Bolling, Equal Protection, Due Process, And Lochnerphobia, David E. Bernstein Jul 2005

Bolling, Equal Protection, Due Process, And Lochnerphobia, David E. Bernstein

George Mason University School of Law Working Papers Series

In Brown v. Board of Education, the United States Supreme Court invalidated state and local school segregation laws as a violation of the Fourteenth Amendment's Equal Protection Clause. That same day, in Bolling v. Sharpe, the Court held unconstitutional de jure segregation in Washington, D.C.'s public schools under the Fifth Amendment's Due Process Clause. Fifty years after it was decided, Bolling remains one of the Warren Court's most controversial decisions.

The controversy reflects the widespread belief that the outcome in Bolling reflected the Justices' political preferences and was not a sound interpretation of the Due Process Clause. The Bolling Court …

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reentry Into Criminal Defense Lawyering, Michael Pinard Jul 2005

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reentry Into Criminal Defense Lawyering, Michael Pinard

Faculty Scholarship

In this article, Professor Michael Pinard highlights the holistic model of criminal defense representation, which seeks to address the myriad issues that often lead to the client’s involvement with the criminal justice system with the overarching goal of providing a comprehensive solution to those underlying factors. While lauding these developments, however, Professor Pinard argues that the holistic model has largely overlooked two facets of the criminal justice system that impact greatly the client’s life once the formal representation has concluded: the collateral consequences of criminal convictions and reentry. Professor Pinard explores the emerging attention devoted to these two components, but …

The Effect Of Knowledge Gain On Capital Punishment: A Partial Test Of The Marshall Hypothesis, Alexander Able Savon Jul 2005

The Effect Of Knowledge Gain On Capital Punishment: A Partial Test Of The Marshall Hypothesis, Alexander Able Savon

USF Tampa Graduate Theses and Dissertations

Justice Thurgood Marshall proposed a three-pronged postulate in his dissent in1972 in the Furman v. Georgia (408 U.S. 238) Supreme Court case. The American public is generally uninformed when it comes to the death penalty, and given information a "great mass of citizens" would be against it, unless their underlying beliefs were rootedin retribution (Furman v. Georgia, p. 363). These statements subsequently came to be known as the Marshall Hypothesis, and were deemed testable by researchers.

This study examines the influence on death penalty opinion as a consequence of participating in a college class on the death penalty. …

Stories Of Resiliency: Successful Female Educational Leaders, Anita M. Pankake, Danna Beaty

Journal of Women in Educational Leadership

United States V. Patane: The Supreme Court's Continued Assault On Miranda, David Bosworth

Mercer Law Review

In United States v. Patane, the United States Supreme Court ruled on the issue of whether a police officer's failure to give a suspect the complete Miranda warnings required the court to suppress a gun found as a result of the suspect's voluntary statements. In a 5-4 decision, the Court held that failure to give such warnings does not require suppression of physical evidence gained from unwarned voluntary statements. The dissenting justices were concerned about the negative effects this ruling would have on police procedures, judicial inquiries, and suspect's rights. This decision creates another exception to the Miranda rule …

Justifying Restorative Justice: A Theoretical Justification For The Use Of Restorative Justice Practices, Zvi D. Gabbay Jul 2005

Justifying Restorative Justice: A Theoretical Justification For The Use Of Restorative Justice Practices, Zvi D. Gabbay

Journal of Dispute Resolution

This paper analyzes the premises of the two main theories of punishment that influence sentencing policies in most Western countries-retributivism and utilitarianism-and compares them to the basic values that structure the restorative justice theory. It then makes clear distinctions between restorative justice and the rehabilitative ideal and addresses the criticism that, like rehabilitation, restorative justice results in different punishments to equally culpable offenders. The paper concludes that restorative justice does not contradict retribution and utility as theoretical justifications for penal sanctioning. Moreover, it suggests that restorative practices rehabilitate the basic notions of retribution and deterrence that have been neglected in …
