Light-Rail In Louisville: Assessing The Financial Feasibility Of Mass Transit, Brian K. Howell Jan 2006

Light-Rail In Louisville: Assessing The Financial Feasibility Of Mass Transit, Brian K. Howell

MPA/MPP/MPFM Capstone Projects

The Louisville-Jefferson County area encompasses a vast area and large population of citizens. To meet the transportation needs of this growing city, the Transit Authority of River City or TARC undertook a study in 1996 to determine potential transportation solutions to traffic congestion in the area. Based on their analysis, TARC determined that a 15-mile light rail transit system would best service their needs. This light rail system would run from the downtown central business district to a park-and-ride facility at the Gene Snyder Freeway.

Prior to undertaking this project, TARC and all those parties involved should ask the fundamental …

Forty Years Of Codification Of Estates And Trusts Law: Lessons For The Next Generation, Mary Louise Fellows, Gregory S. Alexander Jan 2006

Forty Years Of Codification Of Estates And Trusts Law: Lessons For The Next Generation, Mary Louise Fellows, Gregory S. Alexander

Georgia Law Review

As others in this symposium have stated, Richard V. Wellman devoted his professional life to promoting legislation to make the law of estates and trusts responsive to the needs of a state's citizenry. As he saw it, his goal to make the law of donative transfers simpler, fairer, and less expensive depended upon new legislative proposals accompanied by a range of strategies to educate the bar and policymakers about them. Over the years, Dick's faith in statutory lawmaking only grew, because estate planning experts and legislators lauded the benefits achieved through enactment of the uniform laws he either drafted or …

Gene Expression And Discovery During Lens Regeneration In Mouse: Regulation Of Epithelial To Mesenchymal Transition And Lens Differentiation, Mario Medvedovic, Craig R. Tomlinson, Mindy Kay Call, Matthew Grogg, Panagiotis A. Tsonis Jan 2006

Tsonis

Biology Faculty Publications

Purpose: It has been shown that after extracapsular lens removal by anterior capsulotomy in the mouse, the lens can be regenerated. However, as the capsular bag is filled with fibers, epithelial to mesenchymal transition (EMT), an event which is common after cataract surgery as well, takes place during early stages. This study, using a unique mouse model, was undertaken to identify novel regulators and networks in order to more clearly understand secondary cataracts at the molecular level.

Asian Americans On The Streets: Strategies For Prevention And Intervention, James Diego Vigil, Tomson H. Nguyen, Jesse Cheng Jan 2006

Asian Americans On The Streets: Strategies For Prevention And Intervention, James Diego Vigil, Tomson H. Nguyen, Jesse Cheng

Social and Cultural Sciences Faculty Research and Publications

Notably lacking in the literature on Vietnamese and Cambodian youth gangs in the United States and particularly Southern California have been solutions that address the underlying causative factors of gang involvement. Relying on life histories collected over a span of fifteen years, the authors propose a multi-faceted prevention and intervention strategy that includes the community and schools to heighten cultural awareness for children and parents. It is also recommended that policies take into account nuanced differences between Asian communities and bring together multiple stakeholders including officials and hard-core gang members to improve communicative problems that have resulted in gang-policy failures.

"Particular Intentions": The Hillmon Case And The Supreme Court, Marianne Wesson Jan 2006

"Particular Intentions": The Hillmon Case And The Supreme Court, Marianne Wesson

Publications

The case of Mutual Life Insurance Company v. Hillmon is one of the most influential decisions in the law of evidence. Decided by the Supreme Court in 1892, it invented an exception to the hearsay rule for statements encompassing the intentions of the declarant. But this exception seems not to rest on any plausible theory of the categorical reliability of such statements. This article suggests that the case turned instead on the Court's attachment to a particular narrative about the events that gave rise to the case, events that produced a corpse of disputed identity. The author's investigations into newspaper …

A Digital Age Communications Act Paradigm For Federal-State Relations, Kyle D. Dixon, Philip J. Weiser Jan 2006

A Digital Age Communications Act Paradigm For Federal-State Relations, Kyle D. Dixon, Philip J. Weiser

Publications

This article captures the effort of the Digital Age Communications Act (DACA) to craft a new framework for the federal-state relationship in implementing a next generation telecommunications regulatory regime. In particular, it sets forth a DACA model that would implement a "rule of law" regulatory paradigm for an era of technological dynamism. This era requires, as the article explains, a coherent federal framework that circumscribes the role of state and local authorities so as to advance sound competition policy goals. The sole exception to this policy is the recognition that a basic local service rate retains both political and practical …

The Effect Of Variability In Substance Abuse And Dependence Terminology On Physicians' Prescribing Decisions, Lisa Rochelle Burroughs Phipps Jan 2006

The Effect Of Variability In Substance Abuse And Dependence Terminology On Physicians' Prescribing Decisions, Lisa Rochelle Burroughs Phipps

Theses and Dissertations

Prescription drug abuse is a continuing problem in the United States. Educating physicians on issues related to prescription drug abuse is a key factor in preventing and treating this problem. High variability has been found in substance abuse terminology in the literature, textbooks, and FDA-approved product labeling. This dissertation describes a survey study designed to address how the variability in substance abuse terminology, specifically package inserts, affects the prescribing decisions made by physicians.A random sample of 1008 physicians currently licensed and residing in the Commonwealth of Virginia received a letter of explanation, a self-administered questionnaire, and a follow-up reminder and …

The Power Of Journaling: A Dynamic Tool For Evaluating Student Teacher Adjustment In Cross-Cultural Contexts, Brenda B. Mackay Jan 2006

The Power Of Journaling: A Dynamic Tool For Evaluating Student Teacher Adjustment In Cross-Cultural Contexts, Brenda B. Mackay

International Christian Community of Teacher Educators Journal

Journaling is an acceptable pedagogical and assessment tool used to help leverage a university student teacher’s emotional and spiritual growth in a 10 week cross-cultural student teaching experience. The process requires students to document their life and learning experiences.

Questions are designed for student response. Student teachers are encouraged to draw personal connections between their lives and new experiences. This article will show how journaling helped four student teachers process what Kelly and Meyers (1995) identify as the four components of cross-cultural adaptability: (1) emotional resilience, (2) flexibility/openness, (3) perceptual acuity and (4) personal autonomy. Excerpts from the personal journals …

Special Education As Spiritual Warfare, David Anderson Jan 2006

Special Education As Spiritual Warfare, David Anderson

International Christian Community of Teacher Educators Journal

This article reflects on a theology of exceptionalities and the hermeneutics of special education, and develops the notion that there is an aspect of special education which can be understood as spiritual warfare. The main thesis is that providing access to an appropriate and least restrictive education for people with disabilities involves “demolishing strongholds” (2 Corinthians 10:4): removing barriers of ignorance, prejudice, stereotype, cultural mythology, and misconception as to disability and the personal worth surrounding individuals who have disabilities. The discussion is situated within the context of Nicholas Wolterstorff”s work on teaching for shalom (2002, 2004). After defining the biblical …

Politiwheels Within Wheels: Some Thoughts About The Industrialization Of American Higher Education, David W. Robinson Jan 2006

Politiwheels Within Wheels: Some Thoughts About The Industrialization Of American Higher Education, David W. Robinson

International Christian Community of Teacher Educators Journal

The following article is a brief introduction to some of my reflections about the industrial nature of contemporary American higher education. In it, I have attempted a summary profile of the character of our civilization, and of the advanced structures of learning it has produced. It is not intended to be anything more than a sketching on vast historical canvas; a much larger study would be required to survey such a topic. Nevertheless, I believe that it will give the reader a sense of our culture, and the context that American colleges and universities occupy. As always in the histories …

Sports Science Roundtable: Does Sports Science Research Influence Practice?, David Bishop, Angus Burnett, Damien Farrow, Tim Gabbett, Robert Newton

Research outputs pre 2011

As sports scientists, we claim to make a signifi cant contribution to the body of knowledge that infl uences athletic practice and performance. Is this the reality? At the inaugural congress of the Australian Association for Exercise and Sports Science, a panel of well-credentialed academic experts with experience in the applied environment debated the question, Does sports-science research influence practice? The fi rst task was to defi ne “sports-science research,” and it was generally agreed that it is concerned with providing evidence that improves sports performance. When practices are equally effective, sports scientists also have a role in identifying practices …

Clustering Spatial Data For Join Operations Using Match-Based Partition, Jitian Xiao Jan 2006

Clustering Spatial Data For Join Operations Using Match-Based Partition, Jitian Xiao

Research outputs pre 2011

The spatial join is an operation that combines two sets of spatial data by their spatial relationships. The cost of spatial join could be very high due to the large sizes of spatial objects and the computation-intensive spatial operations. In spatial join processing, a common method to minimize the I/O cost is to partition the spatial objects into clusters and then schedule the processing of the clusters such that the number of times the same objects to be fetched into memory can be minimized. In this paper, we propose a match-based approach to partition a large spatial data set into …

Agent-Based Similarity-Aware Web Document Pre-Fetching, Jitian Xiao Jan 2006

Agent-Based Similarity-Aware Web Document Pre-Fetching, Jitian Xiao

Research outputs pre 2011

This paper presents an agent-based similarity-aware Web document pre-fetching scheme that is built on the similarity-aware Web caching architecture. A set of agents are employed to carry out certain duties such as document similarity detection, identification of relevant access patterns, document prediction and network traffic monitoring for document pre-fetching. Preliminary simulations have been conducted to evaluate the proposed scheme, and the results have shown that the new pre-fetching scheme outperforms existing Web-document pre-fetching algorithms
