Cybersecurity, Identity Theft, And The Limits Of Tort Liability, Vincent R. Johnson Aug 2005

Cybersecurity, Identity Theft, And The Limits Of Tort Liability, Vincent R. Johnson

ExpressO

This article considers to what extent database possessors (such as credit card companies and universities) can be held liable for harm caused to data subjects (such as consumers, applicants, and alumni) when information relating to those persons is hacked or otherwise subject to improper access. Addressing common-law and statutory sources (including new legislation in 17 states) the article clearly differentiates the duty to safeguard data from the duty to notify data subjects that the security of their information has been breached. By analogy to the “medical-monitoring damages” which some states award in toxic-exposure cases, the article argues that “security-monitoring damages” …

Substantive Due Process As A Source Of Constitutional Protection For Nonpolitical Speech, Gregory P. Magarian Aug 2005

Substantive Due Process As A Source Of Constitutional Protection For Nonpolitical Speech, Gregory P. Magarian

Working Paper Series

Present First Amendment doctrine presumptively protects anything within the descriptive category “expression” from government regulation, subject to balancing against countervailing government interests. As government actions during the present war on terrorism have made all too clear, that doctrine allows intolerable suppression of political debate and dissent – the expressive activity most integral to our constitutional design. At the same time, present doctrine fails to give a clear account of why the Constitution protects expressive autonomy and when that protection properly should yield to government interests, leading to an inconsistent and unsatisfying free speech regime. In this article, Professor Magarian advocates …

Shifts In Policy And Power: Calculating The Consequences Of Increased Prosecutorial Power And Reduced Judicial Authority In Post 9/11 America, Chris Mcneil Aug 2005

Shifts In Policy And Power: Calculating The Consequences Of Increased Prosecutorial Power And Reduced Judicial Authority In Post 9/11 America, Chris Mcneil

ExpressO

Among many responses to the attacks of September 11, 2001, Congress and the states have shifted to the executive branch certain powers once held by the judicial branch. This article considers the impact of transferring judicial powers to prosecutorial officers, and compares the consequent increased powers of the prosecutor with those powers traditionally held by prosecutors in Japanese criminal courts. It considers the impact of removing from public view and judicial oversight many prosecutorial functions, drawing comparisons between the largely opaque Japanese prosecutorial roles and those roles now assumed in immigration and anti-terrorism laws, noting the need for safeguards not …

Evaluation Of An Electro-Disinfection Technology As An Alternative To Chlorination Of Municipal Wastewater Effluents, Maria Elena Pulido

LSU New Orleans Theses and Dissertations

This research evaluated and demonstrated the disinfection efficiency of an electrochemical system for total coliform removal from wastewater effluents after secondary treatment. Four bench scale batch electrochemical cells were assembled and operated in the laboratory: the first electro-disinfection reactor was set with aluminum electrodes, the second with standard 316 stainless steel electrodes, the third one with titanium electrodes, and the fourth one with a standard 316 stainless steel cathode and a titanium anode. During the electro-disinfection process the water sample was placed on the reactor/disinfector to which direct current (DC) was charged. The results showed that total coliform counts in …

Reliability Of Light-Frame Wood Roof Construction Under Extreme Wind Loads, Daniel Meireles De Oliveriria Rocha Aug 2005

Reliability Of Light-Frame Wood Roof Construction Under Extreme Wind Loads, Daniel Meireles De Oliveriria Rocha

Theses and Dissertations

Light-frame wood construction is frequently used in the U.S. High wind events, such as hurricanes, may cause severe damage to these structures by breaking the roof envelope. This study focuses on computing reliability indices of roof sheathing panels exposed to high wind events while considering a time and spatially varying wind load. A procedure is developed that links probabilistic and dynamic finite element analysis codes. The results show that a few critical panels are most susceptible to damage, while most panels have significantly higher reliability indices than previous studies based on simplified analyses have shown. By setting a target reliability …

Predicting Age Related Changes In Mobility And Driving Habits, Melissa Mathews Aug 2005

Predicting Age Related Changes In Mobility And Driving Habits, Melissa Mathews

Masters Theses & Specialist Projects

Older adults encounter many changes as they age, both cognitively and physically. These changes tend to impact one's mobility in terms of driving ability and exposure. It has been well documented that this population is increasing in number (Lyman, Ferguson, Braver, & Williams, 2002) and that they pose a higher crash risk than a younger population (Braver & Trempel, 2004; Dellinger, Kresnow, White, & Seghal, 2004; Tavris, Kuhn, & Layde, 2001). These cognitive and physical changes combined with increased crash risk lead a number of drivers to reduce the amount that they dri\ c or cease dri\ ing altogether, thereby …

High Tech Spatial Concentration Human Capital, Agglomeration Economies, Location Theories And Creative Cities., Songmei Li 1970-

Electronic Theses and Dissertations

This study explores four economic development theories – classical location theory, human capital theory, agglomeration economies theory and creative cities theory, and their effectiveness in explaining the spatial distribution of high tech industries across metropolitan areas. This study identifies a strong and positive role for education and top-ranked research universities on high-tech employment concentrations, thus supporting the human capital approach that promotes investment in education and academic R&D to stimulate regional high technology economic development. This study also suggests that successful high technology regions are the regions with the presence of multi-regional and multinational corporate headquarters and accessibility to an …

An Iq Test For Federal Agencies? Judicial Review Of The Information Quality Act Under The Apa, Margaret Pak Aug 2005

An Iq Test For Federal Agencies? Judicial Review Of The Information Quality Act Under The Apa, Margaret Pak

Washington Law Review

The Information Quality Act (IQA) directs the Office of Management and Budget (OMB) to issue guidelines to federal agencies for ensuring and maximizing the quality, objectivity, utility, and integrity of information disseminated by the agencies. The IQA directs agencies to develop administrative mechanisms whereby a person affected by agency-disseminated information may request correction of information that the person believes does not comply with the OMB's guidelines. The IQA is silent on whether judicial review is available to challenge an agency's decision to deny a "request for correction" (RFC). Regulated parties, legislators, scholars, and other groups have framed judicial review of …

Executive Exposure: Government Secrecy, Constitutional Law, And Platforms For Judicial Elaboration, Adam M. Samaha Aug 2005

Executive Exposure: Government Secrecy, Constitutional Law, And Platforms For Judicial Elaboration, Adam M. Samaha

Public Law and Legal Theory Working Papers

American law never reached a satisfying conclusion about public access to information on government operations. But recent events are prompting reconsideration. As our current system is reassessed, three shortfalls in past debates should be overcome. The first involves ignorance of foreign systems. Other democracies grapple with information access problems, and their recent experiments are illuminating. Indeed they expose two additional domestic weaknesses. One is a line we have drawn within constitutional law. Courts and commentators tend to treat constitutional issues of public access separately from those of executive discretion to withhold information. These matters should be seen as parts of …

Cryptography Export Controls - Canada's Dichotomous Cryptography Policy, Paul Bates Aug 2005

Cryptography Export Controls - Canada's Dichotomous Cryptography Policy, Paul Bates

Canadian Journal of Law and Technology

The effort to erect strong legal barriers to trans-national distribution of cryptography has significant gaps because strong cryptography can be obtained and used within Canada without legal restrictions. This paper advocates that Canada should exercise its discretion under the WA to diminish, not fortify, the restrictions of the export control regime.
