To Condone Or Condemn? Regional Enforcement Actions In The Absence Of Security Council Authorization, Monica Hakimi Jan 2007

To Condone Or Condemn? Regional Enforcement Actions In The Absence Of Security Council Authorization, Monica Hakimi

Faculty Scholarship

The U.N. Charter establishes that regional arrangements may not take enforcement actions without authorization from the Security Council. Yet the international community does not always enforce this Charter rule. Major international actors repeatedly tolerate deviations from it even as they assert that it allows no exceptions. This Article examines that practice, arguing that two different legal systems govern enforcement actions taken by regional arrangements. One system is reflected in the Charter text and publicly endorsed by major international actors. The second, more nebulous system is based on expectations and demands in the absence of Security Council authorization. Under this second …

Marbury In Mexico: Judicial Review’S Precocious Southern Migration, M C. Mirow Jan 2007

Marbury In Mexico: Judicial Review’S Precocious Southern Migration, M C. Mirow

Faculty Publications

In attempting to construct United States-style judicial review for the Mexican Supreme Court in the 1880s, Ignacio Vallarta, president of the court, read Marbury in a way that preceded this use of the case in the United States. Using this surprising fact as a central example, this article makes several important contributions to the field of comparative constitutional law. The work demonstrates that through constitutional migration, novel readings of constitutional sources can arise in foreign fora. In an era when the United States Supreme Court may be accused of parochialism in its constitutional analysis, the article addresses the current controversy …

Evaluating Transformative Spirituality In An Organizational Leadership Program At A Christian University, Elizabeth D. Rios Jan 2007

Evaluating Transformative Spirituality In An Organizational Leadership Program At A Christian University, Elizabeth D. Rios

Theses and Dissertations

In the field of Christian higher education, some educators are more concerned with marketing their programs to nontraditional students, the fastest growing segment of new enrollments. Although many view that as a blessing, the issues of mission and specifically spirituality are of concern to educators and administrators who want to avoid the secularization already impacting many fine schools in the country. At satellite locations, some educators perceive that the lack of structured practices and intentional procedures and the marketing of convenience-based structural models have watered down the offerings of Christian higher education. This applied dissertation evaluated whether spiritual development and …

Advisory Programs : Organization And Implementation, Angela Ruth Black Jan 2007

Advisory Programs : Organization And Implementation, Angela Ruth Black

Graduate Research Papers

This literature review examined how to implement an advisory program into middle schools. This review looked at the pros and cons of advisory programs, and what needed to be considered before implementing an advisory program.

The topic of advisory programs was chosen after having discussions during my graduate program, as well as with work colleagues. During class discussions, advisory programs sounded like a wonderful concept. But when I went to work, my coworkers made advisory programs sound like a waste of time. I decided I needed to learn more about advisory programs, so I could make my own decision about …

Speleothems As Indicators Of Wet And Dry Periods, Ian John Fairchild, Emily Anne Mcmillan Jan 2007

Speleothems As Indicators Of Wet And Dry Periods, Ian John Fairchild, Emily Anne Mcmillan

International Journal of Speleology

Calcareous speleothems provide a record of dripwater composition which in turn is a function of climatic conditions. The historical focus of speleothem palaeoclimate studies has been on the derivation of palaeotemperatures through oxygen isotope studies. However, it is now realized that water availability is a more generally important control on their characteristics. Growth rate and growth morphology in principle should give rise to recognizable changes at low flow. However, accidental plumbing effects during aquifer evolution, can also lead to variations in water supply and it is not easy to distinguish these effects. In areas where there is a strong amount …

32 | Tel Mor: The Moshe Dothan Excavations, 1959–1960, Tristan J. Barako

IAA Reports—Monograph Series of the Israel Antiquities Authority

This is the final report of the excavations carried out by Moshe Dothan in 1959 at Tel Mor, a small tell in the coastal plain. Finds from the Middle Bronze Age to the Hellenistic period were uncovered, and some Roman-period and later finds as well. The principal remains date to the Late Bronze Age and early Iron Age, represented by a series of large buildings on the summit of the tell. Two of these buildings appear to be forts, and as they were accompanied by significant quantities of Egyptianized pottery, they may have functioned as Egyptian garrisons in Canaan. The …

Laman And Lemuel: A Case Study In "Not Becoming", Michael A. Goodman Jan 2007

Laman And Lemuel: A Case Study In "Not Becoming", Michael A. Goodman

Faculty Publications

We can easily see Laman and Lemuel as being lost from the start. Almost like stock characters in a novel, they may appear to have little depth or complexity. This simplistic view makes it hard to identify the reasons behind, as well as the consequences of, Laman and Lemuel’s behavior. Consequently, if we do not look for deeper meaning in Laman and Lemuel’s story, we may fail to identify the necessary precepts to avoid the pitfalls they fell into and to which we are vulnerable today.

Through a more contextual view of Laman and Lemuel’s lives, we are provided with …

Cultural Competence And Instructional Design: Exploration Research Into The Delivery Of Online Instruction Cross, P. Clint Rogers, Charles R. Graham, Clifford T. Mayes

Faculty Publications

The amount of resources being poured by Western universities, companies, and governments into creating educational content to be exported (via the Internet) to other cultures is astounding. Those assigned to accomplish this task are left with the great challenge of meeting the needs of learners who come from cultures that are foreign to them, and who often have very different abilities and expectations than originally assumed. This study explores the cultural competence in the lived experience of 12 professionals who have been involved with such efforts. Often they have had to question their assumptions, recognizing flaws in their own thinking …

As a follow-up of previous work on the flame pyrolysis of biphenyl and pyrene, a more detailed analysis of the pyrolytic products has been done using additional NMR data obtained on the whole soot sample correlated with detailed high-resolution and GC mass spectrometry data on the solvent-extracted portion of the same samples. These latter data complement the earlier NMR data with details of the pre-sooting structures, referred to as “young soot”, in pyrolyzed biphenyl samples collected at 1365, 1410, and 1470 K and pyrene at 1410 and 1470 K. The data reveal the roles played by free-radical-assisted polymerization reactions as …

Psychometrically Equivalent Russian Speech Audiometry Materials By Male And Female Talkers, Shawn L. Nissen, Richard W. Harris, Melissa G. Pola, David L. Mcpherson, George A. Tavarkiladze, Dennis L. Eggett

Faculty Publications

Despite the large number of individuals who speak Russian, only a limited number of high-quality speech audiometry materials are available in a standard dialect of Russian. Thus, the purpose of this study was to develop and evaluate speech audiometry materials that can be used to measure word recognition and SRT testing in quiet for native speakers of Russian. Familiar mono-syllabic and bisyllabic words were digitally recorded by male and female talkers of Russian and subsequently evaluated by native listeners. Using logistic regression, psychometric functions were then calculated for all words. Selected monosyllabic words were digitally adjusted to create word recognition …

Development Of Speech Reception Threshold Materials For Speakers Of Taiwan Mandarin, Shawn L. Nissen, Richard W. Harris, Katie B. Slade

Faculty Publications

The aim of this research was to develop, digitally record, evaluate, and equate speech audiometry materials that can be used to measure the speech reception threshold(SRT) in quiet for native speakers of Taiwan Mandarin. Familiar trisyllabic words were digitally recorded by male and female talkers of Taiwan Mandarin and subsequently evaluated by 20 native listeners with normal hearing at 14intensity levels (10 to 16 dB HL) in 2 dB increments. Using logistic regression, psychometric functions were calculated for all words. Twenty-eight words with comparatively steep psychometric functions were selected and digitally adjusted to match the mean subject pure-tone average (5.0 …

Soyinka, Tutu, And The Globalization Of African Humanism, Aaron Eastley Jan 2007

Soyinka, Tutu, And The Globalization Of African Humanism, Aaron Eastley

Faculty Publications

In an article dated 13 March 2006, the British weekly New Statesman reported on the latest social intervention of the “most popular priest on the planet” (Campbell), former Anglican Archbishop Desmond Tutu of South Africa. Nobel Peace Prize recipient Tutu, famous for his chairmanship of the South African Truth and Reconciliation Commission, was negotiating a series of televised meetings between former Protestant paramilitaries from Northern Ireland and the surviving family members of people they had murdered. A reality TV spin-off with a suspiciously voyeuristic strain, the three-part BBC2miniseries “Facing the Truth”—an obvious reference to the South African TRC—was deemed “daring” …

Faculty, Staff and Student Publications

OBJECTIVE: Human defensins and cathelicidins are a family of cationic antimicrobial peptides (AMPs), which play multiple roles in both innate and adaptive immune systems. They have direct antimicrobial activity against several microorganisms including burn pathogens. The majority of components of innate and adaptive immunity either express naturally occurring defensins or are otherwise chemoattracted or functionally affected by them. They also enhance adaptive immunity and wound healing and alter antibody production. All mechanisms to explain multiple functions of AMPs are not clearly understood. Prior studies to localize defensins in normal and burned skin using deconvolution fluorescence scanning microscopy indicate localization of …

Does Time Really Slow Down During A Frightening Event?, Chess Stetson, Matthew P Fiesta, David M Eagleman Jan 2007

Does Time Really Slow Down During A Frightening Event?, Chess Stetson, Matthew P Fiesta, David M Eagleman

Faculty, Staff and Student Publications

Observers commonly report that time seems to have moved in slow motion during a life-threatening event. It is unknown whether this is a function of increased time resolution during the event, or instead an illusion of remembering an emotionally salient event. Using a hand-held device to measure speed of visual perception, participants experienced free fall for 31 m before landing safely in a net. We found no evidence of increased temporal resolution, in apparent conflict with the fact that participants retrospectively estimated their own fall to last 36% longer than others' falls. The duration dilation during a frightening event, and …

Jesus, The Great Shepherd-King, Dana M. Pike Jan 2007

Jesus, The Great Shepherd-King, Dana M. Pike

Faculty Publications

“The Lord is my shepherd; I shall not want. He maketh me to lie down in green pastures: he leadeth me beside the still waters” (Psalm 23:1–2). So begins one of the most beloved psalms and best-known biblical passages mentioning a shepherd. Shepherd imagery is utilized in scripture to depict three important aspects of Jesus’s identity and mission: His roles as Savior, King, and Jehovah, the God of Israel. Of these three, His role as compassionate Savior, devoted to protecting and saving the flock of God, is the aspect of shepherd symbolism that typically comes to mind. Less well known, …

Industrial Policy As Strategic Trade Policy In A Global Economy, David Decarlo Jan 2007

Industrial Policy As Strategic Trade Policy In A Global Economy, David Decarlo

Undergraduate Economic Review

With the introduction of “strategic trade policy” in the 1980’s came two separate theoretical justifications for increased government intervention to promote national industries: first, argued by Brander and Spencer (1985), the government could alter the strategic interaction in oligopolistic competition to shift profits to a domestic firm; second, the government could promote key industries in order to capture the benefits of positive externalities, such as knowledge spillovers. But the creation of the WTO and the regulation of export subsidies soon limited the strategic trade policy options available to governments. This paper examines the case for providing R&D and capital subsidies …

College Students’ Personal Financial Literacy: Economic Impact And Public Policy Implications, Florentina Furtuna Jan 2007

College Students’ Personal Financial Literacy: Economic Impact And Public Policy Implications, Florentina Furtuna

Undergraduate Economic Review

This study analyzes the level of financial literacy among college students in Lynchburg VA area as well as the factors that impact the students’ competency in the field. Furthermore, it examines how the level of financial knowledge influences students’ opinions and decisions on personal finance matters. Past research indicates that non-business majors, women, students under age 30, with lower class ranks, and with little work experience have lower levels of financial knowledge. A major focus of this study is to test these hypotheses by administering a survey to college students in Lynchburg VA area and make inferences based on the …

A Note On Clean Abelian Groups, Brendan Goldsmith, P. Vamos Jan 2007

A Note On Clean Abelian Groups, Brendan Goldsmith, P. Vamos

Articles

Nicholson defined a ring to be clean if every element is the sum of a unit and an idempotent. A module is clean if its endomorphism algebra is clean. We show that torsion-complete Abelian p-groups are clean and characterize the clean groups among the class of totally projective p-groups. An example is given of a clean p-group which is neither totally projective nor torsion- complete
