The Superior Position Of The Creditor In The Community Property Regime: Has The Community Become A Mere Creditor Collection Device?, Andrea B. Carroll Jan 2007

The Superior Position Of The Creditor In The Community Property Regime: Has The Community Become A Mere Creditor Collection Device?, Andrea B. Carroll

Journal Articles

This article is a first step in an effort to critically examine the continued vitality of the community regime for regulating spousal property. Specifically, the article examines the American community property regimes in light of how they measure up against non-community property states in terms of creditor protection. The results are often surprising. The community regime grants creditors access to a variety of property for all manner of debts. For instance, the entirety of the community property, including the non-debtor spouse's wages, may be seized in some community property states for the other's premarital debts. That the non-debtor spouse has …

Coercion, Causation, And The Fictional Elements Of Indirect State Responsibility, James D. Fry Jan 2007

Coercion, Causation, And The Fictional Elements Of Indirect State Responsibility, James D. Fry

Vanderbilt Journal of Transnational Law

This Article provides an in-depth analysis of Article 18 of the 2001 ILC Draft Articles on State Responsibility, which holds a coercing state indirectly responsible for an injurious act committed by a coerced state. Not only does this provision lack support from state practice, but the structural and logical flaws within the current formulation ensure that this provision does not significantly influence the evolution of state practice. Indeed, it would have been better for the ILC to have left Article 18 out of the Draft Articles, given that other, less problematic provisions could have covered such situations involving coercion. In …

Paths To Local Food Security: A Right To Food, A Commitment To Trade, Marsha A. Echols Jan 2007

Paths To Local Food Security: A Right To Food, A Commitment To Trade, Marsha A. Echols

Vanderbilt Journal of Transnational Law

International bodies and nation-states attending international meetings on the subject have agreed that there is a "right to food." The first Millennium Development Goal, in which members of the United Nations General Assembly agreed to halve the number of persons without adequate food by the year 2015, complements this right to food. Many persons believe that the right to food--especially at the national level--is linked to national food self-sufficiency. Opponents of this view argue that self-sufficiency is economically irrational in many territories. Others believe that for many countries, particularly nations in sub-Saharan Africa, a government's obligation to ensure food security …

The Legality Of The West Bank Wall: Israel's High Court Of Justice V. The International Court Of Justice, Victor Kattan Jan 2007

The Legality Of The West Bank Wall: Israel's High Court Of Justice V. The International Court Of Justice, Victor Kattan

Vanderbilt Journal of Transnational Law

This Article offers a critique of the decision reached by Israel's High Court of Justice in the Mara'abe Case (2005) as well as some aspects of the International Court of Justice's Advisory Opinion on the Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory (2004). The Article takes a socio-legal and facts-based approach to analyzing the decisions' discussions of settlements, self-determination, and self-defense, examining all three topics in light of several recent legal and political developments.

A Nation At War, John R. Martin Professor Jan 2007

A Nation At War, John R. Martin Professor

Books, Monographs & Collaborative Studies

One of the basics of strategy is understanding the foe and the type of war in which a nation is involved. Perhaps even more basic than that is the seemingly simple requirement to understand that the nation is at war. The Global War on Terrorism (GWOT) does not fit easily into the mold of war, but that is because of too much comparison with conventional wars; the Cold War may provide a better model. The United States--especially the government, but also the people--need to focus more fully on prosecuting the GWOT, but there is no requirement for the full mobilization …

The Origins Of Article Iii "Arising Under" Jurisdiction, Anthony J. Bellia Jr. Jan 2007

The Origins Of Article Iii "Arising Under" Jurisdiction, Anthony J. Bellia Jr.

Journal Articles

Article III of the Constitution provides that the judicial Power of the United States extends to all cases arising under the Constitution, laws, and treaties of the United States. What the phrase arising under imports in Article III has long confounded courts and scholars. This Article examines the historical origins of Article III arising under jurisdiction. First, it describes English legal principles that governed the jurisdiction of courts of general and limited jurisdiction--principles that animated early American jurisprudence regarding the scope of arising under jurisdiction. Second, it explains how participants in the framing and ratification of the Constitution understood arising …

Women's Studies Reading List, Adonna Fleming Jan 2007

Women's Studies Reading List, Adonna Fleming

University of Nebraska-Lincoln Libraries: Faculty Publications

The titles in this annotated reading list are based on a curriculum study that anaIyzed the reading lists from the syllabi of the women's studies courses taught at ten colleges and universities in Colorado, during the 1999-2000 academic years. Inclusion in the list was based on the frequency that the title appeared across the curriculum. In order to qualify for entry in this list each title had to appear on more than one course syllabi. 86 selections are arranged alphabetically by author, and also include the title, publisher, date and place of publication, number of pages, plus a brief description …

Us And Them: Identity And Genocide, David Moshman Jan 2007

Us And Them: Identity And Genocide, David Moshman

Department of Educational Psychology: Faculty Publications

Genocide is commonly deemed to be either inexplicable or the result of special hatreds. I argue instead that genocide is an extreme result of normal identity processes. Four overlapping phases are proposed. (1) Dichotomization elevates one dimension of identity over others and, within that dimension, sharply distinguishes two categories: us and them. This may lead to (2) dehumanization, in which “they” come to be seen not just as different from “us” but as outside the human universe of moral obligation. (3) Destruction may result, accompanied and followed by processes of (4) denial that enable the perpetrators to maintain their moral …

Review Of Waterfowl Ecology And Management By Guy A. Baldassarre And Eric G. Bolen, Gary Krapu Jan 2007

Review Of Waterfowl Ecology And Management By Guy A. Baldassarre And Eric G. Bolen, Gary Krapu

United States Geological Survey, Northern Prairie Wildlife Research Center: Publications

Waterfowl are among the most studied groups of birds, in part because many species are widely hunted. In recent decades, waterfowl researchers have provided a wealth of new findings related to population ecology and management. Baldassarre and Bolen, recognizing the rapid growth of valuable new information since their book was first published in 1994 and the emergence of numerous new issues confronting waterfowl conservation, have prepared a new edition of their book.
The 2006 edition of Waterfowl Ecology and Management represents a major revision of the authors’ original work. The handsome new front cover contains an inset of a Mallard …

Chromatic Aberration Of Eyepieces In Early Telescopes, M. Eugene Rudd Jan 2007

Chromatic Aberration Of Eyepieces In Early Telescopes, M. Eugene Rudd

M. Eugene Rudd Publications

The twofold objective of this study is (1) to identify and give a brief review of the historical development of the various designs of early (pre-1850) telescope eyepieces, and (2) to determine by measurements and calculations the axial and lateral chromatic aberrations of a number of extant eyepieces from that period in order to provide basic data on which to judge the relative quality of different eyepiece forms. Eight distinct types of eyepieces containing one to five lens elements are discussed and illustrated. The second objective was addressed by measuring the focal lengths of the individual lens elements and the …

Wandering Spleen With Torsion Of The Pedicle, Michael C. Safioleas, Michael C. Stamatakos, Ahmad I. Diab, Panayotis M. Safioleas Jan 2007

Wandering Spleen With Torsion Of The Pedicle, Michael C. Safioleas, Michael C. Stamatakos, Ahmad I. Diab, Panayotis M. Safioleas

Saudi Medical Journal

Wandering spleen is a rare medical entity. It usually occurs at 20-40 years of age, and most cases are seen in women. Clinical diagnosis is difficult due to lack of symptoms, unless splenic torsion has occurred and clinical symptomatology of acute abdomen develops. The diagnosis can be confirmed by imaging techniques. Treatment is operative due to complications of splenic infarction. Splenopexy is the usual treatment, except for cases of splenic infarction. Splenectomy should be carried out when there is no evidence of splenic blood flow after detorsion of the spleen and in cases of excessive splenomegaly.

Internet Entrepreneurship And Economic Growth, Gerald V. Post, John F. Pfaff Jan 2007

Internet Entrepreneurship And Economic Growth, Gerald V. Post, John F. Pfaff

Journal of International Technology and Information Management

This paper looks at national attempts to promote economic growth through the Internet. Growth can be driven through service exports or internally through increased service transactions and fostering entrepreneurship. India is often held as an example of service exports, but economic statistics show that India might not be a good example for other nations because net service trade is negative and wages have been economically distorted. Ultimately, developing nations need to find internal growth models. Internal growth could be driven though increased consumption due to improved information, or increased investment expenditures from infrastructure investments.

Comparing The Prioritization Of Erp System Effectiveness Measures By Organizational Actors: A Focus On It Professionals And Business Managers, Princely Ifinedo Jan 2007

Comparing The Prioritization Of Erp System Effectiveness Measures By Organizational Actors: A Focus On It Professionals And Business Managers, Princely Ifinedo

Journal of International Technology and Information Management

Modern organizations adopt Enterprise Resource Planning systems (ERP) to integrate their organizational data resources into unified systems. Researchers tend to concentrate on ERP implementation issues with only a handful studying ERP system effectiveness or success in adopting organizations. In fact, none has studied how key organizational actors prioritize or rank relevant measures or items related to the effectiveness of such systems. This study is designed to fill this gap in research as it aims at investigating how two organizational stakeholder groups, i.e. information technology (IT) professionals and business managers prioritize relevant measures related to ERP systems effectiveness. Using surveys in …

Hosting Galileo Ground Stations, Frans G. Von Der Dunk Jan 2007

Hosting Galileo Ground Stations, Frans G. Von Der Dunk

Space, Cyber, and Telecommunications Law Program: Faculty Publications

At this moment, the European GNSS Supervisory Authority, the public agency-half of the Public-Private Partnership principally in charge of the Galileo system, is built up, and the first full-fledged operations on a global scale are currently envisaged by 2010 or shortly thereafter. Thus, one set of legal questions which now becomes of interest concerns those surrounding the possibility for third countries to host Galileo ground stations.

The present paper seeks to analyse these issues from the perspective of space law, in particular as regards issues of international responsibility and liability under the Outer Space Treaty and the Liability Convention, and …

Fostering The Development Of Vocabulary Knowledge And Reading Comprehension Though Contextually-Based Multiple Meaning Vocabulary Instruction, J. Ron Nelson, Scott A. Stage Jan 2007

Fostering The Development Of Vocabulary Knowledge And Reading Comprehension Though Contextually-Based Multiple Meaning Vocabulary Instruction, J. Ron Nelson, Scott A. Stage

Department of Special Education and Communication Disorders: Faculty Publications

The primary purpose of this study was to assess the effects of contextually-based multiple meaning (i.e., words with multiple meanings) vocabulary instruction on the vocabulary knowledge and reading comprehension of students. Third and 5th grade students received either contextually-based multiple meaning vocabulary instruction embedded in the standard language arts instruction offered to all students over a three-month period or the standard language arts instruction alone (i.e., non-specific treatment). Students who received the contextually-based multiple meaning instruction generally showed statistically and educationally significant gains in their vocabulary knowledge and reading comprehension relative to students who did not. These gains were most …

Regional Advocacy Networks And The Protocol On The Rights Of Women In Africa, Melinda Adams, Alice J. Kang Jan 2007

Regional Advocacy Networks And The Protocol On The Rights Of Women In Africa, Melinda Adams, Alice J. Kang

Department of Political Science: Faculty Publications

While there has been a significant amount of research on transnational feminist activism at the global level, many feminist transnational advocacy networks are mobilizing within world regions. The lack of attention to the regional level has created a considerable imbalance in research on transnational activism. This article's first objective is to define regional advocacy networks (RANs) as a collection of individuals and organizations from the same world region working together toward a common goal. The article's second objective is to explore the conditions under which RANs are influential. We investigate conditions for RAN success through a case study of an …

Use Of Alpha-Chloralose By Usda Wildlife Services To Immobilize Birds, Jeanette R. O'Hare, John D. Eisemann, Kathleen A. Fagerstone, Lawanna L. Koch, Thomas W. Seamans Jan 2007

Use Of Alpha-Chloralose By Usda Wildlife Services To Immobilize Birds, Jeanette R. O'Hare, John D. Eisemann, Kathleen A. Fagerstone, Lawanna L. Koch, Thomas W. Seamans

United States Department of Agriculture Wildlife Services: Staff Publications

In 1992, the U. S. Food and Drug Administration (FDA) opened an Investigational New Animal Drug (INAD) file for the avian immobilizing agent, alpha-chloralose (AC) for the United States Department of Agriculture, Animal and Plant Health Inspection Service (APHIS). Currently, this INAD authorizes trained Wildlife Services (WS) personnel to use AC to immobilize and live-capture nuisance waterfowl (Anatidae spp.), American coots (Fulica americana), pigeons (Columba livia), common ravens (Corvus corax) and sandhill cranes (Grus canadensis). The use of AC has proven to be a valuable tool for WS and the number …

Development And Pilot Testing Of An Omega-3 Fatty Acid Food Frequency Questionnaire, Paula K. Ritter-Gooder, Nancy M. Lewis, Kimberly Barber-Heidal, Megan Waltz-Hill Jan 2007

Development And Pilot Testing Of An Omega-3 Fatty Acid Food Frequency Questionnaire, Paula K. Ritter-Gooder, Nancy M. Lewis, Kimberly Barber-Heidal, Megan Waltz-Hill

Department of Nutrition and Health Sciences: Faculty Publications

Omega-3 fatty acids are essential to health and provide cardio-protective benefits. To estimate omega-3 fatty acid dietary intake, we developed a semi-quantitative food frequency questionnaire (FFQ) and pilot tested its reliability and validity in a convenience sample of cardiac patients in the Midwest. The FFQ was developed using the USDA Nutrient Database for Standard Reference and the ESHA Food Processor, ESHA Research, Salem, Oregon. Three 24-h recalls and two administrations of the FFQ two weeks apart were obtained by a dietitian by phone and home visit from 28 volunteers. Pearson correlation was used to assess the association between food recalls …

New Insights Into Marine Migration And Winter Habitat Of Gulf Sturgeon, Randy E. Edwards, Frank M. Parauka, Kenneth J. Sulak Jan 2007

New Insights Into Marine Migration And Winter Habitat Of Gulf Sturgeon, Randy E. Edwards, Frank M. Parauka, Kenneth J. Sulak

United States Geological Survey: Staff Publications

Migrations and movements of Gulf sturgeon Acipenser oxyrinchus desotoi were determined using satellite pop-up archival transmitting (PAT) tags and acoustic telemetry. Adult Gulf sturgeon from four rivers in northwestern Florida were caught with gill nets and were tagged with PAT and acoustic tags in the fall of 2001 and 2002. PAT tags were programmed to release in early February 2002 and 2003 to provide information about location of late-winter marine habitats. However, only 5 of 25 provided meaningful location information. Three of the PAT-tagged fish were relocated acoustically near the PAT tag pop-up locations, one of which was in Choctawhatchee …

Abnormal Trading Volume, Stock Returns And The Momentum Effects, Ying Zheng Jan 2007

Abnormal Trading Volume, Stock Returns And The Momentum Effects, Ying Zheng

Dissertations and Theses Collection (Open Access)

This paper intends to study the intermediate-term momentum and long-term reversal of stock prices by investigating the informational role of unusual trading volume for winner and loser stocks. I argue that unusual trading volume has different implications for winner and loser stocks. Specifically, high trading volume for losers is driven by purchases made by informed investors; while high trade volume for winners could be driven by either information or representativeness bias or both. The arguments are tested in the paper by showing that in the short run, losers/winners with high abnormal trading volume outperform losers/winners with low abnormal trading volume; …

Do Warrants Lead The Underlying Stocks And Index Futures?, Ying Kui Lin Jan 2007

Do Warrants Lead The Underlying Stocks And Index Futures?, Ying Kui Lin

Dissertations and Theses Collection (Open Access)

The lead-lag relation between options and stocks has been a subject of controversy for years with conflicting findings in the literature. In this thesis, we present an intuitive method to examine the lead-lag relation, if any, in the tick-by-tick data of covered warrants and their underlying stocks or underlying index futures. Our method is non-parametric and needs no assumptions which are critical to the regression-based methods. We find that the electronically traded warrants do not lead stocks or index futures; the movements in the warrants' quotes provide little information about the quotes of the underlying stocks or index futures. Instead, …

Interest Rate Uncertainty And Stock Market Volatility, Jincai Xu Jan 2007

Interest Rate Uncertainty And Stock Market Volatility, Jincai Xu

Dissertations and Theses Collection (Open Access)

The reason for volatility changing over time is still open. As stated in the extant papers uncertainty of Macroeconomic variable plays more important role in explaining the time varying of volatility than the volatility of Macroeconomic variable itself. In this paper we illustrate this with exploring the relationship between stock market volatility and the Interest Uncertainty. In the paper, we take the uncertainty of the decision of FOMC meeting as the uncertainty of interest rate. As we know, asset price is a tool for people to express their belief about the state of the economy, when uncertainty is high, a …

On The Calibration Of The Libor Market Model, U Lagunzad Demelinda Jan 2007

On The Calibration Of The Libor Market Model, U Lagunzad Demelinda

Dissertations and Theses Collection (Open Access)

This thesis presents a study of LIBOR market model calibration. In particular, the study builds on the prevailing calibration methodologies in an attempt to find a method that simultaneously recovers implied volatility and forward rate correlations structures from market prices of plain vanilla options. In order to ensure that complex derivative pricing and hedging requirements are jointly addressed, the study extends the performance analysis of calibration methods from a static level of goodness-of-fit with market prices test, to a dynamic level of approximation to next period's LIBOR (London Interbank Offer Rate) dynamics when tested on a series of market prices. …
