Student Work
This research will use adult probation data from the Douglas County Court Probation Office for 2000 and 2001 to evaluate the relationship between the locations of probationers and their possible effects on the amount of crime on residential city blocks in Omaha, Nebraska. The analyses will relate the probation data to the dependent variables that are based on the Part I Index Crimes obtained from the Omaha Police Department. The research will attempt to evaluate the effects of probationers on the amount of crime on city blocks and compare this with the effects of block-level characteristics and crime on the …

The Perils Of Risk Assessment, James J. Chriss
The Perils Of Risk Assessment, James J. Chriss
Sociology & Criminology Faculty Publications
The article considers how social solidarity has changed over the long march of human history. The distinction that the author Emile Durkheim makes between mechanical and organic solidarity is summarized. In his book "Suicide," Durkheim's pessimism about modern society was fueled by data which indicated that social pathologies were occurring at higher rates in metropolitan communities. The application of postmodern interpretations to the criminal justice arena, especially in terms of the practice of reducing risk via the development of risk assessment tools is illustrated.
A Decade Of Spouse-Based Immigration Laws: Coverture's Diminishment, But Not Its Demise, Janet Calvo
A Decade Of Spouse-Based Immigration Laws: Coverture's Diminishment, But Not Its Demise, Janet Calvo
Northern Illinois University Law Review
This article argues that legacies of coverture and the resulting legal inequality of women remain in spouse-based immigration laws even after several legislative attempts to address some of the underlying issues. First, there has not been a rejection of the notion of spousal control that underlies coverture. The power to petition, which controls the ability of a non-citizen spouse to live and work and have custody of children in the United States, is basically still the prerogative of a citizen or resident spouse. Second, the mail-order bride business continues without significant limitation on the ability of citizens or residents to …

Two Standards Of Competency Are Better Than One: Why Some Defendants Who Are Not Competent To Stand Trial Should Be Permitted To Plead Guilty, Jason R. Marshall
Two Standards Of Competency Are Better Than One: Why Some Defendants Who Are Not Competent To Stand Trial Should Be Permitted To Plead Guilty, Jason R. Marshall
University of Michigan Journal of Law Reform
This Note argues that the present uniform standard of competency, competence to stand trial, be abolished in favor of two standards: competence to stand trial and competence to plea bargain. Part I traces the history of the competency standard by exploring its common law origins, the Supreme Court rulings that frame the debate, an academic reformulation of the competency inquiry, and the interests protected by requiring that defendants be competent to proceed through the criminal process. Part II contrasts the cognitive abilities, capacity to communicate with counsel, and courtroom behavior of defendants standing trial with those qualities required of defendants …
Tribal Jurisdiction And Domestic Violence: The Need For Non-Indian Accountability On The Reservation, Amy Radon
Tribal Jurisdiction And Domestic Violence: The Need For Non-Indian Accountability On The Reservation, Amy Radon
University of Michigan Journal of Law Reform
Domestic violence is a severe problem for tribes across the nation, as their female members are victimized at highly disproportionate rates compared to members of dominant society. Many tribes have sophisticated domestic violence codes to combat the problem, but they are powerless to prosecute the majority of those who will abuse Indian women: non-Indian men. In 1978 the Supreme Court stripped tribes of their power to prosecute non-Indians in criminal matters, which not only damaged tribal sovereignty but also meant the difference between a life free from abuse and one with constant fear, intimidation, and pain for Indian women.

Attachment Strategies Of Adolescents In Foster Care: Indicators And Implications, Shannon Leigh Trewartha
Attachment Strategies Of Adolescents In Foster Care: Indicators And Implications, Shannon Leigh Trewartha
EVMS School of Health Professions Theses & Dissertations
The purpose of this study was to explore the use of an art-based assessment to recognize the attachment strategy of adolescents in foster care. The extenuating circumstances of foster care make it imperative to develop a sensitive, accurate, and time-efficient tool. Knowledge of specific attachment strategy can better guide therapeutic interventions. This study examined adolescents’ attachment strategy as measured by the Adolescent Relationship Questionnaire (A-RSQ) in comparison to ratings on the Bird’s Nest Drawing (BND). Fourteen adolescents in foster care participated.
Due to the low number of participants, data was predominantly analyzed descriptively. On the A-RSQ, the sample had lower …
Education And Its Effects On Police Officer Job Performance: The Perceived Views From Both Chattanooga Police Officers And Society, Heather Stone
Education And Its Effects On Police Officer Job Performance: The Perceived Views From Both Chattanooga Police Officers And Society, Heather Stone
Masters Theses and Doctoral Dissertations
This study was designed to examine the relationship between a police officer's level of education and the perception of education on police officer job performance. Specifically, the researcher hypothesized that police officers with college degrees were perceived to perform their duties better than officer's without any college experience. In order to test this hypothesis, the researcher conducted a survey questionnaire which was administered to numerous police officers who work for the Chattanooga Police Department and civilians within the Chattanooga community. Overall, most of the respondents felt that officers should only be required to have a high school diploma (35.4%). According …

Pleas' Progress, Stephanos Bibas
Pleas' Progress, Stephanos Bibas
Michigan Law Review
George Fisher's new book, Plea Bargaining's Triumph, is really three books in one. The first part is a careful, detailed explanation of how and why plea bargaining exploded in Middlesex County, Massachusetts in the nineteenth century. This part is the fruit of an impressive amount of original research in Massachusetts court records and newspaper archives. The second part of the book looks more broadly at other academic histories of plea bargaining in England, California, and New York. It explains how the forces that produced plea bargaining in Middlesex County likewise contributed to plea bargaining's rise elsewhere. The final part …
Justice In The Time Of Terror, Sharon L. Davies
Justice In The Time Of Terror, Sharon L. Davies
Michigan Law Review
On my drive into work recently I found myself behind a Ford pickup truck and noticed its bumper sticker: "When the going gets tough, I get a machine gun." Not a doctor. Not a counselor or mediator. Not a shelter for cover. Not the wisdom of a favored advisor or a proven friend. But a machine gun. How odd, I thought, to prefer a weapon incapable of identifying with any precision, any careful thought, where the enemy of the wielder of it might actually be hidden. A weapon as apt to injure non-targets as targets. A weapon mindless of its …

The Media At The Tip Of The Spear, Kevin A. Smith
Michigan Law Review
Due largely to the first widespread availability of the telegraph, through which breaking stories could be transmitted to the presses in moments, the debut of the American war correspondent occurred during the Civil War. From their beginning, American war correspondents have frequently "embedded" with the troops on whom they reported. General Grant, for example, allowed his favorite New York Herald reporter to travel with his entourage, and even used him as a personal messenger. Reporters proved an important component of the war effort for both the North and the South. Papers on both sides proved willing providers of propaganda to …

Predictors Of Graduation And Rearrest In A Contemporary Juvenile Drug Court Program, Anthony Phillip Tranchita
Predictors Of Graduation And Rearrest In A Contemporary Juvenile Drug Court Program, Anthony Phillip Tranchita
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
Research on the efficacy of drug courts for substance-abusing criminal adult offenders has generally found reduced recidivism rates, and both actual and potential cost savings to the public. However, outcome research on juvenile drug courts has been limited. Furthermore, little research has examined variables that may be predictive of outcome in this population. This study reports graduation and rearrest rates for a sample of juvenile drug court participants in Salt Lake City, Utah. Also, this research assessed whether demographics, prior arrest history, attendance at drug education classes, serving detention time, or a preprogram measure of degree of substance abuse (SAS …
Human Rights Approaches Of Corruption Control Mechanisms - Enhancing The Hong Kong Experience Of Corruption Prevention Strategies, C. Raj Kumar
San Diego International Law Journal
This Article is intended to make a case for promoting transparency in governance policies from a human rights perspective so as to argue for the development of a human right to good governance in Hong Kong. Secondly, it analyzes the work of the Independent Commission against Corruption (ICAC) in Hong Kong and addresses certain concerns in improving the efficiency of the ICAC. Thirdly, it argues that rights against corruption in Hong Kong should move beyond a law enforcement and public policy issue and attain the status of a human right. Fourthly, this Article examines the growth and development of international …
Reforming Federal Habeas Review Of Military Convictions: Why Aedpa Would Improve The Scope And Standard Of Review, John K. Chapman
Reforming Federal Habeas Review Of Military Convictions: Why Aedpa Would Improve The Scope And Standard Of Review, John K. Chapman
Vanderbilt Law Review
The writ of habeas corpus is a collateral remedy available to prisoners who have exhausted all available appellate remedies. Habeas corpus, which literally means "to have or produce the body," involves a court order directing the custodian of a prisoner to bring the prisoner before the court in order to assess the validity of the prisoner's confinement. The importance of habeas corpus in the federal system has been recognized since the drafting of the Constitution and its historical roots trace back as far as the 12th Century in England. It is a procedure designed to protect individuals by forcing the …

Forensic Information Management System, Arunshankar Srinivasan
Graduate Theses, Dissertations, and Problem Reports (ETD)
The primary objectives of this project were to reduce the paper work, increase data reliability and reduce process turnaround time at the West Virginia State Police Forensic Laboratory (WVSPFL) Charleston, WV. The objective was achieved by reengineering and automating various processes in the seven units of the laboratory. A software tool called Forensic Information Management System (FIMS) was developed. FIMS was implemented in Visual Studio.Net; MS-SQL server was used as the database. The FIMS can be accessed via the internet/intranet, Personal Digital Assistant (PDA), or a stand-alone desktop computer. The key benefits of FIMS are its ability to integrate information …

The Impact Of Fidelity On Program Quality In The Healthy Families America Program, Stacey R. Kessler
USF Tampa Graduate Theses and Dissertations
The current study examined the relationship between program fidelity, or adherence to the program model, and program outcomes using the Healthy Family America Program Model. Specifically, 103 program sites were evaluated based on their adherence to the program model. The outcome indices included the percentage of children with updated immunizations and the percentage of children with primary care physicians. First order correlations, multiple regression, and canonical correlation were used to analyze the data. The results of the study are mixed. Specifically, an overall index of fidelity is positively related the percentage of children with updated immunizations, but not to the …
