This case involves allegations regarding fraudulent use of a credit card and identity theft. Appellant Michael Jezdik (“Jezdik”) and the victim in this case, Anna Behran (“Behran”), met in Las Vegas in early 1997. They enjoyed a brief romantic relationship but soon parted ways. Approximately three years later, however, Jezdik and Behran rekindled their friendship. Behran told Jezdik that she wanted to purchase a home but did not know how to do so. Jezdik offered to help Behran complete an online mortgage application at his residence. Behran agreed. The Nevada Supreme Court affirmed the district court’s holding that the purposes behind the exceptions to the one-action rule found in NRS 40.430 are to allow a sold-out junior lienholder recovery in certain situations. In particular, where the property has been automatically stayed pursuant to the bankruptcy code, the creditor is exempted from the one-action rule. Additionally, NRS 40.430(4)(j) allows a junior lienholder that is sold-out to proceed personally against the debtor instead of making futile attempts against the property. The exceptions are limited by the fact that the junior lienholder cannot have purchased the property.

Troy Anthony Foster, appellant, was charged with four counts of sexual assault and one count of kidnapping. A jury found Foster guilty of three counts of sexual assault and acquitted him on one count of sexual assault and of kidnapping. Foster appealed his conviction asserting five assignments of error. The Nevada Supreme Court rejected Foster’s contentions concluding in part the evidence presented at trial was more than sufficient to sustain the jury’s verdict. Foster then filed a post-conviction petition for a writ of habeas corpus in district court, claiming ineffective assistance of both trial and appellate counsel. The district court …

Vestin Funds sought compensation on a loan from the guarantors of the loan Frederick Waid and M. Nafees. Waid and Nafees retained Noel Gage as their attorney. Gage, however, had previously represented the CEO of Vestin in previous litigation. Nevada prohibits a lawyer from representing a party that is adverse to the interests the lawyer’s current client if the matters are substantially related. To determine “substantially related” the court adopted a three-part test from the Seventh Circuit and applied it to Gage. The court upheld the decision of the lower court.

In November 2003 the Las Vegas Metropolitan Police Department executed a decoy operation targeting the crime of robbery. An officer was posed on a public street dressed as an intoxicated, off-duty casino dealer with a stack of twenty one-dollar bills visible in his left dress shirt pocket. The defendant approached the officer, made conversation and casually removed the dollar bills while placing his arm around the officer. When the officer acted as though he was turning his head to catch the defendant in the act, the defendant pushed the officer’s head away with his forearm twice. The defendant was arrested …

This Article examines whether the "fail-safe" triennial exemption provision of the DMCA is effective for its intended purpose: to serve as a countermeasure to the DMCA's anti-circumvention provisions by protecting the ability of the public to engage in non-infringing uses of copyrighted works. Ultimately, this Article concludes that there are too many faults in both the structure and the execution of the rule-making provision to meaningfully counteract the adverse effects of the anti-circumvention provisions of the DMCA. Specifically, the rule-making procedure explicitly prohibits exemptions to a class based on the use of the work. This amounts to a rejection of …

Reducing Eating Disorder Risk Factors In Sorority Members: A Randomized Trial, Carolyn Becker, Lisa M. Smith, Anna C. Ciao

Although sororities are often perceived as contributing to eating disordered behavior, limited research has investigated eating disorders in sorority members. The purpose of this study was to investigate the utility of a highly interactive cognitive dissonance prevention program in reducing empirically supported risk factors in sorority members. Members (N=149) were randomized to the highly interactive intervention, a more passive intervention, or wait-list. Results indicated that both interventions reduced dietary restraint, body dissatisfaction, and eating disorder pathology. Only the highly interactive group reduced thin-ideal internalization as compared to waitlist. Exploratory analyses also indicated that interventions were beneficial to both …

Issue-Related Learning In A Gubernatorial Campaign : A Panel Study., Stephen C. Craig, James G. Kane, Jason Gainous

This study is based on data from a three-wave telephone panel survey conducted during the 1998 governor's race in Florida. The evidence suggests that a considerable amount of issue-related learning (having to do with candidate policy stands and group endorsements) took place over the course of the general election campaign, though substantial differences were observed from one issue area to the next. Further analysis indicates that learning was especially likely to occur among voters who (a) were more knowledgeable about political affairs to start with(confirming that the so-called "knowledge gap" may be exacerbated during campaigns); (b)scored high on a measure …

Trehalose has extensively been used to improve the desiccation tolerance of mammalian cells. To test whether trehalose improves desiccation tolerance of mammalian mitochondria, we introduced trehalose into the matrix of isolated rat liver mitochondria by reversibly permeabilizing the inner membrane using the mitochondrial permeability transition pore (MPTP). Measurement of the trehalose concentration inside mitochondria using high perfOrmance liquid chromatography showed that the sugar permeated rapidly into the matrix upon opening the MPTP. The concentration of intra matrix trehalose reached 0.29 mmoVmg protein (-190 mM) in 5 min. Mitochondria, with and without trehalose loaded into the matrix, were desiccated in a …

In many crustaceans, changing concentrations of several low molecular weight compounds modulates hemocyanin oxygen binding, resulting in lower or higher oxygen affinities of the pigment. The nonphysiological effector caffeine and the physiological modulator urate, the latter accumulating in the hemolymph of the lobster Homarus Vulgaris during hypoxia, increase hemocyanin oxygen affinity and decrease cooperativity of oxygen binding. To derive a model that describes the mechanism of allosteric interaction between hemocyanin and oxygen in the presence of urate or caffeine, studies of oxygen, urate, and caffeine binding to hemocyanin were performed. Hematopoietic stem and progenitor cells (HPCs) are a heterogenic population of cells used to treat a number of human diseases. Multilineage differentiation is a required function in successful hematopoietic reconstitution after transplantation of cryopreserved grafts. Conventional use of the cryoprotectant dimethyl sulfoxide (DMSO) has resulted in some reports of infusion related toxicity attributed to DMSO and/or damage to cells during freezethawing procedures. The purpose of this study was to explore the use of trehalose, a nontoxic disaccharide of glucose, as an alternative cryoprotectant.
