Singing Of Satnam: Blind Simon Patros, "Dalit" Religious Identity, And "Satnami"-Christian Music In Chhattisgarh, India, Chad M. Bauman

Journal of Hindu-Christian Studies

Christianity in every context -- whether western or nonwestern, contemporary or ancient -- emerges as a composite entity, combining elements of the religions and cultures that predate it with aspects of the Christian faith, in whatever form it arrives. There is, of course, nothing distinctly Christian about this process, for just as the expansion of Christianity into India involved the Indianization of Christianity, so too did the growth of Hinduism in Bali entail the Balinization of Hinduism. Other religions follow a similar pattern when they cross cultural boundaries.

Behavioral Genetics And Crime, In Context, Owen D. Jones Jan 2006

Behavioral Genetics And Crime, In Context, Owen D. Jones

Vanderbilt Law School Faculty Publications

This Article provides an introduction to some of the key issues at the intersection of behavioral genetics and crime.

It provides, among other things, an overview of the emerging points of consensus, scientifically, on what behavioral genetics can and cannot tell us about criminal behavior. It also discusses a variety of important implications (as well as complexities) of attempting to use insights of behavioral genetics in legal contexts.

Structural Laws And The Puzzle Of Regulating Behavior, Edward K. Cheng Jan 2006

Structural Laws And The Puzzle Of Regulating Behavior, Edward K. Cheng

Vanderbilt Law School Faculty Publications

This Article offers a new way of thinking about over criminalization. It argues that in regulating behavior, legislatures have relied excessively on statutory prohibitions and ex post enforcement by police and prosecutors. Regulation by "fiat" alone is often inadequate; proscriptive laws need accompanying structural ones that can cabin behavior and help alter existing social norms. After developing a theoretical framework for distinguishing "fiat" from "structure," the Article tackles the puzzling question why legislatures persist in focusing almost exclusively on fiat-based measures despite the availability of more effective structural ones. The answer turns out to be surprisingly complex, ranging from institutional …

Personal Reflections On The Chief, Richard W. Garnett Jan 2006

Personal Reflections On The Chief, Richard W. Garnett

Journal Articles

My favorite William Rehnquist quote is this, from Kansas v. Colorado: “The Arkansas River rises on the east side of the Continental Divide, between Climax and Leadville, Colorado. Thence it flows south and east through Colorado, Kansas, Oklahoma, and Arkansas, emptying into the Mississippi River, which in turn flows into the Gulf of Mexico. As if to prove that the ridge that separates them is indeed the Continental Divide, a short distance away from the source of the Arkansas, the Colorado River rises and thence flows southwest through Colorado, Utah, and Arizona, and finally empties into the Gulf of Baja, …

The Use Of Genomewide Enu Mutagenesis Screens To Unravel Complex Mammalian Traits: Identifying Genes That Regulate Organ-Specific And Systemic Autoimmunity, Gerard F. Hoyne, Christopher C. Goodnow

Health Sciences Papers and Journal Articles

T-cell development is perhaps one of the best understood processes of mammalian cell differentiation, as many of the genes and pathways have been identified. By contrast, relatively little is known about the genes and pathways involved in immunological tolerance to self-antigens. Here, we describe the challenges associated with a genomewide screen designed at identifying new immune regulatory genes that uses a model of organ-specific autoimmunity leading to type 1 diabetes. The successful propagation and identification of the new gene variants will shed light on the various developmental checkpoints in lymphocyte development that are crucial for establishing tolerance to self-antigens.

Predicting Surface Scatter Using A Linear Systems Formulation Of Non-Paraxial Scalar Diffraction, Andrey Krywonos Jan 2006

Predicting Surface Scatter Using A Linear Systems Formulation Of Non-Paraxial Scalar Diffraction, Andrey Krywonos

Electronic Theses and Dissertations

Scattering effects from rough surfaces are non-paraxial diffraction phenomena resulting from random phase variations in the reflected wavefront. The ability to predict these effects is important in a variety of applications including x-ray and EUV imaging, the design of stray light rejection systems, and reflection modeling for rendering realistic scenes and animations of physical objects in computer graphics. Rayleigh-Rice (small perturbation method) and Beckmann-Kirchoff (Kirchhoff approximation) theories are commonly used to predict surface scatter effects. In addition, Harvey and Shack developed a linear systems formulation of surface scatter phenomena in which the scattering behavior is characterized by a surface transfer …

Investigations Of Rhizobium Biofilm Formation, Nancy Fujishige Jan 2006

Investigations Of Rhizobium Biofilm Formation, Nancy Fujishige

Biology Faculty Works

The development of nitrogen-fixing nodules of the Rhizobium-legume symbiosis, especially the early stages of root hair deformation and curling, infection thread formation, and nodule initiation, has been well studied from a genetic standpoint. In contrast, the factors important for the colonization of surfaces by rhizobia, including roots-an important prerequisite for nodule formation-have not been as thoroughly investigated. We developed conditions for analyzing the ability of two fast-growing rhizobia, Sinorhizobium meliloti and Rhizobium leguminosarum bv. viciae, to produce biofilms on abiotic surfaces such as glass, plastic microtiter plates, sand and soil as a prelude to characterizing the genes important for aggregation …

Impaired Glutamate Transport In A Mouse Model Of Tau Pathology In Astrocytes, Deepa V. Dabir Jan 2006

Impaired Glutamate Transport In A Mouse Model Of Tau Pathology In Astrocytes, Deepa V. Dabir

Biology Faculty Works

Filamentous tau inclusions in neurons and glia are neuropathological hallmarks of tauopathies. The discovery of microtubule-associated protein tau gene mutations that are pathogenic for a heterogenous group of neurodegenerative disorders, called frontotemporal dementia and parkinsonism linked to chromosome-17 (FTDP-17), directly implicate tau abnormalities in the onset/progression of disease. Although the role of tau pathology in neurons in disease pathogenesis is well accepted, the contribution of glial pathology is essentially unknown. We recently generated a transgenic (Tg) mouse model of tau pathology in astrocytes by expressing the human tau protein under the control of the glial fibrillary acidic protein (GFAP) promoter. …

Analyzing The Effects Of Vertical Acceleration And Deceleration In Multi-Phase, Debris-Flow Sediment-Column Experiments / By Christine Marie Williams., Christine Marie Williams Jan 2006

Analyzing The Effects Of Vertical Acceleration And Deceleration In Multi-Phase, Debris-Flow Sediment-Column Experiments / By Christine Marie Williams., Christine Marie Williams

Dissertations, Master's Theses and Master's Reports - Open

Water-saturated debris flows are among some of the most destructive mass movements. Their complex nature presents a challenge for quantitative description and modeling. In order to improve understanding of the dynamics of these flows, it is important to seek a simplified dynamic system underlying their behavior. Models currently in use to describe the motion of debris flows employ depth-averaged equations of motion, typically assuming negligible effects from vertical acceleration. However, in many cases debris flows experience significant vertical acceleration as they move across irregular surfaces, and it has been proposed that friction associated with vertical forces and liquefaction merit inclusion …

Found Law, Made Law And Creation: Reconsidering Blackstone's Declaratory Theory, William S. Brewbaker Iii

Articles

The subject of this paper is Blackstones famous declaratory theory of law the claim that judges find the law rather than make it Blackstones claim is widely rejected in the legal academy often because Blackstone is wrongly associated with the brooding omnipresence view of law rejected in cases like Erie Guaranty Trust and Southern Pacific Co v Jensen I argue that Blackstones theory fails for other reasons namely because his account does not square well with law practice as it exists and because his distinction between legislative lawmaking and judicial declaration is ultimately unsustainableDespite its faults Blackstones account of judging …

Labeling Genetically Modified Food: Comparative Law Studies From Consumer's Perspective, Christopher C. H. Chen Jan 2006

Labeling Genetically Modified Food: Comparative Law Studies From Consumer's Perspective, Christopher C. H. Chen

Research Collection Yong Pung How School Of Law

This article focus on the genetically modified food and labelling requirement. The relatively new technology raises some concerns over the safety of food containing genetically modified substance. The "substantial equivalent" doctrine, adopted by the U.S., and the "precautionary" doctrine, taken by the EU, represent two contradictory approaches to reconcile new biotechnology and consumer protection, a difference influenced by politics or food industry rather than by consumer attitudes. In this article, we argue that consumers cannot make their own choices and exercise market power without a certain degree of disclosure of information. However, even though food labelling is an effective way …

Principles Of U.S. Family Law, Vivian E. Hamilton Jan 2006

Principles Of U.S. Family Law, Vivian E. Hamilton

Faculty Publications

What explains U.S. family law? What are the origins of the current chaos and controversy in the field, the home of some of the most vituperative debates in public policy? To answer these questions, this Article identifies and examines family law's foundational principles. It undertakes a conceptual analysis of the legal practices that govern families. This analysis has yet to be done, and its absence hamstrings constructive thought on our family law. The Article develops a typology that conceptualizes U.S. family law and exposes its underlying principles. First, it identifies the significant elements, or rules, of family law. Second, it …

The Roles Of Food And Predation In Shaping Adaptive And Maladaptive Behaviors In Postfire Bird Species, Bruce Andrew Robertson Jan 2006

The Roles Of Food And Predation In Shaping Adaptive And Maladaptive Behaviors In Postfire Bird Species, Bruce Andrew Robertson

Graduate Student Theses, Dissertations, & Professional Papers

Most animals live in rapidly changing environments, and within-individual phenotypic plasticity can allow populations to track sources of selection that often vary dramatically in time and space. However, if conditions change too rapidly, the cues animals use to track environmental changes may become uncoupled from the ultimately important factors with which they have been historically correlated. Animals relying upon proximal cues to guide their behaviors may, in novel environments, consistently make errors. When these errors occur within the context of choosing a habitat, the organism is said to be caught in an ‘ecological trap’. Herein, I develop a conceptual model …

Political Space, Guaranteed: Utilizing New Zealand's 'Reserved Seats' System To Help Aboriginal Canadians Realize Their Guaranteed Democratic Rights, Jennifer Hefler Jan 2006

Political Space, Guaranteed: Utilizing New Zealand's 'Reserved Seats' System To Help Aboriginal Canadians Realize Their Guaranteed Democratic Rights, Jennifer Hefler

Dalhousie Journal of Legal Studies

Despite having formally recognized the distinctiveness and importance of Aboriginal Rights with the enactment of section 35 of the 1982 Constitution, Aboriginal persons continue to be under-represented in Canadian political institutions. This article will argue that the solution to this problem does not lie in section 35. Instead, this article will demonstrate this historic lack of political space constitutes an infringement of rights guaranteed to Aboriginal Canadians under section 3 of the Charter of Rights and Freedom. The most effective method to remedy this breach is through the implementation of a ‘reserved-seat’ system similar to that in New Zealand. This …

Beyond Coercion: Justice Kennedy's Aversion To Animus, Steven Goldberg Jan 2006

Beyond Coercion: Justice Kennedy's Aversion To Animus, Steven Goldberg

Georgetown Law Faculty Publications and Other Works

In evaluating the constitutionality of religious displays, Justice Kennedy adheres to the coercion test. A crèche on the courthouse steps is acceptable because it does not coerce anyone to support or participate in a religious exercise. He rejects the endorsement test, which asks whether the display makes reasonable nonadherents feel like outsiders, finding it to be “flawed in its fundamentals and unworkable in practice.” Yet in the free exercise context, Kennedy has focused on whether a community shows hostility to minority faiths, and his opinions in Romer and Lawrence stress that legislatures acted unconstitutionally in showing animus to gays. Suppose …

Bostrom, Jay, M.A., Autumn 2006 Modern and Classical Languages and Literatures Spanish Minority Language Attitudes in Galicia and Catalonia Chair: Professor Anthony Beltramo Despite legitimate fears of the effects twenty-first century globalization will have on linguistic diversity, vigorous efforts are being made to maintain minority languages in multi-national/ethnic states such as Spain. Catalonia and Galicia have not forgotten the severe treatment they received under the Franco dictatorship that resulted in untold damage to the trajectory of the languages. Even today, thirty-one years later, the negative effects are palpable and alive in the language attitudes of the Catalan and Galician people. …

Smith’S Humean Criticism Of Hume’S Account Of The Origin Of Justice, Spencer J. Pack, Eric Schliesser Jan 2006

Smith’S Humean Criticism Of Hume’S Account Of The Origin Of Justice, Spencer J. Pack, Eric Schliesser

Economics Faculty Publications

Adam Smith criticizes David Hume's account of the origin of and continuing adherence to the rule of law for being not sufficiently Humean. Hume explained that adherence to the rule of law originated in the self-interest to restrain self-interest. According to Smith, Hume does not pay enough attention to the passions of resentment and admiration, which have their source in the imagination. Smith offers a more naturalistic and evolutionary account of the psychological preconditions of the establishment and morality of justice than Hume had. Smith severs the intimate connection that Hobbes and Hume made between justice and property.
