A Model Of Rights, Nicholas Shunda Oct 2005

A Model Of Rights, Nicholas Shunda

Economics Working Papers

In this paper, we develop a simple model of the rights a government provides its citizenry. Rights are treated as public goods and taken as primitives in agents utility functions; each agent has preferences over the entire policy vector. We model the interaction among citi-zens and the government as a game in which an exogenous lobbying set makes contributions to the government to in uence policy formu-lation in the matter of rights. When examining contribution schedules comprising truthful Nash strategies, we find that members of the lob-bying set obtain rights closer to their most-preferred bundle, while the rights of non-lobbyers …

Remarks On Risk-Sensitive Control Problems, José Luis Menaldi, Maurice Robin

Mathematics Faculty Research Publications

The main purpose of this paper is to investigate the asymptotic behavior of the discounted risk-sensitive control problem for periodic diffusion processes when the discount factor α goes to zero. If uα(θ, x) denotes the optimal cost function, being the risk factor, then it is shown that limα→0αuα(θ, x) = ξ(θ) where ξ(θ) is the average on ]0, θ[ of the optimal cost of the (usual) in nite horizon risk-sensitive control problem.

Some Reflections On The Symposium: Judging, The Classical Legal Paradigm And The Possible Contributions Of Science, Christina E. Wells Oct 2005

Some Reflections On The Symposium: Judging, The Classical Legal Paradigm And The Possible Contributions Of Science, Christina E. Wells

Faculty Publications

One theme running through the many excellent contributions to this symposium involves the myriad influences on judicial decision-making. As Professor Wrightsman notes, Supreme Court Justices' personal characteristics may affect their ability to influence colleagues and, consequently, the outcome of Supreme Court decisions. Professor Ruger observes that judges have both attitudinal and jurisprudential preferences that may change over time, affecting legal outcomes differently as time passes. Professor Sisk similarly notes that judges' personal values and experiences influence their decision-making. These observations are consistent with those of numerous other scholars, who find wide-ranging and diverse influences on the judicial resolution of legal …

Revelations From The Blackmun Papers On The Development Of Death Penalty Law , Martha Dragich

Faculty Publications

Professor Dragich uses the Blackmun papers to augment our understanding of Justice Blackmun's "evolution" on the question of capital punishment. Though the evolution was gradual, she finds that the case of Warren McCleskey seems to have deeply affected Justice Blackmun.

Perceived Competence Of Aging Pilots, Laura M. Stelmach Oct 2005

Perceived Competence Of Aging Pilots, Laura M. Stelmach

Master's Theses - Daytona Beach

This study investigated the relationship between age and the perception of competence of pilots by the traveling public. Scenarios were utilized that depicted an airline captain successfully landing an airplane amidst adverse conditions. Scenarios varied only by the age of the Captain: Young, Old, or Unspecified Age and that the Young and Old scenarios included a photo of the captain. Perceived effectiveness, competence, avoidance, blame, and attribution as depicted by the Captain's performance in the scenario were assessed by 180 participants in three age groups (18-34, 35-55, and 56

Justice Blackmun And The Spirit Of Liberty, Richard C. Reuben Oct 2005

Justice Blackmun And The Spirit Of Liberty, Richard C. Reuben

Faculty Publications

As we see in this symposium, Justice Harry Blackmun is as controversial in death as he was in life. We live in a time of increasing absolutism, where things are either black or white, red or blue, you are either for me or against me, my way or the highway. It is when we are swayed by the sirens of absolutism that we are most likely to make mistakes, for absolutism diminishes our capacity to see nuance, much less to appreciate and account for it in our reasoning. This is a dangerous thing in a court, and in a democracy. …

Advancing Public Interest Practitioner Research Skills In Legal Education, Randy J. Diamond Oct 2005

Advancing Public Interest Practitioner Research Skills In Legal Education, Randy J. Diamond

Faculty Publications

The information revolution has dramatically altered the legal research landscape, expanding the bounds of legal authority. Practitioner research requires more than traditional legal research. It also encompasses factual investigation, non-legal information, interdisciplinary and audience research. Many new lawyers are ill-prepared to research novel and unusual situations, to cope with unwritten laws and local customs, and to meet shifting authority expectations.

Foreword--Reflections On Judging: A Discussion Following The Release Of The Blackmun Papers , Martha Dragich, Christina E. Wells

Faculty Publications

Justice Blackmun's papers were opened to the public on March 4, 2004, the fifth anniversary of his death. Held in the Manuscript Division of the Library of Congress, the collection includes over half a million items, many handwritten by Justice Blackmun. Anyone can read them. For legal scholars, this kind of research can only be described as exhilarating and many of the articles in this symposium draw on research from Justice Blackmun's papers. For the public, the release comes at a time when the interest in judges is particularly acute.

Faculty Publications

This is the third in a series of articles analyzing the current turmoil in federal criminal sentencing and offering suggestions for improvements in the federal sentencing system. The first article, "The Failure of the Federal Sentencing Guidelines: A Structural Analysis," 105 COLUMBIA L. REV. 1315 (2005), analyzed the structural failures of the complex federal sentencing guidelines system, particularly those arising from imbalances among the primary institutional sentencing actors - Congress, the judiciary, the Justice Department, and the U.S. Sentencing Commission. The second, "Beyond BandAids: A Proposal for Reconfiguring Federal Sentencing After Booker," 2005 U. OF CHICAGO LEGAL FORUM 149 (2005), …

The Janus Face Of Brussels: Socialization And Everyday Decision Making In The European Union, Jeffrey Lewis Oct 2005

The Janus Face Of Brussels: Socialization And Everyday Decision Making In The European Union, Jeffrey Lewis

Political Science Faculty Publications

This article examines the European Union's Committee of Permanent Representatives, or COREPER, a group composed of the EU permanent representatives (permreps) and responsible for preparing upcoming ministerial meetings of the Council. As the heart of everyday decision making in the EU, COREPER is a key laboratory to test whether and how national officials become socialized into a Brussels-based collective Culture and what difference this makes for EU negotiations. The key scope conditions for COREPER socialization are high issue density/ intensity and insulation from domestic politics. COREPER also displays a range of socialization mechanisms, including strategic calculation, role playing, and normative …

Working More But Staying Poor, Bradford Mills, Brian Whitacre, Christiana Hilmer Oct 2005

Working More But Staying Poor, Bradford Mills, Brian Whitacre, Christiana Hilmer

Food Assistance

Families living in poverty increasingly contain adults with a strong attachment to the workforce. These families are not, however, the traditional target of public assistance programs. This policy brief high- lights research results from a comprehensive portrait of working families living in poverty, both nationally and in the rural south, using data from the An- nual Demographic Files of the Current Population Survey. Three issues are explored. First, what are the characteristics of working poor families and how have they changed over time? Second, what role does public assistance play in the coping strategies of working families? Third, how can …

Managing Yaupon With Fire And Herbicides In The Texas Post Oak Savannah, Rob B. Mitchell, James C. Cathey, Brad Dabbert, Ron Sosebee, Dale F. Prochaska, Stephanie Dupree Oct 2005

Managing Yaupon With Fire And Herbicides In The Texas Post Oak Savannah, Rob B. Mitchell, James C. Cathey, Brad Dabbert, Ron Sosebee, Dale F. Prochaska, Stephanie Dupree

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The Post Oak Savannah Ecological Region in Texas was once an open grassland savannah maintained by periodic fires. The Post Oak Savannah can support mid- and tall grasses, such as little bluestem, indiangrass, Texas wintergrass, and purpletop. Today, the savannahs have been replaced by oak woodlands with dense yaupon (Ilex vomitoria) understories that limit grass and forb production and species diversity (Fig. 1). Restriction of fires in conjunction with poor grazing management and periodic droughts are often credited for the dense thickets that occur in the Post Oak Savannah.

Yaupon is a native component of the Post Oak …
