United States V. Scrushy And Its Impact On Criminal Prosecutions Under The Certification Requirements Of Sarbanes-Oxley, Walter Trey Stock
Texas Wesleyan Law Review
This Note is divided into three parts. Part I will discuss the Sarbanes-Oxley Act itself, including an overview of the political firestorm that motivated its enactment. Part I will also detail the Act's certification requirement and the penalties for noncompliance. And, finally, Part I will set the stage for United States v. Scrushy by detailing the considerable success the Department of Justice had realized in prosecuting white-collar criminals leading up to Scrushy. Part II will discuss the background of HealthSouth and Richard Scrushy. It will illustrate the government's case against Scrushy and how the government believed the HealthSouth scam was …

Why The Fight Against Poverty Is Failing: A Contrarian View, Knowledge@Smu

Abraham George is the founder of The George Foundation, an NGO engaged in humanitarian work in India, and the author of India Untouched: The Forgotten Face of Rural Poverty. In this contrarian essay, he explores why the current strategies that governments and development agencies are employing to reduce poverty are not working the way they should. Among his arguments: Microcredit programs, as they are now practiced in India, do little to help the poor.

Expanded School-Based Health: The Mental Health And School Connection, Dr. Jill D. Duba

Research suggests that expanded school-based mental health (ESMH) programs can offer benefits and hope for children and their families. Such programs are part of a national progressive movement involving collaborative relationships between schools and community mental health agencies. The purpose of this article is to highlight the constructs and details of ESMH programs, as well as counselor training possibilities.

Integrative Multilevel Family Therapy For Disputes Involving Child Custody And Visitation (Imft-Dccv): An Interview With Jay Lebow, Dr. Jill D. Duba

This article presents the integrative multi-level family therapy of Jay Lebow, focusing on his work in resolving disputes involving child custody and visitation. The interview addresses interventions in high conflict divorces, assessment issues, and symmetrical escalation. A case study is offered.

Beyond Unconscionability: Class Action Waivers And Mandatory Arbitration Agreements, J. Maria Glover

We live in an age of convenience. From financial transactions to electronic correspondence, we frequently deal with large corporations that provide services in our daily lives. One of the prices we pay for the convenience of these transactions, however, is that our commercial relationships increasingly are based on standard form contracts written by large corporations. While these standard form contracts are necessary to an economically efficient society, the growing use of mandatory arbitration provisions and clauses that prohibit class actions in these contracts raises the spectre of corporate abuse.
