"What's Love Got To Do With It?" "It's Not Like They're Your Friends For Christ's Sake": The Complicated Relationship Between Lawyer And Client, Robert J. Condlin

Should lawyers love their clients and try to be their friends? Scholars have defended the “lawyer-as-friend” analogy, but usually they have relied on a more contractual understanding of friendship compatible with traditional concepts of adversary advocacy. I will discuss lawyer-client relationships by examining two generations of scholarly argument for the lawyer-as-friend view, and a description of the approach in operation in an actual legal case. These discussions show in detail what sorts of questions a lawyer-as-friend takes up, how he or she divides or shares representational tasks with clients differently from lawyers who use more traditional approaches to legal representation, …

Electrospray ionization and collision induced dissociation on a triple quadrupole mass spectrometer were used to determine the effect of spatial crowding of incremented alkyl groups of two anomeric pairs of peralkylated (methyl to pentyl) disaccharides (maltose/cellobiose and isomaltose/gentiobiose). Protonated molecules were generated which underwent extensive fragmentation under low energy conditions. For both the 1 → 4 and 1 → 6 α and β isomers, at comparable collision energies the methyl derivative exhibited the least fragmentation followed by ethyl, propyl, butyl, and pentyl. Collision energy is converted to rotational-vibrational modes in competition with bond cleavage, as represented by the slope of …

Background: Epidemiologic studies show that sudden surges in ambient particulate matter (PM) levels can trigger acute asthma exacerbations. Although diesel exhaust particles (DEPs) act as an adjuvant for allergic sensitization, this is a delayed response and does not explain acute PM effects on airway hyperreactivity (AHR). Objective: Our aim was to determine the acute effects of DEPs on AHR using a mouse model. Methods: Three protocols were developed, 2 of which require OVA sensitization, whereas the third was OVA independent. In the mild sensitization protocol BALB/c mice receive intraperitoneal OVA without alum and are then challenged with aerosolized OVA with …

Movement And Spatial Population Structure Of A Prairie Planthopper, James T. Cronin

The transfer of organisms among patches is a key process influencing the spatial structure and regional dynamics of a population; yet, detailed experimental studies of animal movement among patches are uncommon. I performed a series of mark-recapture studies to quantify the movement of a planthopper, Prokelisia crocea (Hemiptera: Delphacidae), among discrete patches of its host plant, prairie cordgrass (Spartina pectinata). Results from these dispersal studies were used to predict the natural distributions and to characterize the spatial population structure of P. crocea. Planthopper emigration loss per patch increased linearly with the density of female conspecifics and was nonlinearly related to …

Objective: Interest in mapping genetic variants that are associated with obesity remains high because of the increasing prevalence of obesity and its complications worldwide. Data on genetic determinants of obesity in African populations are rare. Research Methods and Procedures: We have undertaken a genome-wide scan for body mass index (BMI) in 182 Nigerian families that included 769 individuals. Results: The prevalence of obesity was only 5%, yet polygenic heritability for BMI was in the expected range (0.46 ± 0.07). Field and laboratory studies evaluated the influence of selected crop hosts on Helicoverpa zea (Boddie) population dynamics in relation to genetically engineered Bt (Bollgard) and non-Bt cottons. Host specific H. zea colonies were initiated with a colony originally collected from sweet corn. The colony was allowed to complete one generation on meridic diet then split into cohorts and allowed to complete one generation on field corn, grain sorghum, soybean, cotton, or meridic diet in individual 29.5 ml plastic cups. Terpene-Induced Morphological Changes To Exoskeleton Of Formosan Subterranean Termites (Isoptera: Rhinotermitidae): Toxic Effects Of Cis-Nerol, Betty C.R. Zhu, Gregg Henderson, Huixin Fei, Xiao Ying, Roger A. Laine

The terpenoid, cis-nerol was found to be highly toxic to the Formosan subterranean termite, Coptotermes formosanus Shiraki. Morphological abnormalities were observed in the exoskeleton including the spiracles and trichoid sensilla using scanning electron microscopy after exposure of termites to cis-nerol for 2 h. Proteins were found in a water-soluble fraction collected from the whole termite body exposed to cis-nerol for 60 min. It appears that terpenoids cause damage to cell membranes resulting in a significant loss of proteins.

The transfer of a person's assets after death has been an important element in the law beginning with the Magna Carta, and is firmly rooted in American jurisprudence. Defining children and heirs for probate purposes remains a difficult issue. In particular, the determination of children and heirs in an age when the birth of “illegitimate” children is common makes the proper and just determination of heirship a recurring and timely topic. We used bal and nocturnal zooplankton collections at 30 sites in the Atchafalaya River Basin (ARB) floodplain (Louisiana) to assess inter-habitat differences in diel vertical movements of numerically abundant cladocerans and copepods during the flood pulse. The magnitude of diel movement at each site was quantified with an index of vertical migration (VM)=log (nocturnal abundance+1)—log (diurnal abundance+1), and sites were grouped into lake (n=12), channel (n=9), and swamp (n=9) habitats based on principal components analysis of physicochemical characteristics. The cladocerans Diaphanosoma birgei and Moina micrura and the copepods Mesocyclops edax, Eurytemora affinis, and Acanthocyclops vernalis all exhibited siecantly greater VM …

Seasonal changes in food choice by migratory birds often reflect changes in relative food abundance and increased energetic demand. Hermit Thrushes (Catharus guttatus) in southeastern Louisiana are highly frugivorous during winter but forage exclusively on arthropods just prior to spring migration. We hypothesized that this switch to an exclusively arthropod diet would lead to an increase in fat reserves compared to a frugivorous diet, and that fat birds would initiate migration sooner and display more migratory activity than lean birds. Colony size and reproductive status of Solenopsis invicta (Buren), red imported fire ants, is measured by a rating system developed by Harlan et al. (1981). Because this rating system is commonly used to evaluate chemical controls, especially insect growth regulators, and biological controls such as Thelohania spp., we evaluated the environmental conditions that would affect mound ratings in Louisiana. Increases in relative humidity and mound height were associated with population rating increases. Brood presence in the above ground portion of the nest (mound) was strongly associated with mound temperature. Brood was only found in mounds that had soil temperatures between …

What one believes about origins is a significant component of an overall worldview. An ongoing study at Liberty University is being conducted to define and measure a creationist worldview while determining factors that influence the beliefs and attitudes about origins in a Christian college student population. The Creation Worldview Test (CWT) was administered before and after completion of a required apologetics course. Previous attendance at a creation seminar or course was associated with a stronger initial creation worldview, however prior completion of a college science course appeared to have no impact.
