Ntp V. Rim: The Diverging Law Between System And Method Claim Infringement, Stephen P. Cole

The University of New Hampshire Law Review

[Excerpt] “Almost thirty years after the landmark decision of Decca Ltd. v. United States, the Federal Circuit had an opportunity to reevaluate the extraterritorial limits of U.S. patent law in NTP, Inc. v. Research in Motion, Ltd. After withdrawing its initial opinion (“NTP I”) and issuing a second opinion (“NTP II”), the court held that a system having a component located outside U.S. jurisdiction could be subject to U.S. patent law. The court held as a matter of law, however, that a process in which a step is performed outside U.S. jurisdiction could not be subject to U.S. patent law. …

Mark-Recapture Of Chinese Paddle-Tail Salamanders (Pachytriton Brevipes) Using Spot Pattern Recognition, Michelle Lester

Undergraduate Honors Theses

An abundance and demography survey was conducted on Chinese Paddle-tail salamanders, Pachytriton brevipes, found within the Valley of the Wild Monkeys Park in Huangshan, China. Established mark-recapture sampling techniques were used to investigate population size of this species within the park's streams. Digital photographs were taken of all individuals encountered in order to identify recaptures in a non-invasive manner. There were 56 adult individuals encountered with six recaptured in Y A2 stream and 12 individuals with five recaptured in the Y Al stream. Both Jolly-Seber closed population and Lincoln-Peterson open population models were used to estimate population abundance. Estimates …

Play, Laughter And Humor In Captive Chimpanzees (Pan Troglodytes), Jason M. Wallin Jan 2007

Play, Laughter And Humor In Captive Chimpanzees (Pan Troglodytes), Jason M. Wallin

Undergraduate Honors Theses

Play is ubiquitous in mammals, and argued to occur across many taxa including birds, non-avian reptiles, and invertebrates. Laughter is common in human interactions, and growing evidence from chimpanzees, rats, and dogs may mean it is also common among mammals (at least). Humor in non-humans is less well studied, though theoretical work and anecdotes exist. This study examined play, laughter, and humor using a longitudinal dataset of narrative shift reports collected over more than 1,300 days in a unique family of non-human animals, chimpanzees who use American Sign Language to communicate. Play was more common when young males were present …

Addressing The Incoherency Of The Preemption Provision Of The Copyright Act Of 1976, Joseph P. Bauer Jan 2007

Addressing The Incoherency Of The Preemption Provision Of The Copyright Act Of 1976, Joseph P. Bauer

Vanderbilt Journal of Entertainment & Technology Law

Section 301 of the Copyright Act of 1976 expressly preempts state law actions that are within the "general scope of copyright" and that assert claims that are "equivalent to" the rights conferred by the Act. The Act eliminated the previous system of common law copyright for unpublished works, which had prevailed under the prior 1909 Copyright Act. By federalizing copyright law, the drafters of the statute sought to achieve uniformity and to avoid the potential for state protection of infinite duration.

The legislative history of § 301 stated that this preemption provision was set forth "in the clearest and most …

Reflections On Animals, Property, And The Law And Rain Without Thunder, Gary L. Francione Jan 2007

Reflections On Animals, Property, And The Law And Rain Without Thunder, Gary L. Francione

Law and Contemporary Problems

Animal interests will almost always be regarded as less important than human interests, even when the human interest at stake is relatively trivial and the animal interest at stake is significant. The result of any supposed balancing of human and nonhuman interests required by animal-welfare laws is predetermined from the outset by the property status of the nonhuman as a "food animal," "experimental animal," "game animal," et cetera.

A Return To Descartes: Property, Profit, And The Corporate Ownership Of Animals, Darian M. Ibrahim Jan 2007

A Return To Descartes: Property, Profit, And The Corporate Ownership Of Animals, Darian M. Ibrahim

Law and Contemporary Problems

Philosopher Rene Descartes claimed that animals were no different than inanimate objects: that they could not think or feel pain. Rejection of Descartes' views on animals is nearly universal, but today's factory farms are only possible by treating animals according to Cartesian principles. When faced with the realization that animal foods can be made affordable to most consumers only through factory farming, society is left with a dichotomous choice: either stop purchasing and consuming animal products, or animals will continue to suffer in factory farms.

Tool-Related Cognition In New Caledonian Crows., Lucas A. Bluff, Alex A.S. Weir, Christian Rutz Jan 2007

Tool-Related Cognition In New Caledonian Crows., Lucas A. Bluff, Alex A.S. Weir, Christian Rutz

KIP Articles

The extent to which non-humans understand their physical world is controversial, due to conceptual and empirical difficulties. We examine the evidence for physical understanding in the remarkable tool-oriented behaviour of New Caledonian crows, which make several types of tool in the wild and show prolific tool-related behaviour in captivity. We summarize our own research into the cognitive processes involved in tool behaviour in this species, and review comparable studies in other birds and primates. Our main laboratory findings are: tool-related behaviour emerges in juvenile crows that had no opportunity to learn from others; adult crows can make or select tools …
