Most animals live in rapidly changing environments, and within-individual phenotypic plasticity can allow populations to track sources of selection that often vary dramatically in time and space. However, if conditions change too rapidly, the cues animals use to track environmental changes may become uncoupled from the ultimately important factors with which they have been historically correlated. Animals relying upon proximal cues to guide their behaviors may, in novel environments, consistently make errors. When these errors occur within the context of choosing a habitat, the organism is said to be caught in an ‘ecological trap’. Herein, I develop a conceptual model …

Political Space, Guaranteed: Utilizing New Zealand's 'Reserved Seats' System To Help Aboriginal Canadians Realize Their Guaranteed Democratic Rights, Jennifer Hefler

Despite having formally recognized the distinctiveness and importance of Aboriginal Rights with the enactment of section 35 of the 1982 Constitution, Aboriginal persons continue to be under-represented in Canadian political institutions. This article will argue that the solution to this problem does not lie in section 35. Instead, this article will demonstrate this historic lack of political space constitutes an infringement of rights guaranteed to Aboriginal Canadians under section 3 of the Charter of Rights and Freedom. Beyond Coercion: Justice Kennedy's Aversion To Animus, Steven Goldberg

In evaluating the constitutionality of religious displays, Justice Kennedy adheres to the coercion test. A crèche on the courthouse steps is acceptable because it does not coerce anyone to support or participate in a religious exercise. He rejects the endorsement test, which asks whether the display makes reasonable nonadherents feel like outsiders, finding it to be “flawed in its fundamentals and unworkable in practice.” Yet in the free exercise context, Kennedy has focused on whether a community shows hostility to minority faiths, and his opinions in Romer and Lawrence stress that legislatures acted unconstitutionally in showing animus to gays. Smith’S Humean Criticism Of Hume’S Account Of The Origin Of Justice, Spencer J. Pack, Eric Schliesser

Adam Smith criticizes David Hume's account of the origin of and continuing adherence to the rule of law for being not sufficiently Humean. Hume explained that adherence to the rule of law originated in the self-interest to restrain self-interest. According to Smith, Hume does not pay enough attention to the passions of resentment and admiration, which have their source in the imagination. Smith offers a more naturalistic and evolutionary account of the psychological preconditions of the establishment and morality of justice than Hume had. Smith severs the intimate connection that Hobbes and Hume made between justice and property.

Coercion And Choice Under The Establishment Clause, Cynthia V. Ward

In recent Establishment Clause cases the Supreme Court has found nondenominational, state-sponsored prayers unconstitutionally "coercive" -although attendance at the events featuring the prayer was not required by the state; religious dissenters were free to choose not to say the challenged prayers; and dissenters who so chose, or who chose not to attend the events, suffered no state-enforced sanction. Part I of this Article lays out the historical background that gave rise to the coercion test, traces the development of that test in the Court's case law, and isolates the core elements in the vision of coercion that animates the test. …

This Essay summarizes and perhaps extends slightly some important recent work, mostly by political scientists, on the structural relation between the array of political power in a nation's nonjudicial branch or branches and the way in which judicial review is exercised in relatively stable democracies. Robert Dahl's classic article identified one such relation. According to Dahl, "[e]xcept for short-lived transitional periods when the old alliance is disintegrating and the new one is struggling to take control of political institutions, the Supreme Court is inevitably a part of the dominant national alliance." The purpose of this paper is to describe the condition of the braincase in stratigraphically early and morphologically primitive plesiosaurs. Information on the braincase of plesiomorphic taxa is important because it establishes the polarity of characters occurring in more derived plesiosaurs. This paper begins with a short review of braincase anatomy in stem-group sauropterygians. Data on braincase morphology of the plesiomorphic plesiosaur genera Thalassiodracon and Eurycleidus are then presented and interpreted via comparison with other plesiosaurs, stemgroup sauropterygians, and stem diapsids (Araeoscelis). Early diapsids are relevant because plesiosaur skulls more closely resemble early diapsids than stem-group sauropterygians in several key …

The purpose of this research was to investigate the in vitro and in vivo anti-angiogenic properties of ceramide isolated from oyster (Crassostrea virginica). Ceramide was isolated from oyster by silicic acid chromatography, purified by alkaline hydrolysis, and analyzed by electrospray ionization mass spectrometry (ESI-MS). In vitro, the activity of ceramide on human hormone-dependent (MCF-7) and hormone-independent (MDA-MB-435s) breast cancer cells was evaluated for cell viability and proliferation, VEGF-induced cell migration and invasion, apoptosis, and autophagy. The activity of ceramide was also evaluated for VEGF-induced human umbilical vein endothelial cells (HUVEC) tube formation. The protein levels of vascular endothelial growth factor …

This Article examines growing congressional interest in a specific legislative check on judicial power: controlling the types of cases judges are empowered to decide by expanding and/or contracting federal subject matter jurisdiction. Congress has recently sought to shape judicial power through a range of proposals that variously enlarge and compress federal subject matter jurisdiction. In 2004, for example, the House of Representatives voted to strip federal courts of jurisdiction over constitutional challenges to the Defense of Marriage Act and the Pledge of the Allegiance. Judicial Activism And Its Critics, Kermit Roosevelt, Richard W. Garnett

"Judicial activism," writes Professor Kermit Roosevelt, of Penn, has been employed as an "excessive and unhelpful" charge--one "essentially empty of content." As a substitute, Roosevelt reviews here the framework for analysis of Supreme Court opinions that receives fuller treatment in his recent book, The Myth of Judicial Activism. Professor Richard W. Garnett, of Notre Dame, is willing to go along with "much, though not all, of" Roosevelt's position. Ultimately, Garnett suggests "that 'judicial activism' might be salvaged, and used as a way of identifying and criticizing decisions...that fail to demonstrate th[e] virtue" of constitutional "humility."

Thirty-five years ago, in his landmark Lemon v. Kurtzman opinion, Chief Justice Warren Burger declared that state actions could "excessive[ly]"—and, therefore, unconstitutionally—"entangle" government and religion, not only by requiring or allowing intrusive monitoring by officials of religious institutions and activities, but also through their "divisive political potential." He worried that government actions burdened with this "potential" pose a "threat to the normal political process and "divert attention from the myriad issues and problems that confront every level of government." A call for combining the strengths of geographic education with environmental education to produce an 'education for sustainability' addresses local problems for sustainable development. A place-based approach encourages civic responsibility among students. Using service-learning to extend education beyond the classroom in this case study connected students with local clients in a watershed-based initiative. Theoretical underpinnings of service-learning for geographic education are discussed, and the case study is viewed from instructor, student, and client perspectives to identify successful outcomes and provide suggestions for those who might adopt service-learning for the first time.

Feather mites (Acari: Astigmata) have been reported to be parasitic, commensal, and even mutualis-tic on the birds that serve as their hosts. We investigated whether there was a relationship between number of feather mites (Pteronyssoides obscurus (Berlese, 1885)) on the wing and daily survival of cliff swallows (Petrochelidon pyrrhonota (Vieillot, 1817)) during the breeding season at 12 nesting colonies in Nebraska in 2005. Survival of birds with known mite loads was monitored by mark–recapture, and survival models with and without a linear effect of mites were compared with the program MARK.
