Victims And Perpetrators: An Argument For Comparative Liability In Criminal Law, Vera Bergelson Feb 2005

Victims And Perpetrators: An Argument For Comparative Liability In Criminal Law, Vera Bergelson

Rutgers Law School (Newark) Faculty Papers

This article challenges the legal rule according to which the victim’s conduct is irrelevant to the determination of the perpetrator’s criminal liability. The author attacks this rule from both positive and normative perspectives, and argues that criminal law should incorporate an affirmative defense of comparative liability. This defense would fully or partially exculpate the defendant if the victim by his own acts has lost or reduced his right not to be harmed.

Part I tests the descriptive accuracy of the proposition that the perpetrator’s liability does not depend on the conduct of the victim. Criminological and victimological studies strongly suggest …

The Strength Of Association: Population Density And Social Deviance, University Of Justice Center

Series 3: Neighborhood Characteristics & Police Calls for Service (2004-2005)

This issue of Anchorage Community Indicators provides a brief examination of the relationship between population density and social deviance in the Municipality of Anchorage. A commonly held belief is that social density is positively correlated with social deviance, despite only sparse scientific evidence in support of this theory. A previous issue of Anchorage Community Indicators ("The Strength of Association: Housing Density and Delinquency," ACI 3a(1) (Jul 2004)) found no evidence of a relationship between housing density and deviance. The current issue builds on these previously reported findings by introducing a second measure of social density: population density, once again finding …

The Strength Of Association: Neighborhood Poverty And Social Deviance, University Of Justice Center Feb 2005

The Strength Of Association: Neighborhood Poverty And Social Deviance, University Of Justice Center

Series 3: Neighborhood Characteristics & Police Calls for Service (2004-2005)

This issue of Anchorage Community Indicators examines the strength of association between neighborhood-level poverty in Anchorage neighborhoods— measured as the percentage of households falling below the federally designated threshold of poverty — and social deviance — measured as the annual rate of police calls-for-service for various offenses. These data show poverty to be significantly related to a number of police calls-for-service indicators. These simple measures of association (not causation) align with studies in other contexts which have found that communities experiencing economic hardship bear a double burden in that they also suffer a disproportionate amount of social problems.
