Deterrence Factors For Copyright Infringement Online, Nico Nergadze

The purpose of this study was to investigate deterrence factors for online file-sharing by analyzing different conditions that affect compliance with the law through survey of the students in a large university in Southern U.S. The findings show that certainty of punishment, stigma of the label, knowledge of the laws and consensus with the rule negatively correlated with both actual and likely future file-sharing activities of the users

In Search Of Gideon's Promise: Lessons From England And The Need For Federal Help, Norman Lefstein

A significant national problem is the enduring widespread crisis in providing adequate legal representation for indigent defendants in state criminal prosecutions. Insufficient funding and lack of oversight undermines the quality of public defense delivery systems while constantly risking the conviction of innocent persons. Thus, the Constitution's promise of counsel, first recognized in 1963 by the U.S. Supreme Court in Gideon v. Wainwright, remains unfulfilled. This Article, which draws upon an in-depth study of English criminal legal aid, focuses on sources of funding, selection of counsel by the client, and programs to monitor the quality of representation. Prejudice Presumed: The Decision To Concede Guilt To Lesser Offenses During Opening Statements, Robert J. Nolan

On March I, 2004, the Supreme Court granted certiorari in Florida v. Nixon to resolve whether Strickland v. Washington or United States v. Cronic applies to ineffective assistance of counsel claims where defense counsel unilaterally concedes guilt to a lesser offense. A number of lower courts have considered this issue. Some have applied Stickland's two prong test and required the defendant to prove both deficient performance and prejudice. Other courts have held that such a concession amounts to a failure of meaningful adversarial testing and under Cronic, prejudice should be presumed. Since Bell v. Racial Differences In The Mental Health Needs And Service Utilization Of Youth In The Juvenile Justice System, Michael Jenuwine, Purva Rawal, Jill Romansky, John S. Lyons

Mental health placement rates by the juvenile justice system differ by race. However, it is unknown whether mental health needs differ by race. This study attempted to investigate potential differences in mental health needs and service utilization among Caucasian, African American, and Hispanic juvenile justice involved youth. A stratified random sample of 473 youth petitioned, adjudicated, and incarcerated from 1995-1996 was examined using a standard chart review protocol and the Childhood Severity of Psychiatric Illness measure for mental health needs. The Cooperative Education and Internships program is charged with placing students in positions that will allow them to gain experience in a work environment related to their major area of study. Job development specialists receive no type of written feedback from the employer, the faculty advisor, or the student on whether or not the placement was successful. The problem is that Cooperative Education and Internships has not demonstrated its effectiveness; therefore, there is reluctance from students, faculty advisors, and job development specialists to continue participating and/or promoting the program.

Reducing Discipline Referrals At State Bridge Crossing Elementary School In Alpharetta, Georgia, Renay R. Dixon

The major purpose of this study was to reduce the number of student discipline referrals in a suburban elementary school with a student population of approximately 830 in 2003. An analysis of the annual School Administrative Student Information System Discipline Report indicated that over the past two years (2000-2002), discipline referrals had increased by 44%.

The design most conducive for this applied research was a descriptive design. Pre- and postdata were compared to determine if there was a decrease in student discipline referrals.
