Medical Error Disclosure, Mediation Skills, And Malpractice Litigation: A Demonstration Project In Pennsylvania, Carol B. Liebman, Chris Stern Hyman Jan 2005

Medical Error Disclosure, Mediation Skills, And Malpractice Litigation: A Demonstration Project In Pennsylvania, Carol B. Liebman, Chris Stern Hyman

Faculty Scholarship

In the past decade, the cost of medical malpractice insurance has skyrocketed in Pennsylvania. Physicians in high-risk specialties are reported to have moved out of the state, closed their practices, or retired, particularly in eastern Pennsylvania. Liability insurance companies have pulled out of the state. At the same time, serious medical errors continue to occur. Doctors and hospital officials, afraid of lawsuits and loss of insurance coverage, often stonewall patients and relatives, offering only barebones explanations of serious medical errors. Research shows this situation creates a vicious circle in which frustration, anger, and a search for information often motivate patients …

A Pasport To Service Quality, Lynn A. Brock Jan 2005

A Pasport To Service Quality, Lynn A. Brock

The Christian Librarian

Part 1 of this article discussed the current service quality environment in which academic libraries find themselves operating, and the challenge for staff performance assessment as an integral element of maintaining and improving effective service quality levels. As referenced in Part 1, Millson-Martula and Menon in a 1999 article in College and Research Libraries suggest that "no effort to enhance customer satisfaction will succeed unless students and faculty are convinced that library staff, as service providers, care about the quality of service they provide and the manner in which they do it. However, library staff will not demonstrate a high …

Small Library, Big Job, Carol Reid Jan 2005

Small Library, Big Job, Carol Reid

The Christian Librarian

Many small college libraries employ only one professional. T hat means one person serves as reference librarian, cataloger, acquisitions specialist, circulation supervisor, inter-library loan officer, periodicals manager, information literacy instructor, and administrator- as well as conm1ittee member and sometimes teacher. (We won't mention organist, student activity sponsor, or even volleyball coach.) Wearing so many hats at one time can be both a bane and a blessing. "No two days are ever alike." "I like being my own boss." " It's never boring." A 2004 ACL Conference roundtable discussion brought out all of these positives about working in the single-professional library. …

Free, Full-Text, Scholarly Journals On The Web, John Jaeger

The Christian Librarian

In the November, 2000 issue of College & Research Libraries, Michael Fesmire and Elizabeth Young had a fascinating article entitled, "Free Scholarly Electronic Journals: What Access Do College and University Libraries Provide?" In the article, they discussed the rapid growth of these free, academic, peer-reviewed journals on the Internet that covered all different subject areas. Through careful effort, the authors had located over 200 scholarly, full-text, peer reviewed journals, many of which were indexed in major services such as ERIC, Medline, MathSciNet, INSPEC, and C henucal Abstracts. They also noted, though, that most college and university libraries were not making …

Print Media Vs. Digital Manifest Destiny, David Mash Jan 2005

Print Media Vs. Digital Manifest Destiny, David Mash

The Christian Librarian

Every communications medium reflects and reinforces intellectual habits and content patterns unique to the medium. A digital/internet hegemony is a paradoxical foreclosure on breadth of mind since digital formats do not reflect or reinforce the intellectual habits and content patterns unique to other media, especially books. A credible educational process w ill take appropriate advantage of digital media without allowing its influence to repress breadth of mind.

The Quest For Novel Computational Paradigms And Machines, Christof Teuscher Jan 2005

The Quest For Novel Computational Paradigms And Machines, Christof Teuscher

Electrical and Computer Engineering Faculty Publications and Presentations

The quest for novel and unconventional computing machines is mainly motivated by the man-machine dichotomy and by the belief that meeting tomorrow's complex real world challenges will require new paradigms and new engineering methods to organize, train, and program such machines and to interact with them.

An Exploratory Analysis Of Post Strategic Plan Implementation Fidelity In Two Urban-Based, Nonprofit Health Education/Advocacy Organizations, Theodore N. Burke Jan 2005

An Exploratory Analysis Of Post Strategic Plan Implementation Fidelity In Two Urban-Based, Nonprofit Health Education/Advocacy Organizations, Theodore N. Burke

Theses and Dissertations in Urban Services - Urban Education

This research is a multi case study examining the degree of fidelity (adherence) accorded to strategic plans following implementation in two, urban-based, nonprofit, tax-exempt 501 (c) (3) health education/advocacy organizations. The study was focused on the impetus and goals for strategic planning, the similarities and differences in the implementation processes, adherence (fidelity) to the plan once implemented, and finally what factors prompted the fidelity or lack of fidelity to the plan once implemented. Fourteen respondent participants from the two organizations were interviewed using a semi-structured interview format. Findings of this study indicated that post-strategic plan fidelity following implementation did exist. …

Causation By Presumption? Why The Supreme Court Should Reject Phantom Losses And Reverse Broudo, John C. Coffee Jr. Jan 2005

Causation By Presumption? Why The Supreme Court Should Reject Phantom Losses And Reverse Broudo, John C. Coffee Jr.

Faculty Scholarship

Over a quarter of a century ago, Judge Henry Friendly coined the term "fraud by hindsight" in upholding the dismissal of a proposed securities class action. As he explained, it was too simple to look backward with full knowledge of actual events and allege what should have been earlier disclosed by a public corporation in its Security and Exchange Commission (SEC) filings. Because hindsight has twenty/twenty vision, plaintiffs could not fairly "seize [] upon disclosures" in later reports, he ruled, to show what defendants should have disclosed earlier.

Today, a parallel concept – "causation by presumption" – is before the …

Holmes And The Marketplace Of Ideas, Vincent A. Blasi Jan 2005

Holmes And The Marketplace Of Ideas, Vincent A. Blasi

Faculty Scholarship

At least five basic values might be served by a robust free speech principle: (1) individual autonomy; (2) truth seeking; (3) self-government; (4) the checking of abuses of power; (5) the promotion of good character. Free speech might serve one or more of these values by functioning in at least three different ways: (1) as a privileged activity; (2) as a social mechanism; (3) as a cultural force. My contention is that the conventional understanding of the most familiar metaphor in the First Amendment lexicon, the "marketplace of ideas," has had the undesirable effect of focusing attention too much on …

Disappearing Dilemmas: Judicial Construction Of Ethical Choice As Strategic Behavior In The Criminal Defense Context, Manuel Berrélez, Jamal Greene, Bryan Leach

Faculty Scholarship

Imagine the following scenario: A criminal defense attorney represents a man accused of kidnapping and murdering two children in a residential neighborhood. During the course of interviewing key witnesses, the defense attorney becomes convinced that her client was present at the scene of the murder. While her client denies having been present, his alibi changes entirely from one interview to the next. The two main witnesses that the client offers to Corroborate his most recent alibi recant, suggesting to the defense attorney that both they and the defendant were actually present at the scene of the crime. Third parties confirm …

"Dragonslaying." Review Of Democracy Defended, By G. Mackie, Donald J. Herzog Jan 2005

"Dragonslaying." Review Of Democracy Defended, By G. Mackie, Donald J. Herzog

Reviews

Early in the Iliad, the Achaians convene an assembly. There are a lot of them and they're unruly, too. "[Tihe place of their assembly was shaken, and the earth groaned / as the people took their positions and there was tumult. Nine heralds / shouting set about putting them in order, to make them cease their / clamour and listen to the kings beloved of Zeus."' Clutching the scepter that has come to him ultimately from Zeus, the very symbol of his right to speak and be heard, Agamemnon bitterly proposes that the Achaians give up. Nine years of struggle …

Optimization Of Impedance Bandwidth For The Printed Rectangular Monopole Antenna, Matthias John, Max Ammann Jan 2005

Optimization Of Impedance Bandwidth For The Printed Rectangular Monopole Antenna, Matthias John, Max Ammann

Articles

This paper describes a printed rectangular-plate monopole fed by microstrip line. The effect of varying the plate width, feed-gap height, and feedline width on the impedance bandwidth is examined. It is shown that for a fixed ground-plane size, that optimization of these parameters can yield an impedance bandwidth ratio of 4.3:1, without using any broadbanding techniques.

Investigating The Use Of Wide Area Agmented System (Waas) As A Navigational Tool For Coast Guard And Civilian Maritime Use, Christopher M. Armstrong Jan 2005

Investigating The Use Of Wide Area Agmented System (Waas) As A Navigational Tool For Coast Guard And Civilian Maritime Use, Christopher M. Armstrong

Open Access Master's Theses

Since 2003, the Federal Aviation Administration (FAA) has employed WAAS for precision approaches to airports and navigational use for aircraft -0ver the continental United States, adjacent ocean regions, and parts of Alaska. This was due in part to GPS/DGPS not meeting the FAA's strict guidelines for accuracy, integrity, and availability. Currently, the FAA rates WAAS for 250ft and above the surface of the earth; this 250-foot barrier ensures 100% coverage over the United States from two existing INMARSAT satellites. Because of this height restriction, the Coast Guard has not accepted WAAS as an individual stand-alone source of navigation for military …

Understanding Customer Relationship Management From Managers' And Customers' Perspective: Exploring The Implications Of Crm Fit, Market Orientation, And Market Knowledge Competence, Jounghae Bang

Open Access Dissertations

Customer Relationship Management (CRM) has received a lot of attention and come to occupy a central place as a vital strategy in organizations. Well-managed CRM systems have clear economic payoffs and offer significant possibilities for creating and sustaining ideal, highly satisfying customer relationships. On the flip side, however, poorly managed CRM can spell disaster. Given its potential and the high cost, the focus of CRM practice and research has been mostly on technology. The focus, however, has been shifting to other factors due to the high failure rate. Not many in-depth studies have been conducted to investigate the organizational and …

Attention-Deficit/Hyperactivity Disorder: A Survey Of Assessment Practices By School Psychologists, Teresa L. Miller

Open Access Dissertations

This research was conducted to survey the assessment and diagnostic practices of school psychologists who assess individuals referred for Attention-Deficit/Hyperactivity Disorder (ADHD). Results showed that a substantial number of school psychologists routinely provide ADHD assessments despite concerns about the quality of the psychological instruments available to them or a lack of an agreed-upon gold standard for ADHD assessment. Participants reported that ADHD-related referrals were accurate approximately 65% of the time, and teachers were rated as both the most common and accurate of all referral sources. Most of the school psychologists used the Wechsler Intelligence Scale for Children, the Behavior Assessment …

Do High School Advisory Programs Promote Personalization? Correlates Of School Belonging, Phyllis C. Meloro Jan 2005

Do High School Advisory Programs Promote Personalization? Correlates Of School Belonging, Phyllis C. Meloro

Open Access Dissertations

Personalization of our nation's high schools has been identified as an important yet often overlooked component of successful educational reform. It is a result of having lasting positive relationships with teachers leading to a feeling of connectedness to their school. Research supports the role of personalization and school belongingness through their correlation with a number of positive educational and behavioral outcomes. High sense of school belonging is associated with an increase in educational variables such as high grades and academic motivation, and a decrease in school drop out and behavior problems. This study examined the relationship between an advisory program …

Psychopathy And Compliance Correlates For Male Delinquents In A Community Program, Marshall Jackson Robinson Jan 2005

Psychopathy And Compliance Correlates For Male Delinquents In A Community Program, Marshall Jackson Robinson

Open Access Dissertations

Psychopathy, the constellation of behaviors and attitudes characterized by aggressive predation, manipulation, callousness, exploitation, and which is often connected with criminality, can exact a substantial interpersonal and social toll. While the prevalence of psychopathy is extremely low among the general public, it is a significant population within the realms of criminal justice and mental health. Researchers have linked psychopathy to chronic antisocial behavior across the life span, and have established strong links between adult psychopathy and certain subpopulations of behaviorally dysfunctional youth. Within the last ten years much work has gone into conceptualizing and applying the construct of psychopathy to …

Open Access Dissertations

Problem. Domestic violence (DV) results in the death of four women daily in the US and affects all racial/ethnic groups. Due to immigration, cultural values, and attitude toward authority, there may be unique factors influencing the DV experience for Asian victims that are not well understood due to a paucity of research. Objective. This study examined DV homicide and arrests, victims' reporting, violence severity, and police response to DV calls for Asian victims compared to African American, Hispanic, and White victims. Method. This was a cross-sectional, retrospective study (2001-2004) of DV incidents in Rhode Island based on secondary data analysis …

Moore-Greig Designs: A New Combinatorial Structure, Jarred T. Collins

Open Access Dissertations

Mathematicians began studying the generalized whist tournament in the late 1990's. As with traditional whist tournaments (that is, whist tournaments with 4 players per game), many specializations can be examined. In this study, we have combined the methods of Moore and Greig and introduced a new design, called a Moore - Greig Design. This design is an RBIBD that contains, simultaneously, nested RBIBDs, nested GWhDs, many GWhDas, frames, nested frames, GWh-Frames, nested GWhFrames, GWhaFrames, RRDFs and nested RRDFs. All of these designs are Z-cyclic. Additionally, several infinite classes of these Moore - Greig Designs are new.
