The Interpretive Project And The Problem Of Legitimacy, Barbara K. Bucholtz

It is remarkable that the common law remains as vibrant and as vulnerable today as it was in the nineteenth century. Its vibrancy continues to be illuminated by its responsiveness to societal changes; its vulnerability continues to reflect the flip-side of that responsiveness: an inherent indeterminacy. The analysis that follows investigates the feasibility of maintaining the former characteristic while curtailing the latter, and it is limited to the common law in its interpretive capacity. The principal focus of the analysis is, in keeping with the theme of the conference, the common law of contracts. From that perspective, the Article articulates …

It is an unquestionable fact that the economic development and subsistence of nations depend highly on the health and adequate nutritional status of their economically active population. The concern arises in the light of evidence on adult nutritional deficiencies in some social strata of our country. Malnutrition is the pathological state that results from the inadequate consumption of one or more essential nutrients. Clinically it is manifested by biochemical tests and anthropometric indicators, and affects the response of the individual to different processes of disease as well as to the established therapies. Miller et al examine the construction of readership in Ebony, Essence and O, The Oprah magazine, three popular magazines that purport to be a vehicle of identity and awareness for their target audience. Upon evaluation, they found that Ebony and Essence both challenge the hegemonic process with the incorporation of cultural artifacts that call upon collective memory to form reader association.

Attitudes Toward Abortion Among Religious Traditions In The United States: Change Or Continuity?, John P. Hoffmann, Sherrie Mills Johnson

Abortion continues to be a highly contentious issue in the United States, with few signs of abatement. The goal of this paper is to specify how variable positions about abortion across religious traditions have led to differential shifts in attitudes among their members. Based on culturally relevant events, position papers, and other religious media, the guiding hypotheses propose that Evangelicals have become increasingly opposed to abortion for elective reasons; yet changes in attitudes regarding abortion for traumatic reasons are due primarily to cohort shifts. Data from the cumulative General Social Surveys (1972–2002) are used to test the hypotheses. The first …

Post Reformation Ecclesiology And Missiology--From The Radicals To Wesley: Moving Out Of The Shadow Of Luther And Calvin, Woodrow W. Whidden

Whidden’s essay compares the key theological/ecclesiological factors of the Magisterial Reformation tradition with the Radical and Wesleyan ethos and their respective visions of discipleship, theology, ethics, and mission. He then argues that movements which are Arminian in their soteriology; functional, not institutional, in their ecclesiology; and emphasize discipleship (including strict discipline), sanctification, and Gospel ethics are more likely to have a missional bent.

Christian denominations and mission agencies use different structural models for doing world mission. This article discusses four models and the ecclesiological and practical implications of each for Adventist world mission. The current structural model is analyzed and suggestions are made for adjusting it to better fulfill Adventist world mission in the contemporary context.

You Can't Say That!: Enjoining Publication Of Trade Secrets Despite The First Amendment, Brooks W. Taylor

Enjoining publication of trade secrets is certainly restraint of speech, but is it invalid under the First Amendment to the United States Constitution? Different courts have answered that question in different ways. Some courts have applied strict scrutiny and found preliminary injunctions against the publication of trade secrets to be unconstitutional prior restraint of free speech. Most recently, the California Supreme Court, applying intermediate scrutiny, found such an injunction against the re-publication of computer code on the Internet to be a content-neutral restraint not barred by the prior restraint doctrine.

Productivity has been one of the central topics in the field of word-formation in recent decades. Heretofore, productivity has been mainly, if not solely, discussed in formal terms, such as which affixes can be used with which stems, the productivity of rival affixes, etc. Such a formal approach leaves out the speakers’ needs for creating new words. Accounting for speakers’ word-formation needs requires a re-evaluation of the notion of creativity. Preaspiration And Gemination In Central Numic, Dirk Elzinga, John E. Mclaughlin

The Numic (Uto-Aztecan) languages are well known for consonant gradation, which each language shows to some degree. Three consonantal series have been reconstructed for Proto-Numic: Geminating, Nasalizing, and Spirantizing. The Central Numic languages Timbisha, Shoshoni, and Comanche have preserved these three consonantal series and added a fourth, Aspirating. The Aspirating series is historically derived from the Geminating series, but it is synchronically distinct from it. On the basis of verb class behavior in Central Numic, we show that the Central Numic Aspirated series is a straight forward consequence of Proto-Uto-Aztecan stress patterns as reflected in pre-Proto-Central Numic.

This study was designed to gain a greater understanding of the effects cancer has on families while simultaneously developing family therapy interventions that are helpful for families experiencing the crucible of cancer. On the basis of an action research paradigm, the authors designed an intensive case-analysis protocol involving reflective interviewing to learn about the personal perspectives of family members who participate in therapeutic treatment for cancer. An integration of reflective insight by the families, their therapist, and the research team ultimately revealed that cancer families face an ongoing struggle (a) between feelings of isolation and connectedness, (b) to make meaning …

Since its inception in the 1920s, research on marriage relationships has attracted widespread attention within a variety of disciplines and has held a central position in the scientific study of families. However, despite marriage scholarship's long tradition and broad interdisciplinary base, a number of scholars believe that this area of research has reached a crossroads at the beginning of the 21st century.
