Reconsidering The Commission’S Treatment Of Tribal Courts, Kevin Washburn Feb 2005

Reconsidering The Commission’S Treatment Of Tribal Courts, Kevin Washburn

Faculty Scholarship

Since the U.S. Sentencing Commission first enacted the federal Sentencing Guidelines, the Guidelines have treated tribal courts in a manner that is impossible to reconcile with other modem federal policies of respect for tribal self-determination and self-governance. In refusing to count tribal convictions for purposes of routine calculation of criminal history, the Commission has disrespected tribal courts. The Commission's tribal courts policy is anachronistic and out of step with modem efforts to support tribal courts. The Commission should amend the guidelines to reflect the principle that misdemeanor convictions from tribal courts are entitled to the same level of respect as …

Psychology, Factfinding, And Entrapment, Kevin A. Smith Feb 2005

Psychology, Factfinding, And Entrapment, Kevin A. Smith

Michigan Law Review

Through the entrapment defense, the law acknowledges that criminal behavior is not always the result of a culpable mind, but is sometimes the result of an interaction between the individual and his environment. By limiting the amount of pressure and temptation that undercover agents may bring to bear on a target, the defense recognizes that the ordinary, law-abiding citizen can be persuaded, cajoled, or intimidated into criminal activity that, he would never consider absent law-enforcement interference. Appropriate application of the defense requires, however, that courts be able to accurately separate the truly wicked from the merely weak-willed, and offensively coercive …

Child Neglect And Adolescent Violence: Examining The Effects Of Self-Control And Peer Rejection, Constance L. Chapple, Kimberly A. Tyler, Bianca E. Bersani Feb 2005

Child Neglect And Adolescent Violence: Examining The Effects Of Self-Control And Peer Rejection, Constance L. Chapple, Kimberly A. Tyler, Bianca E. Bersani

Department of Sociology: Faculty Publications

Child maltreatment researchers have often suggested that experiences with child neglect have long-term, negative effects. Child neglect is thought to have particularly adverse effects on self-control, peer relations, and delinquency. In this research, we examine the relationship of child neglect with adolescent violence via self-control and peer rejection. Using prospective, longitudinal data from a community sample, we find that child neglect adversely affects peer rejection and violence. Neglected children were more likely to be rejected by their peers in early adolescence and were more likely to be violent later in adolescence. Contrary to theoretical predictions, child neglect was not a …

An Original Misunderstanding: Akhil Amar And Fourth Amendment, David E. Steinberg Feb 2005

An Original Misunderstanding: Akhil Amar And Fourth Amendment, David E. Steinberg

San Diego Law Review

The Supreme Court's modern Fourth Amendment decisions rely on two central assumptions about the original understanding of the amendment. First, the Court and most modern commentators have presumed that the Fourth Amendment prefers searches and seizures pursuant to a specific warrant. Second, even where law enforcement activities do not require a warrant, the Court has presumed that the Fourth Amendment imposes a global reasonableness requirement on all searches and seizures. In a series of influential writings, Professor Akhil Amar has advocated a restructuring of Fourth Amendment law, based on a very different account of Fourth Amendment history. Professor Amar writes …

The Administrative Law Legacy Of Kenneth Culp Davis, Ronald M. Levin Feb 2005

The Administrative Law Legacy Of Kenneth Culp Davis, Ronald M. Levin

San Diego Law Review

Kenneth Culp Davis, one of the twentieth century's outstanding authorities on administrative law, passed away in September 2003. This commemorative essay surveys his manifold contributions to the field. The concept that is most often associated with his name, the distinction between adjudicative facts and legislative facts, is still a crucial reference point in analyses of the right to be heard in judicial or administrative proceedings. His influence has been felt in a number of other areas as well. During the past few decades, for example, administrative adjudication has become more streamlined, rulemaking has become more widely employed, and obstacles to …

The Oregon Mental Health Referral Checklists: Concept Mapping The Mental Health Needs Of Youth In The Juvenile Justice System, Kevin Corcoran Feb 2005

The Oregon Mental Health Referral Checklists: Concept Mapping The Mental Health Needs Of Youth In The Juvenile Justice System, Kevin Corcoran

School of Social Work Faculty Publications and Presentations

This article summarizes the development of checklists to identify the mental health needs of youth in the juvenile justice system. With concept mapping as its base, a 31-item checklist was developed in three parallel forms and assessed on three samples: youth in a locked correctional facility and parents and juvenile justice professionals of adjudicate youth who were sentenced to community service. The instruments appear to have acceptable to very good internal consistency and moderate to strong coefficients of equivalence. Total symptoms were associated with internal and external problems for youth, suggestions from a trusted friend that one might have a …

Adolescents Growing Up In Stressful Environments, Dual Diagnosis, And Sources Of Success, Albert R. Roberts, Kevin Corcoran Feb 2005

Adolescents Growing Up In Stressful Environments, Dual Diagnosis, And Sources Of Success, Albert R. Roberts, Kevin Corcoran

School of Social Work Faculty Publications and Presentations

This article considers the social and psychological challenges to youth in contemporary society. The authors examine the variety of social impediments that face youths in most of our social institutions, from schools and the juvenile justice system to the family. They underscore the need for prevention, health promotion, and comprehensive assessment. Further, they assert that ‘‘dual diagnosis’’ needs to be considered not as a ‘‘special population’’ but as the typical or common experience of at-risk youths once they are diagnosed at mental health centers or juvenile justice reception and diagnostic centers. They conclude that evidence-based assessment, intervention, prevention, and health …

Private Attorneys General And The First Amendment, Trevor W. Morrison Feb 2005

Private Attorneys General And The First Amendment, Trevor W. Morrison

Michigan Law Review

The "private attorney general" is under fire again. It has been in and out of favor in the six decades since it was named, in part because it has come to signify so many different things. At its core, however, the term denotes a plaintiff who sues to vindicate public interests not directly connected to any special stake of her own. The remedies sought in such actions tend to be correspondingly broad: rather than seeking redress for discrete injuries, private attorneys general typically request injunctive or other equitable relief aimed at altering the practices of large institutions. From school desegregation …

The Unfulfilled Promise Of The Constitution In Executive Hands, Cornelia T.L. Pillard Feb 2005

The Unfulfilled Promise Of The Constitution In Executive Hands, Cornelia T.L. Pillard

Michigan Law Review

Many leading constitutional scholars now argue for greater reliance on the political branches to supplement or even supplant judicial enforcement of the Constitution. Responding to our national preoccupation with the judiciary as the mechanism of constitutional enforcement, these scholars stress that the executive and legislature, too, bear responsibility to think about the Constitution for themselves and to take steps to fulfill the Constitution's promise. Joining a debate that goes back at least as far as Marbury v. Madison, current scholars seek to reawaken the political branches to their constitutional potential, and urge the Supreme Court to leave the other …
