Gender Nonconformity And The Unfulfilled Promise Of Price Waterhouse V. Hopkins, Joel Wm. Friedman Jan 2007

Gender Nonconformity And The Unfulfilled Promise Of Price Waterhouse V. Hopkins, Joel Wm. Friedman

Duke Journal of Gender Law & Policy

The Supreme Court has articulated a doctrinal framework that, if construed and applied properly, provides the lower federal courts with the analytical tools necessary to identify and proscribe workplace rules that compel individuals to adhere to appearance, attire, and behavioral norms that operate to reinforce gendered expectations.1 Since the Supreme Court has ruled that penalizing an individual for failing to conform to gendered norms of behavior constitutes a form of sex-based discrimination,2 one would expect that employees would have achieved some measure of success in challenging such policies.

Testing The Limits Of Antidiscrimination Law: The Business, Legal, And Ethical Ramifications Of Cultural Profiling At Work, Laura Morgan Roberts, Darryl D. Roberts

Duke Journal of Gender Law & Policy

While courts have rarely ruled in favor of plaintiffs bringing discrimination claims based on identity performance, legal scholars have argued that discrimination on the basis of certain cultural displays should be prohibited because it creates a work environment that is "heavily charged" with ethnic and racial discrimination. Drawing upon empirical studies of diversity management, stereotyping, and group dynamics, we describe how workplace cultural profiling often creates an unproductive atmosphere of heightened scrutiny and identity performance constraints that lead workers (especially those from marginalized groups) to behave in less authentic, less innovative ways in diverse organizational settings.

The Peahen’S Tale, Or Dressing Our Parts At Work, Julie A. Seaman Jan 2007

The Peahen’S Tale, Or Dressing Our Parts At Work, Julie A. Seaman

Duke Journal of Gender Law & Policy

However, there may ultimately be no logical way to reconcile decisions that prohibit employers from requiring women to wear revealing outfits and others that permit employers to require them to wear makeup,20 or decisions that prohibit penalizing a woman for being insufficiently feminine and others that permit penalizing a man for being insufficiently masculine.21 In addition, the increasing judicial acceptance of the sex stereotyping theory of sex discrimination under Title VII is in substantial tension with recent cases that insist that sex-differentiated dress and grooming requirements that "merely"22 conform to existing social gender norms do not amount to impermissible sex …

Preservationism, Or The Elephant In The Room: How Opponents Of Same-Sex Marriage Deceive Us Into Establishing Religion, Justin T. Wilson Jan 2007

Preservationism, Or The Elephant In The Room: How Opponents Of Same-Sex Marriage Deceive Us Into Establishing Religion, Justin T. Wilson

Duke Journal of Gender Law & Policy

The overwhelming majority of support for bans on same-sex civil marriage has come from religious believers, and the so-called "secular justifications" for these bans are mere pretexts for religious beliefs that homosexuality, homosexuals, and same-sex couples are evil or sinful. Courts should take a hard look at the substantive justifications offered in support of same-sex marriage bans, bearing in mind that (1) these justifications are universally offered by religious believers but are infrequently offered by credentialed Secularists, and (2) they are the result of a studied use of pretextual, secular-sounding language to cloak a religiously-motivated bias against homosexuals and same-sex …

The Many Faces Of Darlene Jespersen, Michael Selmi Jan 2007

The Many Faces Of Darlene Jespersen, Michael Selmi

Duke Journal of Gender Law & Policy

Since this symposium and this case are about appearances, it is worth noting that Lambda Legal posted pictures of Darlene Jespersen in her uniform on its website, and those pictures could be seen as presenting a stereotypical image of a middle-aged gay woman.5 There are obviously many reasons the pictures may have been presented-to humanize her, to show the effect of the makeup policy since the pictures appeared to be taken in the context of the personal best policy-but they also convey an image, and were likely intended to do so. An objection to this line of reasoning is likely …

A procedure was developed to synthesize a platinum–cobalt (Pt–Co) alloy electrocatalyst for oxygen reduction using Co/C composite as a support. The Pt–Co/C catalysts were synthesized through: (i) chemical oxidation of carbon black, (ii) Co deposition on the oxidized carbon using a chelation method, (iii) chemical treatment in an acidic medium to remove excess of Co on the carbon surface, (iv) Pt deposition onto the Co/C support, and (v) postheat treatment to form the Pt–Co alloy catalyst. The synthesized Pt–Co/C catalyst showed improved activity and long-term stability in polymer electrolyte membrane …

Community-Based And Collaborative Management Of Coral Reefs And Coastal Resources In Palau, Elizabeth Matthews Jan 2007

Community-Based And Collaborative Management Of Coral Reefs And Coastal Resources In Palau, Elizabeth Matthews

Open Access Dissertations

This study examines community-based and collaborative management of coral reefs in Palau through three manuscripts, each examining particular coastal resource management activities at a different scale of partnership and interaction: local protected area management at the state level, ecosystem management at the inter-state level, and migratory species (marine turtles) management at the state/national government level. In each instance, the social context of resource management was described using factors drawn from Richard Pollnac's Rapid Assessment of Management Parameters (RAMP) for coral reefs, among others. Ethnographic methods, especially key informant interviews and targeted questionnaires, were used in this study. A comparative analysis …

Judith Weir's King Harald's Saga: Innovations Of Character And Virtuosity In Contemporary Opera, Kelly Fiona Lynch

LSU Major Papers

In 1979, Scottish-born composer Judith Weir wrote King Harald’s Saga for the soprano Jane Manning. Although an opera in three acts, the cast consists of one performer unaccompanied, interpreting various characters, including the protagonist, King Harald, two of his wives, and the entire Norwegian Army. The opera presented in its entirety is ten minutes in duration. The scope of this paper is intended to assist the performer as well as those who are interested in contemporary opera. I have provided a brief overview of Weir’s compositional style in opera, chamber opera and song. As King Harald’s Saga was Weir’s first …

A Performer's Guide To Ross Lee Finney's Song Cycle Chamber Music, Joseph Charles Perniciaro

LSU Major Papers

Ross Lee Finney (1906-1997), significant American composer and pedagogue, published five works for solo voice and piano within his catalogue of genres and styles. Though composed in 1951, Finney’s setting of Chamber Music, to James Joyce’s texts by the same title, remained unpublished until 1985. This song cycle, Finney’s last published solo vocal work, will be the focus of this document and subsequent lecture recital. The purpose of this study will be to examine seventeen of the thirty-six songs from the cycle and provide performance suggestions. The written document is comprised of five chapters: Chapter One provides biographical information and …

Impact Of Lidar Nominal Post-Spacing On Dem Accuracy And Flood Zone Delineation, George T. Raber, John R. Jensen, Michael E. Hodgson, Jason A. Tullis, Bruce A. Davis, Judith Berglund Jan 2007

Impact Of Lidar Nominal Post-Spacing On Dem Accuracy And Flood Zone Delineation, George T. Raber, John R. Jensen, Michael E. Hodgson, Jason A. Tullis, Bruce A. Davis, Judith Berglund

Faculty Publications

Lidar data have become a major source of digital terrain information for use in many applications including hydraulic modeling and flood plane mapping. Based on established relationships between sampling intensity and error, nominal post-spacing likely contributes significantly to the error budget. Post-spacing is also a major cost factor during lidar data collection. This research presents methods for establishing a relationship between nominal post-spacing and its effects on hydraulic modeling for flood zone delineation. Lidar data collected at a low post-spacing (approximately 1 to 2 m) over a piedmont study area in North Carolina was systematically decimated to simulate datasets with …

Pairwise Alignment Of Metamorphic Computer Viruses, Scott Mcghee Jan 2007

Pairwise Alignment Of Metamorphic Computer Viruses, Scott Mcghee

Master's Projects

Computer viruses and other forms of malware pose a threat to virtually any software system (with only a few exceptions). A computer virus is a piece of software which takes advantage of known weaknesses in a software system, and usually has the ability to deliver a malicious payload. A common technique that virus writers use to avoid detection is to enable the virus to change itself by having some kind of self-modifying code. This kind of virus is commonly known as a metamorphic virus, and can be particularly difficult to detect [17]. Existing virus detection software is continually being improved …

A Communication Link Reliability Study For Small Unmanned Aerial Vehicles, Alicia K. Mylin

University of Kentucky Master's Theses

Dependable communication links for unmanned aerial vehicles (UAV) are crucial to operational reliability and mission success. This study is focused on evaluating the probability of successful communication links for small UAVs. A program based on the Friis Transmission Equation was developed to calculate the power received in a line-of-sight communication link. The program was used to evaluate the probability of success for a variety of flight pa

The Superior Position Of The Creditor In The Community Property Regime: Has The Community Become A Mere Creditor Collection Device?, Andrea B. Carroll

Journal Articles

This article is a first step in an effort to critically examine the continued vitality of the community regime for regulating spousal property. Specifically, the article examines the American community property regimes in light of how they measure up against non-community property states in terms of creditor protection. The results are often surprising. The community regime grants creditors access to a variety of property for all manner of debts. For instance, the entirety of the community property, including the non-debtor spouse's wages, may be seized in some community property states for the other's premarital debts. That the non-debtor spouse has …

Coercion, Causation, And The Fictional Elements Of Indirect State Responsibility, James D. Fry Jan 2007

Coercion, Causation, And The Fictional Elements Of Indirect State Responsibility, James D. Fry

Vanderbilt Journal of Transnational Law

This Article provides an in-depth analysis of Article 18 of the 2001 ILC Draft Articles on State Responsibility, which holds a coercing state indirectly responsible for an injurious act committed by a coerced state. Not only does this provision lack support from state practice, but the structural and logical flaws within the current formulation ensure that this provision does not significantly influence the evolution of state practice. Indeed, it would have been better for the ILC to have left Article 18 out of the Draft Articles, given that other, less problematic provisions could have covered such situations involving coercion. In …
