Exonerated By Dna After 16 Years In Prison, Donald E. Wilkes Jr. Jan 2004

Exonerated By Dna After 16 Years In Prison, Donald E. Wilkes Jr.

Popular Media

Since 1973 a total of 114 innocent persons sentenced to death in 25 states have been exonerated and released from death row, many after being imprisoned for a decade or more, and some after narrowly avoiding execution by only a few days. (Five of the exonerees--Jerry Banks, Earl Charles, James Edward Creamer, Gary X. Nelson, and Robert Lewis Wallace--were Georgia death row inmates.) In addition, since 1989 no less than 138 innocent convicted persons (including some of the 114 death row exonerees) have been exonerated and released from prison due to the efforts of the New York-based Innocence Project, a …

Immaturity, Normative Competence, And Juvenile Transfer: How (Not) To Punish Minors For Major Crimes, David O. Brink Jan 2004

Immaturity, Normative Competence, And Juvenile Transfer: How (Not) To Punish Minors For Major Crimes, David O. Brink

ExpressO

This essay critically examines the national trend to get tough on juvenile crime by making it easier to transfer juvenile offenders to adult criminal court. It assesses this trend in light of different rationales for punishment, arguing that immaturity provides retributive, deterrent, and corrective reasons to punish juvenile crime differently than otherwise similar adult crime. Insofar as retributive concepts determine whom to punish and how much to punish, it is especially important that immaturity involves diminished normative competence and, hence, diminished responsibility. In defending a traditional approach to juvenile criminal justice against the reforms embodied in the transfer trend, the …

Perceptions Of Racial Profiling: Rap Music, Utah, And Police In American Culture, Theresa A. Martinez Jan 2004

Perceptions Of Racial Profiling: Rap Music, Utah, And Police In American Culture, Theresa A. Martinez

Utah Law Review

What about scholars like us who are interested in the methods and the measurement of racial profiling? Will we go to the source itself?. Will we go into the belly of the police department and ask police about their perceptions? Will we go that far? All these steps and more are part of the process of making change. Perhaps we will uncover the hard fact that police perceptions are not so different from those of our white sons and daughters in this nation. But we must look and we must pay close attention; not to do so would be a …

Rethinking Public Engagement In The Administrative State, Mariano-Florentino Cuellar Jan 2004

Rethinking Public Engagement In The Administrative State, Mariano-Florentino Cuellar

ExpressO

This Article presents an empirical, doctrinal, and theoretical critique of public engagement in the modern administrative state. The legitimacy of the administrative state depends on the claim that it provides opportunities for public engagement as well as a mechanism for expert scientific decisionmaking. A typical rulemaking proceeding lets experts make technical judgments about terrorism, transportation, or telecommunications subject to court review guarding against arbitrariness. The whole process is then enmeshed in a system that is supposed to provide engagement – and therefore democratic accountability -- through presidential appointments and control, congressional oversight, and the public notice-and-comment process. This existing approach …

Freeing The Innocent: A Proposed Forensic Evidence Retention Statute To Optiie Utah's Post-Conviction Dna Testing Act For Claims Of Actual Innocence, Ted S. Reed Jan 2004

Freeing The Innocent: A Proposed Forensic Evidence Retention Statute To Optiie Utah's Post-Conviction Dna Testing Act For Claims Of Actual Innocence, Ted S. Reed

Utah Law Review

Since 1993, post-conviction DNA testing has proven itself to be a valuable systemic safeguard against punishing the innocent. Post-conviction DNA testing has now exonerated at least one hundred and forty-three Americans. At least twelve of these exonerated citizens were at one time on death row. Virtually all had exhausted their appeals and post-conviction remedies. Only their serendipitous rescue by DNA testing saved them from execution. Collectively, these one hundred and forty-three innocent Americans served more than 1397 years in prison.
