Communication Studies Faculty Works
This case study examines the context of and reaction to the uncovering of singer Janet Jackson's breast during the broadcast of the 2004 Super Bowl halftime show. Using a select thick reading of the event and its coverage, the analysis focuses on: a) the construction of the event by its organizational stakeholders, b) the reconstruction of understandings about how the fiasco came to be and what really happened and should have happened, and c) the deconstruction of the event by critics and those in the political environment who had reason to consider the incident and the. response to it in …
Solving Problems Vs. Claiming Rights: The Pragmatist Challenge To Legal Liberalism, William H. Simon
Solving Problems Vs. Claiming Rights: The Pragmatist Challenge To Legal Liberalism, William H. Simon
William & Mary Law Review
Recent developments in both theory and practice have inspired a new understanding of public interest lawyering. The theoretical development is an intensified interest in Pragmatism. The practical development is the emergence of a style of social reform that seeks to institutionalize the Pragmatist vision of democratic governance as learning and experimentation. This style is reflected in a variety of innovative responses to social problems, including drug courts, ecosystem management, and "new accountability" educational reform. The new understanding represents a significant challenge to an influential view of law among politically liberal lawyers over the past fifty years. That view, Legal Liberalism, …

Muss Es Sein? Not Necessarily, Says Tort Law, Anita Bernstein
Law and Contemporary Problems
The rule of law helps to check tendencies to excess, aligns remedies with what happened to similarly situated persons in the past, and give both power and accountability to public officials. Asserting its perpetual demand of Muss es sein? in reaction to oppressions, tort law jolts stais into change.

Corporate Law Or The Law Of Business?: Stakeholders And Corporate Governance At The End Of History, Adam Winkler
Law and Contemporary Problems
Surely, corporate managers themselves, who must operate within the broader law of business, are aware of the legally imposed duties to protect workders, consumers, and larger communities. Perhaps it is time corporate lawyers caught up to this reality.

The Medicare Prescription Drug, Improvement, & Modernization Act Of 2003: Are We Playing The Lottery With Healthcare Reform?, Melissa Ganz
Duke Law & Technology Review
With millions of Americans unable to cope with the rising costs of prescription drugs, and many even forced to go without health insurance, the mounting pressure on Congress to enact major healthcare reform culminated in the Medicare Prescription Drug, Improvement, & Modernization Act of 2003. This iBrief examines this legislation, and concludes that it provides elusive benefits for seniors and merely creates a windfall for the pharmaceutical and insurance industries.

Civil-Military Cooperation In Peace Operations: The Case Of Kosovo, Thomas R. Mockaitis Dr.
Civil-Military Cooperation In Peace Operations: The Case Of Kosovo, Thomas R. Mockaitis Dr.
Books, Monographs & Collaborative Studies
The humanitarian intervention in Kosovo provides an excellent case study of civil-military cooperation (CIMIC) in peace operations. The intervention required 40,000 heavily armed combat troops from NATO and Partnership for Peace countries to provide security and coordinate relief efforts with the UN, the OSCE, and over 500 humanitarian organizations. CIMIC provided the mechanism for such cooperation and support. Like any concept employed in coalition warfare, CIMIC varied widely in the quality of its application. This study examines the effectiveness of CIMIC within each brigade area and throughout the province as a whole. It identifies best practices and common mistakes to …

Sex Differences In Video Game Play: A Communication-Based Explanation, Kristen Lucas, John L. Sherry
Department of Communication Studies: Faculty Publications
In this study, we examined gender differences in video game use by focusing on interpersonal needs for inclusion, affection, and control, as well as socially constructed perceptions of gendered game play. Results of a large-scale survey (n = 534) of young adults’ reasons for video game use, preferred game genres, and amount of game play are reported. Female respondents report less frequent play, less motivation to play in social situations, and less orientation to game genres featuring competition and three-dimensional rotation. Implications for game design are discussed.

Johne’S Disease, Inflammatory Bowel Disease, And Mycobacterium Paratuberculosis, Ofelia Barletta-Chacon, Luiz E. Bermudez, Raúl G. Barletta
School of Veterinary and Biomedical Sciences: Faculty Publications
Johne’s disease is a chronic diarrhea affecting all ruminants. Mycobacterium avium subsp. paratuberculosis (MAP), a slowly growing mycobacteria, is the etiologic agent. There is also a concern that MAP might be a causative agent of some cases of inflammatory bowel disease in humans, especially Crohn’s disease. Food products including pasteurized bovine milk have been suggested as potential sources of human infection. This review addresses microbial factors that may contribute to its pathogenicity. In addition, the experimental evidence defining MAP as the cause of Johne’s disease and the issues and controversies surrounding its potential pathogenic role in humans are discussed.

Isolation Versus Quarantine And Alternative Measures To Control Emerging Infectious Diseases, Fahad A. Al-Ateeg
Saudi Medical Journal
In the past 25 years, the world has witnessed the emergence and re-emergence of many infectious diseases. In the early stages of their emergence, isolation and quarantine may be the only and last resort to effectively control infectious diseases when we are confronted with limited or no knowledge of a newly identified and previously unknown contagious disease, which causes a serious public health threat either locally or internationally. The article traces back the origins of isolation and quarantine; defines precisely the terms isolation and quarantine as they are currently used in the modern era; compare and contrast these terms; identifies …

OBJECTIVE: Organ transplantation is successful. The main challenge in the Kingdom of Saudi Arabia (KSA) and elsewhere continues to be organ shortage. This shortage was not resolved by utilization of living donors. Previous studies indicate that there is underreporting of brain death cases, lack of completion of documentation process, poor medical care in some instances and finally high refusal rate for consent. In order to put this problem in perspective and find a solution, we initiated a collaborative project between 4 hospitals in Riyadh, KSA and The Saudi Center for Organ Transplantation. The initial result of this project is presented …
