Chevron Deference And Agency Self-Interest, Timothy K. Armstrong Jan 2004

Chevron Deference And Agency Self-Interest, Timothy K. Armstrong

Faculty Articles and Other Publications

Judicial review of a federal administrative agency's statutory or regulatory interpretation ordinarily proceeds under the highly deferential framework announced in the landmark case of Chevron U.S.A., Inc. v. Natural Resources Defense Council, 467 U.S. 837 (1984). Withholding an independent judicial interpretation of a statute or regulation in deference to an agency's views, however, poses unique problems when the agency has a self-interested stake in its interpretation - as, for example, when the agency's interpretation affects its regulatory jurisdiction or yields a financial benefit to the agency. A review of several cases in which courts have deferred, or refused to defer, …

Semantic Analysis For Monitoring Insider Threats, Svetlana Symonenko, Elizabeth D. Liddy, Ozgur Yilmazel, Robert Del Zoppo, Eric Brown Jan 2004

Semantic Analysis For Monitoring Insider Threats, Svetlana Symonenko, Elizabeth D. Liddy, Ozgur Yilmazel, Robert Del Zoppo, Eric Brown

School of Information Studies - Faculty Scholarship

Malicious insiders’ difficult-to-detect activities pose serious threats to the intelligence community (IC) when these activities go undetected. A novel approach that integrates the results of social network analysis, role-based access monitoring, and semantic analysis of insiders ’ communications as evidence for evaluation by a risk assessor is being tested on an IC simulation. A semantic analysis, by our proven Natural Language Processing (NLP) system, of the insider’s text-based communications produces conceptual representations that are clustered and compared on the expected vs. observed scope. The determined risk level produces an input to a risk analysis algorithm that is merged with outputs …

A Framework For Creating A Facetted Classification For Genres: Addressing Issues Of Multidimensionality, Kevin Crowston, Barbara H. Kwasnik Jan 2004

A Framework For Creating A Facetted Classification For Genres: Addressing Issues Of Multidimensionality, Kevin Crowston, Barbara H. Kwasnik

School of Information Studies - Faculty Scholarship

People recognize and use document genres as a way of identifying useful information and of participating in mutually understood communicative acts. Crowston and Kwasnik [1] discuss the possibility of improving information access in large digital collections through the identification and use of document genre metadata. They draw on the definition of genre proposed by Orlikowski and Yates [3], who describe genre as "a distinctive type of communicative action, characterized by a socially recognized communicative purpose and common aspects of form" (p. 543). Scholars in fields such as rhetoric and library science have attempted to describe and systematize the notion of …

Discerning Emotions In Texts, Victoria L. Rubin, Jeffrey M. Stanton, Elizabeth D. Liddy Jan 2004

Discerning Emotions In Texts, Victoria L. Rubin, Jeffrey M. Stanton, Elizabeth D. Liddy

School of Information Studies - Faculty Scholarship

We present an empirically verified model of discernable emotions, Watson and Tellegen’s Circumplex Theory of Affect from social and personality psychology, and suggest its usefulness in NLP as a potential model for an automation of an eight-fold categorization of emotions in written English texts. We developed a data collection tool based on the model, collected 287 responses from 110 non-expert informants based on 50 emotional excerpts (min=12, max=348, average=86 words), and analyzed the inter-coder agreement per category and per strength of ratings per sub-category. The respondents achieved an average 70.7% agreement in the most commonly identified emotion categories per text. …

Context-Based Question-Answering Evaluation, Elizabeth D. Liddy, Anne R. Diekema, Ozgur Yilmazel

School of Information Studies - Faculty Scholarship

In this poster, we will present the results of efforts we have undertaken to conduct evaluations of a QA system in a real world environment and to understand the nature of the dimensions on which users evaluate QA systems when given full reign to comment on whatever dimensions they deem important.

Ana Castillo, Sara L. Spurgeon Jan 2004

Ana Castillo, Sara L. Spurgeon

Western Writers Series Digital Editions

It may seem odd to call Ana Castillo a western writer, considering she has lived most of her life in Chicago. Geographically, this city would not generally qualify as “western.” But the images, tensions, and themes that drive Castillo’s work are the same that currently challenge traditional definitions of the “west” as a place bounded strictly by geography. Historically, of course, Chicago at one time imagined itself as the prototypical western city, but the frontier moved on, and with it the American notion of what the west was, where it was located, what it looked like, and who inhabited it. …

Using Symbolic Knowledge In The Umls To Disambiguate Words In Small Datasets With A Naive Bayes Classifier, Gondy Leroy, Thomas C. Rindflesch Jan 2004

Using Symbolic Knowledge In The Umls To Disambiguate Words In Small Datasets With A Naive Bayes Classifier, Gondy Leroy, Thomas C. Rindflesch

CGU Faculty Publications and Research

Current approaches to word sense disambiguation use and combine various machine-learning techniques. Most refer to characteristics of the ambiguous word and surrounding words and are based on hundreds of examples. Unfortunately, developing large training sets is time-consuming. We investigate the use of symbolic knowledge to augment machine-learning techniques for small datasets. UMLS semantic types assigned to concepts found in the sentence and relationships between these semantic types form the knowledge base. A naïve Bayes classifier was trained for 15 words with 100 examples for each. The most frequent sense of a word served as the baseline. The effect of increasingly …

National Stereotypes In Teaching English As A Foreign Language, Radmila Popovic Jan 2004

National Stereotypes In Teaching English As A Foreign Language, Radmila Popovic

MA TESOL Collection

This thesis explores how to deal with lexically encoded national stereotypes in the second language classroom. I address this question starting with previous research on stereotypes, and discussing a principled approach to interrelating insights from a variety of paradigms and disciplines. Then I shift to the linguistic analysis of nationality words in English - phrases, idioms and proverbs, as well as connotations which these lexical items are capable of developing in certain contexts. Finally, I consider the implication of the findings for foreign language teaching, and suggest a pedagogical model for dealing with stereotypes in the language classroom.

Reflections On My Nepali Language Learning Experience While In The American Peace Corps In Nepal, 2001 - 2003, Eloy Guzman

MA TESOL Collection

This paper examines my experience during my two years as a Peace Corps volunteer in Nepal (2001-2003) learning the Nepali language. I reflect on my process of learning Nepali, which involved drawing on connections between this language and the two other languages I speak – Spanish and English. I also examine the social aspects of my learning this language while living and working as an ESL teacher in a small rural mountain village in Eastern Nepal. This self-reflection on my language learning experience has informed my understanding of how the language learning process is inextricably connected to one’s primary language …

Teaching Adult Efl Learners In Japan From A Japanese Perspective, Patricia Jean Gage Jan 2004

Teaching Adult Efl Learners In Japan From A Japanese Perspective, Patricia Jean Gage

MA TESOL Collection

This paper presents teaching materials that were developed for adult EFL learners in Japan. The author’s primary purpose for developing these materials was to create lessons that would utilize content from a Japanese perspective and the students’ personal interests. The author asserts that students are able to communicate more effectively when the topic and the content of the lessons are familiar to the students. Developed around topics chosen by the students, these lessons contain anecdotes written by the students along with activities that integrate listening, reading, speaking, and writing. The five lessons and the rationale for designing them are included …

We Talk Too Much: Quantitative And Qualitative Aspects Of Teacher Talk, Lynn Corwin Jan 2004

We Talk Too Much: Quantitative And Qualitative Aspects Of Teacher Talk, Lynn Corwin

MA TESOL Collection

This paper is one teacher’s exploration of teacher talking time. As a language teacher the author understands that teacher talk is an essential tool of the trade and critical to the language learning process. However, she recognized that talking too much could be a problem. This paper describes the journey the author took to understand how and when to talk in the classroom. The author provides reasons and examples of why teacher silence can sometimes be more effective than talking. Throughout the paper, she focuses on the power of silence in the classroom when the teacher values it and when …

Promoting Language And Culture Learning In An Efl Context, Laura Anne Battles Jan 2004

Promoting Language And Culture Learning In An Efl Context, Laura Anne Battles

MA TESOL Collection

This Independent Professional Paper (IPP) describes the intercultural communication project I undertook during my Interim Year Teaching Practicum (IYTP) in Granada, Spain. Throughout the academic year of 1998-1999, English-speaking students enrolled in the University of Granada’s Spanish Language and Culture Courses were invited to participate as volunteer language and culture exchange partners with my Spanish-speaking, intermediate-level English as a Foreign Language students. These classroom experiences, designed to enrich the course’s speaking, reading, writing, and listening curriculum, were intended to stimulate authentic communication and to heighten personal and intercultural awareness among the participants.

The argument presented in this paper is that …

The Din Theory Revealed: Theoretical, Professional, And Personal Reflections Concerning The Socialization Of Language, Dana Elise Arends Jan 2004

The Din Theory Revealed: Theoretical, Professional, And Personal Reflections Concerning The Socialization Of Language, Dana Elise Arends

MA TESOL Collection

This paper is a written analysis of my personal experience with the "din in the head" theory proposed by Dr. Elizabeth Barber and Dr. Stephen Krashen (Barber 1980; Krashen 1981). I experienced this din firsthand during a three day trip to Montreal, Quebec in Canada and a subsequent three day trip to Roma, in Italia. I will propose that the language din suggested by professors Barber and Krashen does exist. Furthermore, I will show how the Spanish din with which I had become familiar with from my classes at the School for International Training hindered, and at times prohibited, my …

This dissertation is about English articles and specifically the difficulties that non-native speakers, particularly Japanese learners, face in mastering their use. In this dissertation, I will mainly focus on;

1. An investigation on teaching articles and the use of articles including a survey completed by teachers of English

2. Two charts for determining articles and categories with examples including my adaptation of the chart

3. Some ideas and practical suggestions for teaching articles

The findings from this study have led me to a belief that there are ways for Japanese learners to improve their ability to use articles and by …

English Language Learners, Comprehensive School Reform, And State Education Agencies: An Overlooked Opportunity To Make Comprehensive School Reform Comprehensive, Edmund T. Hamann, Ivana Zuliani, Matthew Hudak Jan 2004

English Language Learners, Comprehensive School Reform, And State Education Agencies: An Overlooked Opportunity To Make Comprehensive School Reform Comprehensive, Edmund T. Hamann, Ivana Zuliani, Matthew Hudak

Department of Teaching, Learning, and Teacher Education: Faculty Publications

After verifying that the federally supported Comprehensive School Reform Demonstration (CSRD) program schools in the 7 states studied had a disproportionately high English Language Learner (ELL) population, we examined the understandings and guidance about ELLs that was included by those states’ state education agencies (SEAs) in the policy documents that they generated for CSRD. Specifically, we looked at the CSRD plans that SEAs submitted to the U.S. Department of Education and at the first requests for proposals they circulated to schools. In those documents, we found little recognition of the dichotomy identified by Miramontes, Nadeau, and Commins (1997) between school …

The Hegemony Of The Copyright Treatise, Ann Bartow Jan 2004

The Hegemony Of The Copyright Treatise, Ann Bartow

Law Faculty Scholarship

This Article asserts that major conceptions about the appropriate structure, texture, and span of copyright protections and privileges have been fashioned by copyright treatises, particularly the various editions of Nimmer on Copyright. Copyright treatises function in concert with the machinations of Congress, the courts, and custom, but their role is not often scrutinized.

Because copyright treatises typically do a far better job than Congress or the courts of explicating copyright law in straightforward and accessible language, such treatises can not only communicate the copyright law, but also influence its development and direction. Policy makers no doubt understand that content owners …

On Reflection, James Anthony Gibbons Jan 2004

On Reflection, James Anthony Gibbons

Shannon Research Press

This book commences with a criticism of constructivism as the basis for curriculum design followed by an attempt to argue an alternative. It is possible to proceed to criticise constructivism as the basis for curriculum design by illustrating the issues with references to extracts from curricula used by various countries and Departments of Education. This book takes a different route. The assumption is made that criticism will be clearer if related to a substantial part of a curriculum rather than extracts from a variety of curricula from a variety of countries. The focus is on the recently developed, and currently …
