Your Licensor Has A License To Kill, And It May Be Yours: Why The Ninth Circuit Should Resist Bankruptcy Law That Threatens Intellectual Property Licensing Rights, Jon Minear

In recent opinions, the U.S. Court of Appeals for the Seventh Circuit has interpreted the Bankruptcy Code ("the Code") in a manner that makes inaction or ignorance perilous for IP licensees whose licensor declares bankruptcy. Although Congress amended the Code to protect a licensee from losing technology rights in these situations, the Seventh Circuit has narrowly interpreted a strikingly similar bankruptcy provision involving real-estate leases and, in doing so, has cast doubt on the efficacy of the licensee protections found in section 365(n) of the Code. Malaria And Pregnancy: The Perspective In Pakistan, Maqsood A. Bhatti, Muhammad Azharuddin, Samreen Bhatti, Muhammad Islam, Muhammad Aslam Khan

Objective: To study the effects of malaria on pregnancy outcome.Methods: A case control study conducted on patients identified by ICD-9 coding system of the hospital medical records. Demographic and clinical data recorded on standardized data sheet and analyzed using SPSS 11.5 software.Results: Of the total patients, 67.4% were multigravid and 32.6% were primigravid with 78.6% of patients having platelets < 150,000. Mean haemoglobin was 9.4 gm/dl in patients and 12.2 gm/dl in controls. Plasmodium Vivax was accounted for 55.8%, P. Falciparum for 41.9%, and P. Ovale 2.3% of infections. In all, 48.8% of patients received oral Chloroquine, 16.3% oral Quinine, 30.3% intravenous Quinine, 20.9% of patients received combination treatment with IV Clindamycin, and one each patient received oral Artemether or oral halofantrine. Two patients had an abortion. One of the following complications including, threatened abortion, preterm labour, ARDS or Cerebral malaria, was observed in one patient each. Mean weight of babies born to cases was 2.8 kg (range 1.4-3.8) and of control babies was 3.2 kg (range 2.5-4.0 kg). No congenital malformations were reported.CONCLUSION: Plasmodium falciparum sp, moderate parasitic load, haemoglobin < 10 gm/dL, platelet count < 50,000/mm3 and IV quinine with loading dose of 20 mg/kg are identified as few of the potential risk factors for poor outcome in pregnancy.

HIV and AIDS

The Horizons program, in partnership with International Medical Corps and Steadman Research Services International, conducted an intervention study in Kibera, an urban slum in Nairobi, Kenya to determine what effect three different community-based activities had on utilization of key prevention of mother-to-child transmission (PMTCT) services. The interventions included moving services closer to the population via mobile clinics, as well as increasing psychosocial support through the use of traditional birth attendants and peer counselors as PMTCT promoters. Transcending Boundaries To Improve The Food Security Of Hiv-Affected Households In Rural Uganda: A Case Study, Katharine Coon, Jessica Ogden, John Odolon, Anthony Obudi-Owor, Charles Otim, James Byakigga, Peter Spebanja

HIV and AIDS

A case study conducted in Tororo, Uganda found that a partnership between TASO, an AIDS service NGO and agricultural extension, was successful in helping HIV-affected communities improve food security. This Horizons study reports that four participatory training workshops developed through the alliance resulted in improved management capacity and more collaborative organizational structures among the district partners. This in turn created the conditions for the AIDS community workers and other field partners to work more effectively together with farmers’ groups at the local level to identify and address constraints to food security.

In this article, I examine my revelations and growth related to folk culture and literature connected to the African American community. I borrow from and play on the Sudanese formulaic ending for the folktale; it seemed to me appropriate - even obligatory- that "I put the tale back where I found it." This Article will demonstrate that a pharmacist's refusal to fill a valid prescription for emergency contraception constitutes sex discrimination and violates the WLAD. Part I explains the nature and function of emergency contraceptive pills (ECPs) as well as their role in basic health care for women and the importance of their accessibility. Part II addresses federal civil rights protections and the failure of these protections to provide relief for women facing refusals. Part I of this Article explores the general themes of third-wave feminist writings. The Article begins with an overview of third-wave feminist literature and its predominant concerns. These concerns are (1) dissatisfaction with earlier feminists; (2) the multiple nature of personal identity; (3) the joy of embracing traditional feminine appearance and attributes; (4) the centrality of sexual pleasure and sexual self-awareness; (5) the obstacles to economic empowerment; and (6) the social and cultural impact of media and technology. Patent law has been described as "the Price of Life". This can most strikingly be seen when applied to developing countries' access to HIV/AIDS drugs. Since the explosion of the HIV/AIDS epidemic in the 1980's, the disease referred to as the "Modern Black Death" has devastated large parts of populations in several developing countries. Because of several reasons, including strong patent protection advocated and implemented by developed countries through TRIPS and the resulting high price of medicines, these developing countries cannot afford the price of the HIV/AIDS drugs.
