An Empirical Study Of Parental Responsibility Laws: Sending Messages, But Wat Kind And To Whom?, Leslie Joan Harris Jan 2006

An Empirical Study Of Parental Responsibility Laws: Sending Messages, But Wat Kind And To Whom?, Leslie Joan Harris

Utah Law Review

Finally, parental responsibility laws define youth crime as a private problem born of familial failure rather than behavior that, at low levels, is a usual part of the maturation process and, at higher levels, may call for collective efforts to engage teenagers in positive ways, including helping parents in difficult situations. The laws provide politicians with a cheap and easy way of avoiding meaningful efforts to address significant social issues.

Hamdan V. Rumseld: The Legal Academy Goes To Practice, Neal K. Katyal

Georgetown Law Faculty Publications and Other Works

Hamdan v. Rumsfeld is a rare Supreme Court rebuke to the President during armed conflict. The time is not yet right to tell all of the backstory of the case, but it is possible to offer some preliminary reflections on how the case was litigated, the decision, and its implications for the oft-noticed divide between legal theory and practice.

In a widely cited article, Judge Harry Edwards lamented "the growing disjunction between legal education and the legal profession," claiming that "many law schools. .. have abandoned their proper place, by emphasizing abstract theory at the expense of practical scholarship and …

The Post-9/11 Federal Homeland Security Paradigm And The Adoptive Capacity Of Public Administration Theory And Practice, Chaya Rani Jain Jan 2006

The Post-9/11 Federal Homeland Security Paradigm And The Adoptive Capacity Of Public Administration Theory And Practice, Chaya Rani Jain

Theses and Dissertations

The September 11, 2001 terrorist attacks redefined the federal approach to disaster planning. Prior to 9/11, disaster and emergency management meant preparedness for and response to natural and man-made emergencies such as floods, hurricanes, fires, and civil discord. The post-9/11 paradigm shift, a multi-pronged approach called "homeland security" strategy, now incorporates a multitude of man- and nature-made disasters to include border and transportation security; emergency preparedness, response and recovery against chemical, biological, radiological and nuclear threats; as well as information analysis and infrastructure protection. These new priorities were communicated to the state and local governments. The purpose of this descriptive, …

The Developments In Paramedical Science And The Implications Of National And International Accreditation And Registration In Alliance With Ambulance Authorities, Barry Gibson, Richard Brightwell

EDU-COM International Conference

The School of Exercise, Biomedical and Health Sciences at Edith Cowan University established a new Bachelor of Science (Paramedical Science) degree in 2004. The program is a joint initiative between Edith Cowan University and St. John Ambulance and is the only Paramedical degree being taught within Western Australia. In preparing the graduates to work in the profession as qualified paramedics, it was essential to integrate the theoretical content taught by both the university and the ambulance corporation with significant practical experiences being delivered in the ambulance and hospital environments. The implications for this type of arrangement have been far reaching, …

Challenging Standard Conceptions Of Tradition, Science And Technology In 2006: Why Laws Prohibiting The Sale Of Violent Video Games To Minors Should Be Ultimately Upheld, Ilana Lubin

Cardozo Journal of Equal Rights & Social Justice

The note argues that regulating the sale of violent video games to minors is constitutionally justifiable, supported by scientific evidence on adolescent brain development and legal precedents. It critiques the lack of a clear legal standard in court decisions and advocates for a nuanced approach that balances First Amendment rights with public safety concerns.

The Cultural, Political, And Legal Climate Behind The Fight To Stop Trafficking In Women: William J. Clinton's Legacy To Women's Rights, Susan Tiefenbrun Jan 2006

The Cultural, Political, And Legal Climate Behind The Fight To Stop Trafficking In Women: William J. Clinton's Legacy To Women's Rights, Susan Tiefenbrun

Cardozo Journal of Equal Rights & Social Justice

The article examines the Clinton Administration's significant contributions to advancing women's rights, particularly through landmark legislation such as the Family and Medical Leave Act (FMLA) and the Trafficking Victims Protection Act (TVPA). These efforts, including the appointment of women to high office, reflect a cultural shift toward valuing women's roles and protecting them from exploitation. The TVPA, reauthorized under subsequent administrations, has had a lasting domestic and international impact in combating human trafficking and supporting victims. The article highlights the importance of legislative and judicial approaches in addressing violence against women and promoting gender equality.

Effect Of Speed Limit Increase On Crash Rate On Rural Two-Lane Highways In Louisiana, Athira Swarna Jayadevan Jan 2006

Effect Of Speed Limit Increase On Crash Rate On Rural Two-Lane Highways In Louisiana, Athira Swarna Jayadevan

LSU Master's Theses

Though the rural two lane roads are the low volume-less traveled roads, the majority of the crashes occur on these roads and the high speed of motor vehicles on these roads is suspected to be one of the main causes for this. This study focused on the development of a methodology to study the impact of a speed limit increase on the crash rate on the rural two lane roads in Louisiana. The Louisiana crash database obtained from the Louisiana Department of Transportation (LADOTD) was used to carry out the analysis. The analysis consisted of the comparison of crash rates …

Cultural Cognition And Public Policy, Donald Braman, Dan M. Kahan Jan 2006

Cultural Cognition And Public Policy, Donald Braman, Dan M. Kahan

GW Law Faculty Publications & Other Works

People disagree about the empirical dimensions of various public policy issues. It's not surprising that people have different beliefs about the deterrent effect of the death penalty, the impact of handgun ownership on crime, the significance of global warming, the public health consequences of promiscuous sex, etc. The mystery concerns the origins of such disagreement. Were either the indeterminacy of scientific evidence or the uneven dissemination of convincing data responsible, we would expect divergent beliefs on such issues to be distributed almost randomly across the population, and beliefs about seemingly unrelated questions (whether, say, the death penalty deters and whether …

Automated Adaptation Between Kiranti Languages, Daniel Richard Mccloy Jan 2006

Automated Adaptation Between Kiranti Languages, Daniel Richard Mccloy

Graduate Student Theses, Dissertations, & Professional Papers

McCloy, Daniel, M.A., December 2006 Linguistics Automated Adaptation Between Kiranti Languages Chairperson: Dr. Anthony Mattina Minority language communities that are seeking to develop their language may be hampered by a lack of vernacular materials. Large volumes of such materials may be available in a related language. Automated adaptation holds potential to enable these large volumes of materials to be efficiently translated into the resource-scarce language. I describe a project to assess the feasibility of automatically adapting text between Limbu and Yamphu, two languages in Nepal’s Kiranti grouping. The approaches taken—essentially a transfer-based system partially hybridized with a Kiranti-specific interlingua—are placed …

A Digital Age Communications Act Paradigm For Federal-State Relations, Kyle D. Dixon, Philip J. Weiser Jan 2006

A Digital Age Communications Act Paradigm For Federal-State Relations, Kyle D. Dixon, Philip J. Weiser

Publications

This article captures the effort of the Digital Age Communications Act (DACA) to craft a new framework for the federal-state relationship in implementing a next generation telecommunications regulatory regime. In particular, it sets forth a DACA model that would implement a "rule of law" regulatory paradigm for an era of technological dynamism. This era requires, as the article explains, a coherent federal framework that circumscribes the role of state and local authorities so as to advance sound competition policy goals. The sole exception to this policy is the recognition that a basic local service rate retains both political and practical …
