The Association Of Whole Grain Ontakes With The Metabolic Syndrome: The Baltimore Longitudinal Study Of Aging (Blsa), Janice Eileen Maras

Master's Theses and Doctoral Dissertations

Background: Whole grains and their nutrient components have an important protective effect on the metabolic syndrome. Studies are needed to examine their bioactive components in relation to diet and the metabolic syndrome.

Objective: Our objective was to examine the associations between dietary intakes of whole grains and the metabolic syndrome.

Design: The study subjects were 1516 healthy men and women participating in the Baltimore Longitudinal Study of Aging. Dietary information was collected with 7-day food records, and estimates of whole grain intake were obtained from a newly developed database.

Results: A total of 17% (n = 251) of subjects met …

Competencies And Physical Agent Modalities: An Investigation Of Clinical And Ethical Implications, Casey A. Lambert Jan 2007

Competencies And Physical Agent Modalities: An Investigation Of Clinical And Ethical Implications, Casey A. Lambert

Master's Theses and Doctoral Dissertations

Occupational therapy has evolved from its early inception in diversional therapy to incorporate technologically advanced modalities into the professional domain. Over the last thirty years the profession has increasingly incorporated physical agent modalities (PAMs) into the treatment process. Throughout this process there has been both opposition and support for the inclusion of PAMs in occupational therapy. There are concerns from both sides regarding the proper training of therapists in the use of PAMs, how competency should be assessed, who is responsible for ensuring competency, and the ethical concerns with the use of these modalities.

This phenomenological study analyzed six therapists’ …

Serum Gamma-Glutamyltransferase And The Risk Of Type 2 Diabetes In A Population-Based Cohort Study Of Older Mexican Americans, Lynn Blythe Jan 2007

Serum Gamma-Glutamyltransferase And The Risk Of Type 2 Diabetes In A Population-Based Cohort Study Of Older Mexican Americans, Lynn Blythe

Master's Theses and Doctoral Dissertations

Our objective was to test the hypothesis that increased GGT predicts an increased risk of type 2 diabetes (T2D) in elderly Mexican Americans.

Data from a population-based cohort study of 1789 community-dwelling Mexican American men and women, aged 60-101, in the SALSA study were used. Data for 1,203 participants without diabetes at baseline were evaluated for incident diabetes. Proportional hazard models were used to predict the probability of incident T2D by GGT level.

After adjustment for age, gender, smoking, alcohol use, and BMI, the risk of developing T2D associated with GGT was significant at 1.4 (95% CI 1.2 -1.7). However, …

Should Scientific Research In The Lead-Up To Invention Vitiate Obviousness Under The Patented Medicines (Notice Of Compliance) Regulations: To Test Or Not To Test?, Ron A. Bouchard Jan 2007

Should Scientific Research In The Lead-Up To Invention Vitiate Obviousness Under The Patented Medicines (Notice Of Compliance) Regulations: To Test Or Not To Test?, Ron A. Bouchard

Canadian Journal of Law and Technology

This article is an analysis of case law pertaining to whether scientific research in the lead-up to invention should vitiate a finding of obviousness in pharmaceutical litigation under the Patented Medicines (Notice of Compliance) Regulations (the ‘‘NOC Regulations’’). The NOC Regulations belong to a class of legal instruments referred to as ‘‘linkage regulations’’ that tie patent protection for marketed pharmaceuticals to the Canadian drug approval process. Therefore, the NOC Regulations control entry of generic drugs into the market and access by the public to affordable medication. The issue of testing arises out of the complex and inverse relationship between inventiveness …

Privacy, Crime And Terror: Legal Rights And Security In A Time Of Peril By Stanley A. Cohen (Markham: Lexisnexis Butterworths, 2005), Teresa Scassa Jan 2007

Privacy, Crime And Terror: Legal Rights And Security In A Time Of Peril By Stanley A. Cohen (Markham: Lexisnexis Butterworths, 2005), Teresa Scassa

Canadian Journal of Law and Technology

It is now trite to say that the events of September 11, 2001 have had a profound impact on our national security, in terms of its institutional and normative dimensions, and also in terms of a more general public anxiety. The hastily enacted Anti-terrorism Act of 2001 brought about significant changes to a wide range of statutes including, among others, the Criminal Code, the Official Secrets Act, the Canada Evidence Act, and the Proceeds of Crime (Money Laundering) Act. An early conference and resultant book on the Anti-terrorism Act raised serious concerns about the potential impact of the changes on …

Peer To Peer Meets The World Of Legal Information: Encountering A New Paradigm, Ethan Katsh, Beth Simone Noveck Jan 2007

Peer To Peer Meets The World Of Legal Information: Encountering A New Paradigm, Ethan Katsh, Beth Simone Noveck

Articles & Chapters

The authors describe a proposed system for patent application reviews that uses new technologies to access information-community peer reviews. By allowing examiners to "mine for data" in the heads of experts rather than in libraries or databases, the proposal illustrates how new technology could change the boundaries of legally authoritative and relevant information and make it possible to identify legitimate authority from new sources.

Law In The Plays Of Elmer Rice, Randolph N. Jonakait Jan 2007

Law In The Plays Of Elmer Rice, Randolph N. Jonakait

Articles & Chapters

While novels, short stories, television shows, movies, and classic dramas are often analyzed for insights into the law, modern plays are seldom similarly examined. The plays of Elmer Rice, however, should be discussed by those interested in our legal system. Rice, although now largely forgotten, was a leading playwright of the last century. He was a law school graduate, and his work often incorporated legal themes. His plays provide provocative commentaries about the law and raise dilemmas about justice and ethics that resonate today. This essay explores the interplay between plays and the law by examining the life and work …

Only A Sith Thinks Like That: Llewellyn's Dueling Canons, Eight To Twelve, Michael B.W. Sinclair

Articles & Chapters

In this, the second installment in a series of articles planned to examine each of the twenty eight pairs of "dueling canons" having opposite effect left to us in 1950 by Karl N. Llewellyn (Karl N. Llewellyn, "Remarks on the Theory of Appellate Decision and the Rules or Canons About How Statutes Are to Be Construed", 3 VANDERBILT L.REV. 395 (1950)), I examine pairs 8 through 12. I start with Pair 12, Llewellyn's formulation of the Plain Meaning Rule; it is not so much a canon of construction as a condition on construction: unless one or both of its conditions …

International Human Rights And Comparative Mental Disability Law: The Universal Factors, Michael L. Perlin Jan 2007

International Human Rights And Comparative Mental Disability Law: The Universal Factors, Michael L. Perlin

Articles & Chapters

An examination of comparative mental disability law reveals that there are at least five dominant, universal, core factors that must be considered carefully in any evaluation of the key question of whether international human rights standards have been violated. Each of these five factors is a reflection of the shame that the worldwide state of mental disability law brings to all of us who work in this field. Each is tainted by the pervasive corruption of sanism that permeates all of mental disability law. Each reflects a blinding pretextuality that contaminates legal practice in this area.

These are the factors …

The Effects Of Harvesting And Hauling On The Blood Physiology And Fillet Quality Of Market-Size Channel Catfish, C. Douglas Minchew, Rachael V. Beecham, Philip R. Pearson, Bartholomew W. Green, Jin M. Kim, Susan B. Bailey Jan 2007

The Effects Of Harvesting And Hauling On The Blood Physiology And Fillet Quality Of Market-Size Channel Catfish, C. Douglas Minchew, Rachael V. Beecham, Philip R. Pearson, Bartholomew W. Green, Jin M. Kim, Susan B. Bailey

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Commercially produced, food-size channel catfish Ictalurus punctatus that were harvested using routine procedures had significant elevations in plasma cortisol, glucose, and lactate compared with preharvest fish captured from open ponds. Blood samples were taken from 10 fish in each of two treatments (liquid oxygen diffuser- and paddlewheel-aerated holding socks) and four sampling periods (before harvest, after socking, before loading, and before unloading) during each of 10 harvest events. Water column temperatures averaged approximately 278 C during the study. Ten fillet samples were taken from fish held overnight in paddlewheel- and liquid oxygen-aerated holding socks during some harvest events. Mean plasma …

Transnational And Intimate Crossings: The 'Threatening Body' Of The 'Migrant Sex-Worker', Melissa Autumn White Jan 2007

Transnational And Intimate Crossings: The 'Threatening Body' Of The 'Migrant Sex-Worker', Melissa Autumn White

Reconstruction: Studies in Contemporary Culture

This paper introduces the rubric of the "migrant sex-working body" in order to theorize the affective and geopolitical valences of power 'threatened' by such bodies. The everyday and affective labours of migrant sex-workers whose bodies have been positioned as a 'threat' to the imagined community of the nation and to Hetero Factory's (Rossi 2003) family are fetishized in a Marxian sense in order to make an exploration of the collusion of transnational "structures of feeling" and border security regimes possible. In other words, the focus of the paper is not on or about the "migrant sex-working body", but rather on …

The U.N. Disability Convention: Historic Process, Strong Prospects And Why The U.S. Should Ratify, Tara J. Melish Jan 2007

The U.N. Disability Convention: Historic Process, Strong Prospects And Why The U.S. Should Ratify, Tara J. Melish

Journal Articles

On December 13, 2006, the United Nations General Assembly unanimously adopted the Convention on the Rights of Persons with Disabilities. The Convention is historic and path-breaking on several levels, both in protection terms for the world's 650 million persons with disabilities who may now draw upon its provisions in defense of their internationally-protected rights, and in relation to the unprecedented level of civil society input and engagement in the negotiation process. This sustained and constructive engagement has given rise to a dynamic process of dialogue, cooperation, and mutual trust that will fuel monitoring and implementation work, at national and international …

Non-Pecuniary Interests And The Injudicious Limits Of Appellate Standing In Bankruptcy, S. Todd Brown Jan 2007

Non-Pecuniary Interests And The Injudicious Limits Of Appellate Standing In Bankruptcy, S. Todd Brown

Journal Articles

Standing to appeal bankruptcy court orders today is limited to those with a pecuniary interest. This prudential limitation is based on the person aggrieved requirement of Section 39(c) of the Bankruptcy Act of 1898 - a requirement that was not included in the Bankruptcy Code. This article examines the extensive differences between the Act and the Code, the potential justifications for extending the pecuniary interest test in spite of the omission of the person aggrieved requirement, and the potential ramifications for parties and the integrity of the bankruptcy process. This analysis suggests that standing to appeal bankruptcy orders should be …

In-Situ And Simultaneous Measurements Of Size And Charge Distributions Of Dust On Mars: Instrumentation And Analysis, Praveen Kumar Srirama Jan 2007

In-Situ And Simultaneous Measurements Of Size And Charge Distributions Of Dust On Mars: Instrumentation And Analysis, Praveen Kumar Srirama

Theses and Dissertations

Martian dust characterization is important for minimizing the effects of abrasion, adhesion, corrosion, and damage to mission hardware, and also to reduce the effect on human health during future robotic and human exploratory missions. Characterizing the particle size and charge on Mars dust will help in the development of techniques for dust mitigation. Presently there is no miniature instrument which is capable of in-situ and real time measurements on Mars. In order to simultaneously analyze the particle size and charge of Mars dust, a Dust Particle Analyzer (DPA) has been developed and tested which is based on a Laser Doppler …
