Use It Or Pretenders Will Abuse It: The Importance Of Archival Legal Information, Theodore Eisenberg

Archival information about the legal system should inform policymaking. Despite claims of soaring civil damages awards, modem historical data show no to little growth in tort awards and no real growth in punitive damages awards. The data also show a dramatic forty-year decline in trial rates from more than ten percent of case dispositions to less than two percent. The decline needs to be explained in part by using archival data. Contrary to perceptions underlying the Class Action Fairness Act of 2005, little systematic evidence exists that state and federal courts process class actions significantly different. Fiduciary Foundations Of Administrative Law, Evan J. Criddle

An enduring challenge for administrative law is the tension between the ideal of democratic policymaking and the ubiquity of bureaucratic discretion. This Article seeks to reframe the problem of agency discretion by outlining an interpretivist model of administrative law based on the concept of fiduciary obligation in private legal relations such as agency, trust, and corporation. Administrative law, like private fiduciary law, increasingly relies upon a tripartite framework of entrustment, residual control, and fiduciary duty to demarcate a domain of bounded agency discretion. Therapeutic Forgetting: The Legal And Ethical Implications Of Memory Dampening, Adam J. Kolber

Neuroscientists have made significant advances in identifying drugs to dampen the intensity of traumatic memories. Such drugs hold promise for victims of terrorism, military conflict, assault, car accidents, and natural disasters who might otherwise suffer for many years from intense, painful memories. In 2003, the President's Council on Bioethics released a report, entitled Beyond Therapy: Biotechnology and the Pursuit of Happiness, which analyzed memory dampening in some detail. While the Council acknowledged the potential benefits of memory dampening, some Council members were concerned that it may: (1) discourage us from authentically coping with trauma, (2) tamper with personal identity, (3) …

Conscripting Attorneys To Battle Corporate Fraud Without Shields Or Armor? Reconsidering Retaliatory Discharge In Light Of Sarbanes-Oxley, Kim T. Vu

Michigan Law Review

This Note advocates that federal courts should allow attorneys to bring retaliatory discharge claims under SOX. Traditional rationales prohibiting the claims of retaliatory discharge by attorneys do not apply in the context of Sarbanes-Oxley. This Note contends that the Department of Labor and the federal courts should interpret the whistleblower provisions of § 806 as protecting attorneys who report under § 307. Assuring reporting attorneys that they have protection from retaliation will encourage them to whistleblow and thereby advance SOX's policy goal of ferreting out corporate fraud. Supraspinal Fatigue Does Not Explain The Sex Difference In Muscle Fatigue Of Maximal Contractions, Sandra K. Hunter, Jane E. Butler, Gabrielle Todd, Simon C. Gandevia, Janet L. Taylor

Exercise Science Faculty Research and Publications

Young women are less fatigable than young men for maximal and submaximal contractions, but the contribution of supraspinal fatigue to the sex difference is not known. This study used cortical stimulation to compare the magnitude of supraspinal fatigue during sustained isometric maximal voluntary contractions (MVCs) performed with the elbow flexor muscles of young men and women. Eight women (25.6 ± 3.6 yr, mean ± SD) and 9 men (25.4 ± 3.8 yr) performed six sustained MVCs (22-s duration each, separated by 10 s). Probing The Reaction Mechanism Of The D-Ala-D-Ala Dipeptidase, Vanx, By Using Stopped-Flow Kinetic And Rapid-Freeze Quench Epr Studies On The Co(Ii)-Substituted Enzyme, Megan L. Matthews, Gopalraj Periyannan, Christine E. Hajdin, Tara K. Sidgel, Brian Bennett, Michael W. Crowder

In an effort to probe the reaction mechanism of VanX, the D-ala-D-ala dipeptidase required for high-level vancomycin resistance in bacteria, stopped-flow kinetic and rapid-freeze quench EPR studies were conducted on the Co(II)-substituted enzyme when reacted with d-ala-d-ala. The intensity of the Co(II) ligand field band at 550 nm decreased (ε550 = 140 to 18 M-1 cm-1) when VanX was reacted with substrate, suggesting that the coordination number of the metal increases from 5 to 6 upon substrate binding. In July 2006 the Senate passed the Stem Cell Research Enhancement Act.1 The House of Representatives had passed the bill, referred to as H.R. 810, in May 2005. The day after the Senate vote, President Bush vetoed the legislation. It was the first time he exercised the veto power in almost six years in office. That day, the House voted to override the veto. The vote was 235 to 193, less than the two-thirds majority needed to set aside a presidential veto.

The purpose of this issue is to promote a dialogue between the family law academic community and stakeholders in the family law system about how future family lawyers should be educated. Family law practice has undergone dramatic change in the last quarter century, perhaps more than any other area of practice. Virtually everything about it has changed—the role of the family court, the procedure for resolving family disputes, the role of the family lawyer, and the substantive law. Neck Recurrence In Early Carcinoma Tongue, Mubasher Ikram, Sadaf Fatima Jafferbhoy, Maisam Abbas Shiraz Onali

Objective: To study the efficacy of different locoregional treatment options for tongue cancer in determining the prognosis, with reference to recurrence of disease in neck.

Methods: This is a retrospective analysis of 80 patients with early (T1/T2) carcinoma tongue who had hemiglossectomy with or without neck surgery and radiotherapy for 14 years.

Results: Eighty patients were included in this study, 49 (61.3%) men and 31 (38.8%) women; 36 (45%) patients with T1 lesion and 44 (55%) with T2 lesion. Sixty two patients (77.5%) were staged cN0 and 18 patients had a clinically palpable neck nodes (cN+). Thirty seven patients were …

The value of screening for cervical cancer has been proven; as such screening has resulted in a decrease in incidence and mortality of cervical cancer by over 80% in developed countries . Yet despite a screening infrastructure, cervical cancer is the most common female malignancy in South Africa , affecting 1 in ever 41 women. It is estimated that more than 3,400 South African women die of cervical cancer every year . The objective of this study was to learn about the resources available to a diabetic and the actual ability of diabetics to access these resources. I found that two ideal paradigms of care were consistently mentioned by experts in KwaZulu Natal and at the World Diabetes Congress (WDC), the international conference on diabetes that I attended in Cape Town. The first is self-management of the disease and a patient centered approach to care. The presence of the tsetse fly has historically been an obstacle to the utilization of the resources of the Okavango Delta and the rest of Northern Botswana. In the late 1990’s, an outbreak of trypanosomiasis in cattle, the disease carried by tsetse, prompted the government of Botswana to implement an aerial spraying operation to eradicate the flies. The broad spectrum pesticide deltamethrin was applied over three months in a Northern block of the delta in 2001 and a southern block in 2002. Post-spray monitoring, carried out by the Henry Oppenheimer Okavango Research Center (HOORC), showed that although the pesticide did …

This study was conducted to determine the effects of the erection of the Makgadikgadi wildlife fence along the western border of the Makgadikgadi Pans National Park on cattle populations and livestock owners to the west of the fence. Cattle foraging behavior and movement patterns were recorded using GPS and focal observation methods to determine resource use and pressures affecting the populations. Interviews were also conducted in the area of Meno-a-Kwena camp to examine the effects of the fence on the economics of the local cattle industry. I spent approximately one month researching the relation of Projecto Promotoras Legais Populares (PPLP) with its Subjects, Promotoras Legais Populares (PLP). It is a course aimed to foster political growth amongst marginalize groups in society through the exploration of their Rights. I explored the methodology used by PPLP in order to address the local needs of its Subjects --mainly black women with a poor/working-class background. How did this methodology facilitate the creation of a political space where they can voice these needs?
