Balancing Network Security And Privacy: One Organization's Effort, Priscilla Hutson
Balancing Network Security And Privacy: One Organization's Effort, Priscilla Hutson
Honors College Theses
An organization with internet access runs a high risk of compromising their computer network. Data can be corrupted, confidential information can be stolen, and viruses can paralyze an entire network. Monitoring employee activity involves questionable legal issues and risk of violating the employees’ privacy. An organization must balance the need for monitoring against possible damage to morale, because even an innocent employee may feel spied on. According to American Management Association’s annual survey on workplace monitoring released in April 2001, 78% of large firms in the U.S. are monitoring their employees, but 10% do not notify their employees of this. …

Does Shame Have A Critical Period? Examining Shame Dynamics In British Adolescents, Michael J. O'Friel
Does Shame Have A Critical Period? Examining Shame Dynamics In British Adolescents, Michael J. O'Friel
Doctor of Psychology (PsyD)
Research into the makeup and consequences of shame has burgeoned over the last thirty years as different studies have highlighted the destructive and maladaptive behaviors that can result from an individual's exposure to multiple shaming experiences. Limited research has focused on how culture filters the experience and effects of shame. Cross-cultural research is the 'zeitgeist' in the field of shame, propelling forward the need to gain greater awareness as to the prevalence and impact of shame across cultures. A sample of25 British children aged 9-10 and 25 British children aged 14-15 were asked to respond to a projective test of …

A Separate Crime Of Reckless Sex, Katharine K. Baker
A Separate Crime Of Reckless Sex, Katharine K. Baker
All Faculty Scholarship
This article attempts to make progress on both the problems of sexually transmitted disease and acquaintance rape by proposing a new crime of reckless sexual conduct. A defendant would be guilty of reckless sexual conduct if, in a first sexual encounter with another particular person, the defendant had sexual intercourse without using a condom. Consent to unprotected intercourse would be an affirmative defense, to be established by the defendant with a preponderance of the evidence. As an empirical matter, first-encounter unprotected sex greatly increases the epidemiological force of sexually transmitted disease and a substantial proportion of acquaintance rape occurs in …

What Do Juvenile Offenders Know About Being Tried As Adults? Implications For Deterrence , Richard E. Redding
What Do Juvenile Offenders Know About Being Tried As Adults? Implications For Deterrence , Richard E. Redding
Working Paper Series
An underlying assumption in the nationwide policy shift toward transferring more juveniles to criminal court has been the belief that stricter, adult sentences will act as either a specific or general deterrent to juvenile crime. With respect to general deterrence - whether transfer laws deter would-be offenders from committing crimes - it is important to examine whether juveniles know about transfer laws, whether this knowledge deters criminal behavior, and whether juveniles believe the laws will be enforced against them. The current study is one of the first to examine juveniles' knowledge and perceptions of transfer laws and criminal sanctions. We …

Repercussions Of Crawford V. Washington: A Child's Statement To A Washington State Child Protective Services Worker May Be Inadmissible, Heather L. Mckimmie
Repercussions Of Crawford V. Washington: A Child's Statement To A Washington State Child Protective Services Worker May Be Inadmissible, Heather L. Mckimmie
Washington Law Review
Before the landmark United States Supreme Court case of Crawford v. Washington, Washington State courts often admitted statements of unavailable alleged child abuse victims through the hearsay testimony of Washington State Child Protective Services (CPS) workers. In Crawford, the U.S. Supreme Court announced a new "testimonial" standard for the admissibility of out-of-court statements. The Court held that the Confrontation Clause of the Sixth Amendment bars testimonial out-of-court statements unless the declarant is unavailable and the defendant had a prior opportunity to cross-examine the declarant. The Court did not clearly define the term testimonial, which left the matter open …
