The Regulation Of International Coercion, James P. Terry Oct 2005

The Regulation Of International Coercion, James P. Terry

Newport Papers

The most significant discourse about serious threats to U.S. national security in the twenty-first century will likely concern the military capabilities and intentions of non state actors, acting either for themselves, for religious elites, or as surrogates for state sponsors.

Introduction: The Power Of Stories: Gloucester Tales, Susan Ayres Oct 2005

Introduction: The Power Of Stories: Gloucester Tales, Susan Ayres

Texas Wesleyan Law Review

This special symposium issue includes a selection of the almost sixty papers delivered at the conference. As both the number of papers and breadth of topics demonstrate, law and literature is not dead.' Rather, it is alive, kicking, and inspiring scholarly investigation. A general overview of this symposium issue shows all three strands of the law and literature movement. One strand, law in literature, examines legal issues and representations of lawyers that appear in literary works.' Another strand, law as literature, uses the tools of literary theory to analyze judicial decisions and legislative enactments. The third strand, the narrative project, …

The “Extreme Makeover” Effect Of Law School: Students Being Transformed By Stories, Cassandra Sharp Oct 2005

The “Extreme Makeover” Effect Of Law School: Students Being Transformed By Stories, Cassandra Sharp

Texas Wesleyan Law Review

The relationship between law and popular culture has caused great interest among scholars over the years. It is a field that invites the merging of disciplinary boundaries and allows for plurality in the ways that law can be viewed. This paper seeks to view this relationship from the vantage point of the first-year law student and to explore the representation and transformation of meaning about law and lawyering within the social and academic context of law school. Situated within the expanding scholarship on law and popular culture, this paper examines how the image of the lawyer is constructed and interpreted …

Touristic Transcendence And Post Modern Flitting: An Exploration Of The Experiences Of Second Home Owners, Deirdre Quinn, Darach Turley Oct 2005

Touristic Transcendence And Post Modern Flitting: An Exploration Of The Experiences Of Second Home Owners, Deirdre Quinn, Darach Turley

Articles

The focus of this article is the experience of the tourist as s/he moves between ordinary everyday non-tourist life and tourist life in the current postmodern consumption context.

A comprehensive review of the existing literature on second home consumption is presented. There is some emphasis on how it is practised by the Irish second home owner. This is a group that has been identified as being relatively under-researched in a consumer behaviour context; it is a group thst is affluent, growing and heterogeneous (Mottiar and Quinn 2003).

The vacation home is a complex issue within tourism being viewed as 'a …

The Failure Of The International Laws Of War And The Role Of Art And Story-Telling As A Self-Help Remedy For Restorative Justice, Susan Tiefenbrun Oct 2005

The Failure Of The International Laws Of War And The Role Of Art And Story-Telling As A Self-Help Remedy For Restorative Justice, Susan Tiefenbrun

Texas Wesleyan Law Review

This Article asks several questions that seem particularly relevant in view of the current state of war that our peace-loving society is engaged in today. What is the role of the laws and customs of war if the warriors don't play by the rules? What is the role of art and music during and after the commission of atrocities? Can art prevent further atrocities, assuage victims of catastrophic events, inspire the collective conscience of perpetrators, and protect victims from the reality of pain caused by war and the violations of the international laws of armed combat? Can a book or …

When Literature Becomes Law: An Example From Ancient Greece, Mark J. Sundahl Oct 2005

When Literature Becomes Law: An Example From Ancient Greece, Mark J. Sundahl

Texas Wesleyan Law Review

After a brief introduction to Solon and the Testamentary Law in the next section, Part III of this paper will examine the origin of the phrase "under the influence of a woman" by tracing the evolution of the concept of the "persuasive woman" in the poems of Homer and Hesiod. Part IV will then show that the mythological models of the female enchantress contained in these poems gave rise to a cultural fear of the "persuasive woman" in Greece, which was reflected both in the Testamentary Law as well as in the courtroom speeches of classical Athens. The final part …

Stories Of The Code, Allen Kamp Oct 2005

Stories Of The Code, Allen Kamp

Texas Wesleyan Law Review

My article is a story about the stories of the Uniform Commercial Code, those told by its drafters and its detractors, especially how it was sold to those it would affect and those who had the power to enact it or not. I think it is an interesting story that not only tells us something about the development of a commercial statute, but also gives insights into the values of the legal and the commercial world in the Twentieth Century.

Christian Creativity In A Post-Christian Ethos, Quentin Faulkner Oct 2005

Christian Creativity In A Post-Christian Ethos, Quentin Faulkner

Glenn Korff School of Music: Faculty Publications

The ideas I want to explore in this essay begin with the experience of some works of art that have recently been created for St. Mark’s-on-the-Campus Episcopal Church in Lincoln, Nebraska, the church of which I’m a member. All of the art you will experience has been created by active and faithful members of this church. Let me hasten to say that although I’ve been involved in various ways in fostering this art, I’m in no way responsible for it. That responsibility lies primarily with an insightful priest, Father Donald Hanway, who has vigorously championed the cause of the arts …

"Finis Origine Pendet” – Enhancing Later Learning And Professional Socialization Through An Introductory Dpt Course, Kyle P. Meyer, Patricia A. Hageman, Robert H. Fuchs, Amy E. Tyler, Gregory M. Karst

Internet Journal of Allied Health Sciences and Practice

Background and Purpose: In developing a new Doctor of Physical Therapy (DPT) curriculum, the faculty at a mid-west academic health sciences center decided to introduce course content historically placed near the end of the program’s Master of Physical Therapy curriculum at the beginning of the DPT curriculum. The new DPT curriculum was constructed to promote the value of three central themes; 1) evidence-based practice and 2) patient-centered care, both of which contribute to 3) sound clinical decision making. Faculty theorized that by explicitly expressing these themes in a first semester, introductory course, students would acquire a much needed framework for …

A Review Of The Pathophysiology Of Psychological Disorders In Persons With Parkinson’S Disease, Neil Kenney, Efrain Gonzalez Oct 2005

A Review Of The Pathophysiology Of Psychological Disorders In Persons With Parkinson’S Disease, Neil Kenney, Efrain Gonzalez

Internet Journal of Allied Health Sciences and Practice

An understanding of the physiological etiologies of psychological disturbance continues to evolve as an essential component of training and practice for healthcare providers. The epidemiology of psychological disorders in persons with Parkinson’s disease (PD) is reviewed. The anatomy of the basal ganglia, etiology of PD, and pathophysiological bases for depression, anxiety, dementia, apathy, psychosis and delusions in persons with PD are then discussed. In consideration of the strong biological and environmental bases of psychopathology in persons with PD, it is proposed that a biopsychosocial model be considered for optimal delivery of interdisciplinary care to this population.

Fiber Comb Filters Based On Uv-Writing Bragg Gratings In Graded-Index Multimode Fibers, Yi Liu, John W.Y. Lit, Xijia Gu, Li Wei

Physics and Computer Science Faculty Publications

We report a new kind of comb filters based on fiber Bragg gratings in graded-index multimode fibers. It produces two groups of spectra with a total of 36 reflection peaks that correspond to 18 principal modes and cross coupled modes. The mode indices and wavelength spacings have been investigated theoretically and experimentally. This kind of comb filters may be used to construct multi-wavelength light sources for sensing, optical communications, and instrumentations.
