Ennobling Direct Democracy, Sherman J. Clark Jan 2007

Ennobling Direct Democracy, Sherman J. Clark

Articles

In this essay, Professor Clark argues that we should be attentive to the effect that direct democracy might have on our public character. Building upon earlier work, Clark suggests that the initiative in particular threatens to debase us by undercutting a crucial character trait which might best be called "responsibility-taking." The bulk of this essay is devoted to explaining what this means, and why it matters. Why should we care about the effect of political processes on public character? Why is this particular trait important and worth preserving? How is it threatened by direct democracy? In conclusion, and by way …

On The Relation Between Form And Substance In Law, Philip E. Soper Jan 2007

On The Relation Between Form And Substance In Law, Philip E. Soper

Articles

In this paper the author deals with some theoretical aspects of Robert Summers’ last book (Summers 2006). In particular, he concentrates on the hazy relationship between form and substance in Summers’ theory. In order to analyze some major difficulties entailed in the thesis that form and substance are different and independent things, the author discusses three specific questions: (1) the difference between form and substance; (2) the possibility of a form meant to be value-neutral; (3) how to distinguish a form-centered approach from a formalistic approach when one has to interpret a statute. This last question is dealt with through …

Charter Dialogue Revisited: Or "Much Ado About Metaphors", Peter W. Hogg, Allison A. Bushell Thornton, Wade K. Wright Jan 2007

Charter Dialogue Revisited: Or "Much Ado About Metaphors", Peter W. Hogg, Allison A. Bushell Thornton, Wade K. Wright

Osgoode Hall Law Journal

This article is a sequel to the 1997 article "The Charter Dialogue Between Courts and Legislatures (Or Perhaps The Charter of Rights Isn't Such A Bad Thing After All)." In the present article, the authors review various academic critiques of their "dialogue" theory, which postulates that Charter decisions striking down laws are not the last word, but rather the beginning of a "dialogue," because legislative bodies are generally able to (and generally do) enact sequel legislation that accomplishes the main objective of the unconstitutional law. The authors also examine the Supreme Court of Canada's dicta on the "dialogue" phenomenon, and …

Concept Analysis In Web Documents, Rajesh Singh Jan 2007

Concept Analysis In Web Documents, Rajesh Singh

Master's Projects

A Keyword within a text/web document represents some human thought. The interaction of keywords leads to narrowing of scope of human thought by forming a more precise semantic entity called concepts. Analyzing a set of document not only requires analysis of the keywords within those documents but also their interactions within a document. In this new approach a set of documents can be analyzed where by the interactions of its keywords is also considered in finding the important concepts. These concepts can be used to cluster them into smaller subsets such that documents in each cluster will be semantically similar.

Legal Commitments And Religious Commitments, Jospeh Vining Jan 2007

Legal Commitments And Religious Commitments, Jospeh Vining

Articles

In his elegant and accessible new book, Law's Quandary, Steven Smith groups our various senses of what is real for us into ontological families: the mundane; the scientific, including mathematics; and the religious. These supply "lumberyards," as it were, for thought and discussion about the world and action in it. Law itself is not one of them. Those involved in law, as citizens or professionals practicing law or speaking for or about law, are presented in the book as looking out from law to the ontological resources available in the lumberyards he describes.

Readiness Of Hospital Discharge Scale - Md Adult Short Form - English, Marianne E. Weiss

RHDS

The Readiness for Hospital Discharge Scale, Quality of Discharge Teaching Scale, and Post-Discharge Coping Difficulty Scale were developed by Dr. Marianne Weiss to measure nurse-sensitive discharge care processes and patient outcomes. Three versions of the scales were developed concurrently for different patient populations – Adult medical-surgical patients, Parents of hospitalized children, and Postpartum Patient mothers (see Weiss & Piacentine, 2006, Weiss et al., 2007, and Bobay et al., 2018 for description of the development and initial testing). Additional scales and information about translation rights are located at Marquette Nursing.

The Word And The Law, James Boyd White Jan 2007

The Word And The Law, James Boyd White

Articles

In this Article I shall first give a brief account of Milner Ball's book, The Word and the Law, saying something about the interesting and important way in which it connects theology, literature, and law. I shall then give a little more content to what I say about this achievement by engaging in a kind of reading of two texts, one theological and one literary, connecting both to the law. I mean this reading simultaneously to be my own and to reflect something of what I have learned from Milner. Another way to put this is to say that …

Homer Clark: Colleague And Friend, James Boyd White Jan 2007

Homer Clark: Colleague And Friend, James Boyd White

Articles

Born in Chicago in 1918, Homer Clark was raised in the Long Island suburbs of New York City. After high school he attended Amherst College, where he was an athlete-playing football, squash, and I think baseball too--as well as of course a good student. There he met the major influence in his intellectual life, Theodore Baird, who was the dominant academic figure at Amherst in those days. Baird was an English teacher, whose extraordinary freshman composition course opened the minds of generations of students. Baird and Homer hit it off, especially after they got into an argument in class. Homer …

Partially Odious Debts?, Omri Ben-Shahar, Mitu Gulati Jan 2007

Partially Odious Debts?, Omri Ben-Shahar, Mitu Gulati

Articles

The despotic ruler of a poor nation borrows extensively from foreign creditors. He spends some of those funds on building statues of himself, others on buying arms for his brutal secret police, and he places the remainder in his personal bank accounts in Switzerland. The longer the despot stays in power, the poorer the nation becomes. Although the secret police are able to keep prodemocracy protests subdued by force for many years, eventually there is a popular revolt. The despot flees the scene with a few billion dollars of his illgotten gains. The populist regime that replaces the despot now …

Emotional And Domain Concept Enhancements To Alicebot, Alvin Cho Jan 2007

Emotional And Domain Concept Enhancements To Alicebot, Alvin Cho

Master's Projects

Extensive research and development have been done in the area of human simulation and artificial intelligence and their related fields, such as common sense knowledge bases, chatterbots, natural language parsing, semantic analysis, synthetic actors, and cognitive sciences. This paper takes part in that extensive research by focusing on the improvement of human simulation in chatterbots, specifically in Alicebot, a prominent non-emotional pattern-matching chatbot. An emotion and personality model is added to Alicebot so that it can make decisions based on its emotions and personality. Alicebot is also augmented with the ability to determine what it likes or does not like …

Operon Prediction With Bayesian Classifiers, Natalia Khuri Jan 2007

Operon Prediction With Bayesian Classifiers, Natalia Khuri

Master's Projects

In this work, we present an approach to predicting transcription units based on Bayesian classifiers. The predictor uses publicly available data to train the classifier, such as genome sequence data from Genbank, expression values from microarray experiments, and a collection of experimentally verified transcription units. We have studied the importance of each of the data source on the performance of the predictor by developing three classifier models and evaluating their outcomes. The predictor was trained and validated on the E. coli genome, but can be extended to other organisms. Using the full Bayesian classifier, we were able to correctly identify …

Case Studies In Proof Checking, Robert Kam Jan 2007

Case Studies In Proof Checking, Robert Kam

Master's Projects

The aim of computer proof checking is not to find proofs, but to verify them. This is different from automated deduction, which is the use of computers to find proofs that humans have not devised first. Currently, checking a proof by computer is done by taking a known mathematical proof and entering it into the special language recognized by a proof verifier program, and then running the verifier to hopefully obtain no errors. Of course, if the proof checker approves the proof, there are considerations of whether or not the proof checker is correct, and this has been complicated by …

A Qualitative Study Of Experiences Of Aboriginal Caregivers Of Children With Developmental Disabilities, Joyce Ellen Clouston Jan 2007

A Qualitative Study Of Experiences Of Aboriginal Caregivers Of Children With Developmental Disabilities, Joyce Ellen Clouston

Theses and Dissertations (Comprehensive)

A qualitative study of 20 caregivers of Aboriginal children with developmental disabilities revealed that caregivers continue to be guided by values rooted in traditional Aboriginal societies where all children were considered gifts of the Creator. The lives of vulnerable children had purpose, they were treated with respect, and the self-growth of the caregiver was connected to care of the child. The needs of young families were supported within a web of relationships in family and community. Disruptions to traditional family relationships began in the colonial era with the negation of Aboriginal culture and spirituality, and continue in many communities in …

Anticipating The New Creation: Wesleyan Foundations For Holistic Mission, Randy L. Maddox Jan 2007

Anticipating The New Creation: Wesleyan Foundations For Holistic Mission, Randy L. Maddox

The Asbury Journal

This essay provides a brief orientation to the public debate over the last forty years about the implications of the Christian worldview for environmental concern. It then explores the mature writings of John Wesley (and some of Charles Wesley's hymns), seeking to highlight those convictions that emphasize God's care for the whole creation and that call upon us to participate in this care. These Wesleyan convictions are developed in direct dialogue with the most common charges leveled against the Christian worldview as unsupportive or even detrimental to environmental concern. The article also highlights how Wesley sharpened his commitment to those …

The 20th Century Holiness Movement And Korean Holiness Groups, Myung Soo Park Jan 2007

The 20th Century Holiness Movement And Korean Holiness Groups, Myung Soo Park

The Asbury Journal

The Korean Christianity has been influenced by the American mission work whether its influence is good or bad. This study demonstrates how much the holiness movements in America have changed Korea Holiness churches. A schism among the American Holiness churches brought another one among Korean people; a revival in America brought another one in Korea. A theological change in American Holiness circle made the same kind of change in Korea. Therefore, we might study the Korea Holiness movement in relations with American Holiness movement.

Planting The Seeds: The Experiences Of Community Psychology Graduates As Agents Of Systemic Social Change, Peggy Ann Weston Jan 2007

Planting The Seeds: The Experiences Of Community Psychology Graduates As Agents Of Systemic Social Change, Peggy Ann Weston

Theses and Dissertations (Comprehensive)

Social change is a part of human existence, but other than charismatic individuals such as Dr. Martin Luther King Jr. and Gandhi, little has been published about the lived experience of social change agents. Time (era, passage of time, etc.) is often neglected as an important temporal factor of analysis in systemic social change (SSC) activities. The intent is to explore the experience of people working as SSC agents and discover what influences their work. A better understanding of this experience would contribute to more effective SSC work and perhaps address challenges facing change agents. The main research question, “What …

Crawford, Davis, And Way Beyond, Richard D. Friedman Jan 2007

Crawford, Davis, And Way Beyond, Richard D. Friedman

Articles

Until 1965, the Confrontation Clause of the Sixth Amendment to the United States Constitution hardly mattered. It was not applicable against the states, and therefore had no role whatsoever in the vast majority of prosecutions. Moreover, if a federal court was inclined to exclude evidence of an out-of-court statement, it made little practical difference whether the court termed the statement hearsay or held that the evidence did not comply with the Confrontation Clause.

Does Nonprofit Ownership Matter?, Jill R. Horwitz Jan 2007

Does Nonprofit Ownership Matter?, Jill R. Horwitz

Articles

In recent years, policymakers have increasingly questioned whether nonprofit institutions, particularly hospitals, merit tax exemption. They argue that nonprofit hospitals differ little from their for-profit counterparts in the provision of charity care and, therefore, should either lose their tax-exempt status or adhere to new, strict, and specific requirements to provide free services for the poor. In this Article, I present evidence that hospital ownership-whether it is for-profit, nonprofit, or government owned-has a significant effect on the mix of medical services it offers. Despite notoriously weak enforcement mechanisms, nonprofit hospitals act in the public interest by providing services that are unlikely …

Public Rights And Private Commerce: A Nineteenth-Century Atlantic Creole Itinerary, Rebecca J. Scott Jan 2007

Public Rights And Private Commerce: A Nineteenth-Century Atlantic Creole Itinerary, Rebecca J. Scott

Articles

Tracing the history of a family across three generations, from enslavement in eighteenth-century West Africa through emancipation during the Haitian Revolution and subsequent resettlement in New Orleans, then France, then Belgium, can shed light on phenomena that are Atlantic in scope. A business letter written in 1899 by the cigar merchant Edouard Tinchant to General Máximo Gómez in Cuba frames an inquiry that opens out onto a family itinerary that spanned the long nineteenth century. Rosalie Vincent’s achievement of freedom in the shadow of slavery in Saint-Domingue in 1793–1803 can be seen as linked to her grandson Edouard Tinchant’s participation …

Critical Success Factors For E-Commerce In Thailand: Cultural And Infrastructural Influences, Kittipong Laosethakul, William Boulton

WCBT Faculty Publications

The main purposes of this paper are to identify critical success factors (CSFs) for electronic commerce (e-commerce) in Thailand and explain the major influences behind these factors. Detailed case studies of nine e-commerce companies from different industries in Thailand were conducted. Results showed that social behavior and national culture, more specifically issues pertaining to trust and shopping behavior, were the major influences for the success of e-commerce in Thailand. The phenomenon could be partly explained by Hofstede’s cultural dimensions. Thailand’s infrastructure also played an important role in the success of its e-commerce development. The findings provide a framework to guide …

A Feminist Human Rights Law Approach For Engendering The Millennium Development Goals, Christina T. Holder Jan 2007

A Feminist Human Rights Law Approach For Engendering The Millennium Development Goals, Christina T. Holder

Cardozo Journal of Equal Rights & Social Justice

The note critiques the Millennium Development Goals (MDGs) for adopting a technocratic, economic-focused approach to poverty reduction, which neglects the equitable distribution of development benefits and the structural causes of poverty. It advocates for a feminist human rights law approach that integrates Third World Feminism and human rights frameworks to create a more inclusive and rights-based strategy for achieving the MDGs, particularly in empowering women and addressing gender inequalities.

French Headscarves And The U.S. Constitution: Parents, Children, And Free Exercise Of Religion, Christina A. Baker Jan 2007

French Headscarves And The U.S. Constitution: Parents, Children, And Free Exercise Of Religion, Christina A. Baker

Cardozo Journal of Equal Rights & Social Justice

The note examines the 2004 French law banning conspicuous religious symbols in public schools, highlighting its roots in France's unique secularist tradition (laïcité) and its implications for religious freedom. It contrasts this approach with the U.S., where the First Amendment would likely prevent such a ban, emphasizing the importance of protecting religious liberty to safeguard broader societal freedoms. The analysis underscores the differing legal and cultural frameworks between France and the U.S. in balancing secularism and religious expression.

Theses

This intensive single-site case study has taken the entering cohort of Year 11 students in the year 2000 and has used: Point-of-entry and post-experience interviews of students admitted to the course, Parallel entry and on-course surveys, On-course administration of the well-credentialed Adolescent Coping Scale (Frydenberg and Lewis, 1993), and Staff interviews to identify and describe the environmental, personal and contextual factors that are associated with a student’s completion/non-completion of the two year Course and thereby help the College Administration address the on-going unacceptably high numbers of students not completing the Course. By making extensive use of the Adolescent Coping Scale …
