Looking Over A Crowd And Picking Your Friends: Civil Rights And The Debate Over The Influence Of Foreign And International Human Rights Law On The Interpretation Of The U.S. Constitution, Stanley A. Halpin

UC Law SF International Law Review

Since the 1940s Civil Rights advocates have attempted, with little success, to use International Human Rights law to protect the rights of African Americans in the United States. However, in recent terms, the United States Supreme Court has seemingly opened the door, at least a crack, to some limited recognition of international human rights norms as a legitimate influence upon their interpretation of the Constitution. This article examines the efforts of Civil Rights Advocates to utilize human rights law and develops from this history four models of enforcement of human rights law in the United States. It details the Court's …

Recent Developments In The Debate Concerning The Use Of Foreign Law In Constitution Interpretation, Lisa Sofio

UC Law SF International Law Review

Comparative analysis, the interpretive technique of using foreign and international law to better understand the United States Constitution, may be a valuable tool for modern judges. Legislative proposals and statements made by various members of Congress reveal that Congress is opposed to the judiciary's use of comparative analysis and appears prepared to take drastic measures to prevent judges from looking to foreign law to answer difficult questions. This note explores the propriety and reasons for this response and explores whether comparative analysis has merit as an interpretive tool.

Development Of Literacy Beliefs And Practices: Preservice Teachers With Reading Specializations In A Field-Based Program, Wayne M. Linek, Mary Beth Sampson, I. Laverne Raine, Kimberly Klakamp, Brenda Smith

Reading Horizons: A Journal of Literacy and Language Arts

This manuscript documents a year-long descriptive case study of preservice teachers specializing in reading. The objectives of this study were to (a) better understand the development of literacy beliefs and change processes in preservice teachers with reading specializations engaged in the final year of their field-based teacher education program, and (b) ascertain factors influencing their change processes during the final year of preparation. The results highlight the shifts these preservice teachers made concerning their beliefs about literacy instruction and the factors that served as catalysts for those changes.

On Becoming A Family: Melanie's Story Of Benjamin's Adoption, 2002, Melanie Springer Mock

Faculty Publications - Department of English

Excerpt: "I became a mother in the back of a taxi cab.

No sit-com cliché, this. The taxi was a late-model, jacked up Honda, its plush chairs bedecked by delicate white doilies. Traffic dared not impede my driver, a silently brooding young man who weaved between Cyclos and motorcycles freighted by fruit, vegetables, live chickens, entire families. I sat tensely in the backseat, holding my son, incredulously wondering into what I had just gotten myself."

Treatment At The Front End Of The Criminal Justice Continuum: The Association Between Arrest And Admission Into Specialty Substance Abuse Treatment, Sheryl Kubiak, Cynthia L. Arfken, James A. Swartz, Alison L. Koch Jan 2006

Treatment At The Front End Of The Criminal Justice Continuum: The Association Between Arrest And Admission Into Specialty Substance Abuse Treatment, Sheryl Kubiak, Cynthia L. Arfken, James A. Swartz, Alison L. Koch

Wayne State University Associated BioMed Central Scholarship

Abstract

Background

To reduce criminal recidivism and drug use, it has been proposed that the substance abuse treatment delivery system cut across different components of the criminal justice continuum. Arrest, at the front end of this continuum, may represent a critical moment to motivate people with substance use disorders (SUD) to seek treatment but is often over looked as an intervention point. We used data from the 2002 National Survey on Drug Use and Health (NSDUH) to compare treatment need and recent treatment admission for participants with no criminal justice (CJ) involvement in the past year, past-year arrest, and CJ …

The 9/11 Reform Act: Examining The Implementation Of The Human Smuggling And Trafficking Center, U.S. House Of Representatives Committee On Homeland Security

Human Trafficking: Data and Documents

The 9/11 Commission correctly pointed out that before September 11, 2001, no U.S. Government agency systemically analyzed terrorists’ travel strategies. The 9/11 Commission also believed if the Federal Government had done so, we could have discovered how terrorist predecessors to al-Qa’ida exploited the weaknesses in our border security.

As a result, and based on the Commission’s recommendation, the Committee on Homeland Security, along with the Committee on International Relations, pushed for the terrorist travel provisions in the 9/11 Reform Act. Through the Act, Congress directed the Departments of Justice, State and Homeland Security to address the problem of terrorist travel, …

Abstract

Background

The Multicenter Study of Hydroxyurea (HU) in Sickle Cell Anemia (MSH) previously showed that daily oral HU reduces painful sickle cell (SS) crises by 50% in patients with moderate to severe disease. The morbidity associated with this disease is known to have serious negative impact on the overall quality of life(QOL) of affected individuals.

Methods

The data in this report were collected from the 299 patients enrolled in the MSH. Health quality of llife (HQOL) measures were assessed in the MSH as a secondary endpoint to determine if the clinical benefit of HU could translate into a measurable …

Achieving The American Dream: Facilitators And Barriers To Homeownership Among Immigrants, Lutchmie Narine, Marcia A. Shobe Jan 2006

Achieving The American Dream: Facilitators And Barriers To Homeownership Among Immigrants, Lutchmie Narine, Marcia A. Shobe

Public Health, Food Studies, and Nutrition

As of March 2003, the immigrant population in the United States (US) has reached 33.5 million individuals. Finding a way out of poverty is very difficult for many immigrants due to both individual and institutional barriers to savings and asset accumulation. Given that the primary sources of wealth among native-born households is through homeownership, it is only fitting that foreign-born households would also wish to achieve the “American Dream.” This paper outlines significant supports and barriers to savings and, more importantly, homeownership among US immigrants. Several suggestions for asset-based policy development for immigrants are also included in the discussion. By …

Newly Betwixt And Between: Revising Liminality In The Context Of A Teacher Preparation Program, Alison Cook-Sather Jan 2006

Newly Betwixt And Between: Revising Liminality In The Context Of A Teacher Preparation Program, Alison Cook-Sather

Education Program Faculty Research and Scholarship

Through an analysis of a contemporary rite of passage-the final stage of teacher preparation-I develop a new theory of liminality that both builds on and extends Victor Turner's enduring insights. The analysis focuses on how preservice teachers in an undergraduate education program engage in a process of identity formation within an asynchronous, nondimensional, liminal space made possible and shaped by e-mail and with the support of experienced mentor teachers.

Temperament In Context: Infant Temperament Moderates The Relationship Between Perceived Neighborhood Quality And Behavior Problems, Craig R. Colder, Liliana J. Lengua, Paula J. Fite, Joshua A. Mott, Nicole R. Bush Jan 2006

Temperament In Context: Infant Temperament Moderates The Relationship Between Perceived Neighborhood Quality And Behavior Problems, Craig R. Colder, Liliana J. Lengua, Paula J. Fite, Joshua A. Mott, Nicole R. Bush

United States Public Health Resources

Hypotheses that positive affect and fear in infancy moderate later relationships between neighborhood quality and behavior problems were examined in a sample of children from the National Longitudinal Survey of Youth. Results suggested that poor neighborhood quality was associated with antisocial behavior at age 6 for children who in infancy were characterized by either high positive affect and low fear or by low positive affect and high fear. Depression/anxiety increased from age 6 to age 12 for children in poor quality neighborhoods who were characterized in infancy by low positive affect. A combination of low fear and high positive affect …
