucracy that sometimes undermines basic academic values.
