Architecture Program: Faculty Scholarly and Creative Activity

This study examines the quality of life in Crete, Nebraska, with the specific purpose of identifying the factors that play the largest role in determining residential satisfaction. The survey asks a number of questions pertaining to different aspects of living in Crete. The survey is adapted from a survey previously used for a similar study in Schuyler, Nebraska. Focus groups are used to identify key issues in Crete and make adjustments to the questionnaire. Cronbach’s alpha is used to test the reliability of the topical variables, and index variables are created, which are used in the subsequent analysis. Using residential …

The Role Of Emotional Intelligence In Counseling Bilingual Latinos Who Avoid Expressing Or Experiencing Emotions, Mayra A. Montalvo Jan 2006

The Role Of Emotional Intelligence In Counseling Bilingual Latinos Who Avoid Expressing Or Experiencing Emotions, Mayra A. Montalvo

Graduate Research Papers

A review of literature on the role of emotional intelligence in counseling bilingual Latinos who avoid expressing or experiencing emotions reveals that language, gender, ethnicity, religion, and family structure influence emotion usage. The two constructs, emotional intelligence and multiculturalism, offered a framework for understanding cultural and contextual factors in cross-cultural client-counselor relationships, redefining resistance from a multicultural standpoint, and possible therapeutic interventions that take into account the cultural influences and beliefs of Latinos on the mental health system.

Introduction To The Special Issue On Emotion In Legal Judgment And Decision Making, Brian H. Bornstein Jan 2006

Introduction To The Special Issue On Emotion In Legal Judgment And Decision Making, Brian H. Bornstein

Department of Psychology: Faculty Publications

In the last decade, researchers have shown burgeoning interest in issues at the intersection of emotion and law. Given the longstanding interest in emotion among social (and other) psychologists, most of this research has come from a psychological perspective, but it also includes work with a legal, sociological, philosophical, and neuroscience flavor. The issues are theoretical as well as practical, influencing both psychological theories of emotion and matters of legal practice and policy.

The law adopts a double standard in its treatment of emotion. In some areas, the law explicitly addresses emotion as a legitimate consideration, but in other areas, …

Can Copyright Lend Its Cinderellaic Magic To Chinese Folklore?, 5 J. Marshall Rev. Intell. Prop. L. 203 (2006), Deming Liu

UIC Review of Intellectual Property Law

Folklore in China is disappearing and facing challenges for its very survival. To salvage folklore in China, some have called for immediate legislative action and proposed the law of copyright or sui generis protection as some potential solutions. However, copyright is traditionally concerned with the creations of individuals rather than the cumulative creations of an ethnic group or region. Furthermore, even sui generis protection, which is better adapted to folklore in theory, could be susceptible in practice to the abuses of private monopolies or state tyranny. Overall, the protection of folklore depends more on a consistent governmental policy of open-mindedness …

Legal Writing Programs And Professionalism: Legal Writing Professors Can Join The Academic Club, James M. Boland Jan 2006

Legal Writing Programs And Professionalism: Legal Writing Professors Can Join The Academic Club, James M. Boland

St. Thomas Law Review

Sociological jurisprudence has been a major factor in legal interpretive schemes for over a century, but this has not been reflected in most legal writing programs. These programs must produce legal writers who not only are competent writers, but are also competent legal theorists who know the difference between classical rule-based reasoning and modem interpretive methods. Concomitantly, legal writing professors must produce scholarship that reflects the diversity of these more complex schemes, rather than just writing about writing. This article will first describe the current condition of legal writing programs, and then suggest changes that more thoroughly introduce students to …

Won't You Be My Neighbor?: Child Abuse In A Community Context, Gabrielle Rebottini

Electronic Theses and Dissertations

This project quantitatively and spatially examines child abuse reports in a neighborhood context based on the analysis of Allegheny County in Southwestern Pennsylvania that is divided into 98 zip codes. Based on data on child abuse reports obtained from ChildLine from 1994 to 2004, this research tests a relationship between variables traditionally associated with child abuse rates and reporting rates. Next, neighborhood assets are compared to determine their relevance. They include grocery stores, parks, libraries, hospitals, schools and religious institutions. Results include significant relationships between reporting rates and unemployment, vacancy rates, marital status, the elderly population, and the location of …

Adolescents’ Expectations About Mothers’ Employment: Life Course Patterns And Parental Influence, Matthew Weinshenker Jan 2006

Adolescents’ Expectations About Mothers’ Employment: Life Course Patterns And Parental Influence, Matthew Weinshenker

Sociology Faculty Publications

Because of social constraint and personal preference, cutting back and dropping out of the workforce remain common responses to the problem of balancing work and motherhood. To understand whether this phenomenon will continue, adolescents from middle-class, dual-earner families (N = 194) were asked how much they expected that they (for girls) or their future partners (for boys) would work while raising children. Nearly all expected new mothers to quit their jobs or reduce their hours temporarily, which signifies either acceptance of, or ignorance of, the penalties of career interruption among girls with high occupational aspirations. Adolescents’ expectations were associated with …

Looking Over A Crowd And Picking Your Friends: Civil Rights And The Debate Over The Influence Of Foreign And International Human Rights Law On The Interpretation Of The U.S. Constitution, Stanley A. Halpin Jan 2006

Looking Over A Crowd And Picking Your Friends: Civil Rights And The Debate Over The Influence Of Foreign And International Human Rights Law On The Interpretation Of The U.S. Constitution, Stanley A. Halpin

UC Law SF International Law Review

Since the 1940s Civil Rights advocates have attempted, with little success, to use International Human Rights law to protect the rights of African Americans in the United States. However, in recent terms, the United States Supreme Court has seemingly opened the door, at least a crack, to some limited recognition of international human rights norms as a legitimate influence upon their interpretation of the Constitution. This article examines the efforts of Civil Rights Advocates to utilize human rights law and develops from this history four models of enforcement of human rights law in the United States. It details the Court's …

Recent Developments In The Debate Concerning The Use Of Foreign Law In Constitution Interpretation, Lisa Sofio Jan 2006

Recent Developments In The Debate Concerning The Use Of Foreign Law In Constitution Interpretation, Lisa Sofio

UC Law SF International Law Review

Comparative analysis, the interpretive technique of using foreign and international law to better understand the United States Constitution, may be a valuable tool for modern judges. Legislative proposals and statements made by various members of Congress reveal that Congress is opposed to the judiciary's use of comparative analysis and appears prepared to take drastic measures to prevent judges from looking to foreign law to answer difficult questions. This note explores the propriety and reasons for this response and explores whether comparative analysis has merit as an interpretive tool.

Reading Horizons: A Journal of Literacy and Language Arts

This manuscript documents a year-long descriptive case study of preservice teachers specializing in reading. The objectives of this study were to (a) better understand the development of literacy beliefs and change processes in preservice teachers with reading specializations engaged in the final year of their field-based teacher education program, and (b) ascertain factors influencing their change processes during the final year of preparation. The results highlight the shifts these preservice teachers made concerning their beliefs about literacy instruction and the factors that served as catalysts for those changes.

On Becoming A Family: Melanie's Story Of Benjamin's Adoption, 2002, Melanie Springer Mock

Faculty Publications - Department of English

Excerpt: "I became a mother in the back of a taxi cab.

No sit-com cliché, this. The taxi was a late-model, jacked up Honda, its plush chairs bedecked by delicate white doilies. Traffic dared not impede my driver, a silently brooding young man who weaved between Cyclos and motorcycles freighted by fruit, vegetables, live chickens, entire families. I sat tensely in the backseat, holding my son, incredulously wondering into what I had just gotten myself."
