Historical Overview Of The American Land Use System: A Diagnostic Approach To Evaluating Governmental Land Use Control, John R. Nolon Sep 2006

Historical Overview Of The American Land Use System: A Diagnostic Approach To Evaluating Governmental Land Use Control, John R. Nolon

Elisabeth Haub School of Law Faculty Publications

This article describes how the American land use system has evolved to address recent environmental and economic development problems. It begins by tracing the history of the legal system used in the United States to control private sector land development and demonstrates how it achieved the flexibility needed to respond to modern challenges. The American land use system has paid a price for this flexibility: it is not a coherent whole, but rather a fragmented mosaic of legal influences. Impressive examples of cohesion are cited that suggest a strategic approach to reforming the system so that it can become an …

Economic Well-Being And Intimate Partner Violence: New Findings About The Informal Economy, Loretta Pyles

The Journal of Sociology & Social Welfare

The purpose of this research was to explore the relationship between intimatep artnerv iolence (IPV) and women's participationin the informal economy (both legal and illegal) and their impact on economic well-being. This research was part of a National Institute of Justice (NIJ) study that was concerned with women's survival of childhood and adult abuse. For the 285 women that were in this sample, there were positive, medium correlations between IPV and various types of informal economic activity. Illegal informal economic activity, institutionalized informal economic activity, incarceration and physical abuse negatively impacted women's economic well-being.

Men's Quest For Wholeness: The Changing Counseling Needs Of Paheka Males, Philip Culbertson Sep 2006

Men's Quest For Wholeness: The Changing Counseling Needs Of Paheka Males, Philip Culbertson

UNIversitas: Journal of Research, Scholarship, and Creative Activity

In this essay I will claim that one of the most significant factors explaining the high levels of domestic and public violence in New Zealand is the definition of masculinity that Pakeha (descendants of white colonial settlers) men have inherited and the risks and demands for men who attempt to achieve it. In order to comprehend the extreme stress which the Pakeha definition of masculinity places on men, we need to begin by understanding how culture-specific every definition of masculinity (and femininity) is. Next we need to review how this Pakeha definition developed as a result of the history of …

Hypermasculinity And Violence As A Social System, Thomas J. Scheff Sep 2006

Hypermasculinity And Violence As A Social System, Thomas J. Scheff

UNIversitas: Journal of Research, Scholarship, and Creative Activity

Current theories of conflict fail to develop an adequate model of the causation of violence. Greed for power is often invoked, but how greed itself develops is seldom considered. Particularly absent are models explaining the vast energy that propels violence and destruction. This essay will consider bases of greed and violence unleashed by alienation and repression of emotions. Since it appears that most men in our society are more alienated/repressed than most women, the idea of hypermasculinity is used to develop a theory of conflict. The combination of alienation with the repression of vulnerable emotions suggests a biosocial doomsday machine …

Paying Ceos In Bankruptcy: Executive Compensation When Agency Costs Are Low, M. Todd Henderson Sep 2006

Paying Ceos In Bankruptcy: Executive Compensation When Agency Costs Are Low, M. Todd Henderson

Coase-Sandor Institute for Law & Economics Research Paper Series

Conventional wisdom suggests that high agency costs explain the (excessive) amounts and (inefficient) forms of CEO compensation. This paper offers a simple empirical test of this claim and the reform proposals that follow from it, by looking at pay practices in firms under financial distress, where agency costs are dramatically reduced. When a firm files for Chapter 11 or privately works out its debt with lenders, sophisticated investors consolidate ownership interests into a few large positions replacing diffuse and disinterested shareholders. These investors, be they banks or vulture investors, effectively control the debtor during the reorganization process. In addition, all …

Report From An Interdisciplinary Case Study On A Public Transit System In Crisis, Kim A. Jones, Robert C. Mock Jr., Sarah T. Cearley

Journal of Public Transportation

This article describes how a public transportation system in a mid-sized southern state was assessed in regard to its adequacy in providing transportation services. The article begins by discussing the trends in current transportation patterns, funding of public transit, and special populations served by public transit. A case study is then presented of a transit system that was experiencing what has become a typical problem for similar transit systems across the nation: intensified public and political pressures caused by funding cuts and unfunded mandates from the federal government. Findings from the case study are then provided along with recommendations for …

Many rural communities have experienced population growth during the past decade. Are they satisfied with the services provided? Are they planning to move from their community next year?

This report details 2,482 responses to the 2006 Nebraska Rural Poll, the eleventh annual effort to understand rural Nebraskans’ perceptions. Respondents were asked a series of questions about their community. Trends for some of these questions are examined by comparing data from the ten …
