The Fable Of Federal Environmental Regulation: Reconsidering The Federal Role In Environmental Protection, Jonathan H. Adler

Cleveland was the site of one of the seminal events in environmental history. On the morning of June 22, 1969, a stray spark ignited oil and debris on the surface of the Cuyahoga River. The resulting fire attracted relatively little local attention in Cleveland, but became a national event. Subsequently, Time, National Geographic, and The New York Times all wrote about the fire. It even inspired a song by Randy Newman. By many accounts, it lit the spark that led to the passage of the Federal Clean Water Act.

Statutory Interpretation In Econotopia, Nathan B. Oman

Much of the debate in the recent revival of interest in statutory interpretation centers on whether or not courts should use legislative history in construing statutes. The consensus in favor of this practice has come under sharp attack from public choice critics who argue that traditional models of legislative intent are positively and normatively incoherent. This paper argues that in actual practice, courts look at a fairly narrow subset of legislative history. By thinking about the power to write that legislative history as a property right and legislatures as markets, it is possible to use Coase's Theorem and the concept …

The topics of change, development and globalization are extremely pertinent to modern-day Samoa. The past ten years have lead to a vast increase in the inter-connectedness of Samoa to the world economically, socially, and culturally. This paper uses McDonald’s as a representation of the globalization occurring in Samoa in order to better understand the real impacts of these abstract terms. Indigenous Healing Practices And Their Effect On Tb And Hiv/Tb Patients’ Utilization And Compliance With Anti-Tb Medication, Josephine Thinwa

A sample of 27 Tuberculosis patients attending New Brighton Clinic in small urban community for treatment were surveyed and interviewed on their use of alternative treatments and interpretation of TB. This study specifically focused on TB patients’ use of traditional medicine in treating TB and whether this use had an effect on the patients’ willingness to utilize and adherence to anti-TB treatment from the clinic. Investigations were also done to characterize if an HIV positive status influenced TB patients’ inclination to utilize traditional medicine. Managing The Commons Through Obligation: Communality In The Sierra Juárez Of Oaxaca, Katie Moyer

As one of the most ethnically, culturally, and biologically diverse states in the Mexican Republic, Oaxaca proved to be a good location to learn about alternative forms of social organization. With 570 municipalities, Oaxaca has 23% of the municipalities in the entirety of Mexico. The vast majority of Oaxaca’s municipalities—480—are politically and socially organized through communality, a traditional form of self-government widely known as usos y costumbres (uses and customs). Within the four weeks allotted for this research project the majority of my time was spent in the Northern Sierra Juárez in the state of Oaxaca.

In this paper, I hope to explore Irish reactions to multi-culturalism through the highly controversial citizenship referendum. This referendum, through which the twenty-seventh amendment to the Irish Constitution will be made, is fundamentally changing Ireland’s citizenship policy from one of jus soli and jus sanguinis to one of just jus sanguinis. This change has been made amid current inflows of immigrants, many of whom are racially distinct and come from a variety of cultural backgrounds. One of the most revolutionary legal changes in the past generation has been the “propertization” of intellectual property (IP). The duration and scope of rights expand without limit, and courts and companies treat IP as absolute property, bereft of any restraints. But astonishingly, scholars have not yet recognized that propertization also can lead to the narrowing of IP. In contrast to much of the literature, which criticizes the propertization of IP, this Article takes it as a given.
