Perceptions of health and illness vary depending on culture, tradition, history, ethnicity and identity. As cultures change and construct their stories, the practices and belief systems surrounding health also shift, develop and are expressed in different ways. With these patterns in mind, the purpose of this essay is to examine the traditional medicine of the Mapuche people of southern Argentina and focus on how aspects of this medicine have been lost, re-shaped, sustained and recuperated. The indigenous population of Australia faces a life expectancy that is eighteen years lower than the general population. This study addresses this incredible disparity by exploring the historical, cultural and social forces that impact on health status, focussing especially on health care service utilisation. Qualitative methods of interviewing and participant observation have been used to examine the two sectors of Aboriginal health service delivery in urban Victoria: Aboriginal community controlled health organisations (ACCHOs) and mainstream organisations. The Mekong Delta hosts suitable conditions for promoting the widespread dissemination of biogas systems, such as tropical temperatures, high population density, and widespread animal husbandry. The low-cost polyethylene biodigester (BD) is the most common model in the Mekong Delta, although concrete and brick biodigesters have been implemented to a lesser extent. Biogas systems offer a wide range of benefits, such as improving water quality, enhancing integrated farming systems, and meeting rural energy demand while improving public health. In 1997, a large number of agricultural leases in the Fijian sugar belts began to expire without renewal. Stepping away from the debates over who should have access to land under what legislation and for what purpose, this paper concentrates on the people who are being directly affected by lease expiration: the cane farmers and cutters themselves. This paper is principally an analysis of the international observers’ experiences in Olga Isabel and the implications of their continual presence in the community. I begin by explaining my methodology in carrying out this project. I then give a brief history of the Zapatistas, followed by a summary of the present situation in Olga Isabel and its historical and political context. The body of the paper examines the experiences of international observers and the effects of their presence within communities. I conclude by placing my findings in the context of the larger Zapatista movement for indigenous rights and autonomy.

Staying Open: How Restricting Venue In Texas's Judicial Bypass Cases Would Hurt Minors And Violate The Constitution., Shelia Cheaney, Laura Smith

The open venue provision is necessary to protect a minor’s constitutional right to have an abortion. Under the open venue provision, a minor may petition from any county in Texas for a judicial bypass to keep her abortion private. Proposed legislation, such as Texas House Bill 1212, threatens that right by restricting a minor from obtaining a judicial bypass only from the county of her residence. In Planned Parenthood of Central Missouri v. Danforth, the United States Supreme Court held it was constitutional for states to require a minor to obtain parental consent in order to obtain an abortion. Bellotti …

How should agencies and legislatures evaluate possible policies to mitigate the impacts of earthquakes, floods, hurricanes and other natural hazards? In particular, should governmental bodies adopt the sorts of policy-analytic and risk assessment techniques that are widely used in the area of environmental hazards (chemical toxins and radiation)? Environmental hazards policy analysis regularly employs proxy tests, in particular tests of technological "feasibility," rather than focusing on a policy's impact on well-being. When a disaster strikes the United States, Congress typically feels heavy pressure to enact legislation, including tax legislation, to provide relief. This Article discusses features of two tax legislative initiatives, which responded to two quite different disasters: first, the response to the devastation of the fall 2005 hurricane season and, then, the response to the earlier terrorist attacks on the World Trade Center and Pentagon of September 11, 2001. The Article first raises the possibility that some of the provisions of these acts may be vulnerable to indirect constitutional challenge under the Uniformity Clause. Did Nepa Drown New Orleans? The Levees, The Blame Game, And The Hazards Of Hindsight, Douglas A. Kysar, Thomas O. Mcgarity

This Article highlights the. hazards of hindsight analysis of the causes of catastrophic events, focusing on theories of why the New Orleans levees failed during Hurricane Katrina in 2005 and particularly on the theory that the levee failures were "caused" by a 1977 National Environmental Policy Act (NEPA) lawsuit that resulted in a temporary injunction against the Army Corps of Engineers' hurricane protection project for New Orleans. Horizontal Political Externalities: The Supply And Demand Of Disaster Management, Ben Depoorter

This Article discusses the dynamics of shared political accountability and provides a supply- and demand-side analysis of disaster management. Because multiple levels of government share political accountability in national scale disasters, disaster management is subject to a collective action problem. Introducing the concept of horizontal political externalities, this Article explains the shortcomings of disaster management in terms of asymmetric political accountability costs for ex ante preparedness and ex post relief. In the presence of shared accountability, investments in prevention and relief by one government actor confer positive externalities upon other government actors by reducing the overall chance of being held …

Courts and scholars have largely overlooked the constitutional source and scope of a state executive's powers to avert and respond to crises. This Article addresses how actual and perceived legal barriers to executive authority under state constitutions can have major consequences beyond a state's borders during times of crisis. It proposes to empower state executives to address federal and regional goals without any previous authorization from the state legislature-a presumption of state executive lawmaking, subject to state legislative override, which would give a state or local executive expansive lawmaking authority within its system of government to address national and regional …

Law school seminars sometimes educate the professor as much as the students. That proved true for me in the spring of 2004, when seventeen law students and two colleagues from other departments joined me for a seminar focused on ancient and contemporary perspectives on law found within various Christian theological traditions. One seminar student who repeatedly spurred my own thinking was Jason Carter. Particularly thought provoking was the paper Jason presented in the final weeks of the seminar.

The returns from the 2004 election suggested that Jason had been unusually prescient in his analysis of U.S. religious and political trends. …

Distance Education: Perceived Barriers And Opportunities Related To Extension Program Delivery, Darrell A. Dromgoole, Chris T. Boleman

A Delphi study was conducted to determine obstacles, advantages, and potential topics that could be developed related to distance education as perceived by Extension educators. Respondents suggested that clientele connectivity, clientele lack of technology, and lack of competencies associated with technologies were major obstacles for distance education utilization. Respondents identified savings in travel time and travel expenses, reaching new audiences, and opportunities for multiple delivery systems as major advantages of distance education. Respondents said programs focused on lawn, ornamental, household gardening; general horticulture; and pesticide usage were highly valued and could be successful with clientele.

he correspondence of William James has come a long way since his ·1 son, Henry James, published the two-volume set The Letters of William James in 1920.1 The recently completed Skrupskelis Berkeley edition boasts twelve bulky tomes, all carrying the seal of the Committee on Scholarly Editions of the Modern Language Association. The first three volumes cover the correspondence between William and his brother Henry, whereas the remaining nine volumes contain the correspondence with others, arranged chronologically. This report provides information and analysis on the current ballast water regulations at international, federal, regional and state levels; ballast water discharge trends in Oregon; the shipping industry’s compliance with Oregon law; and current and emerging issues affecting Oregon’s ballast water legislation. Cerebral palsy is the most common cause of severe physical disability in childhood. Spasticity is a common and disabling symptom for many patients with cerebral palsy. Therapy for spasticity is symptomatic with the aim of increasing functional capacity and relieving discomfort. Spasticity treatment by orally administered drugs and intramuscular chemodenervation agents has become more frequent. Most oral medications to treat spasticity have been inadequately studied in children, especially those with cerebral palsy.
