Obviousness is one of the most litigated elements of patent of validity, due primarily to the enormous gray area between the roles of judge and jury. While obviousness is ultimately a legal question, the courts make an effort to leave the underlying factual determinations to the jury, with mixed results. McGinley v. Franklin Sports, Inc. illustrates the problems with the Court of Appeals for the Federal Circuit’s current approach as to what role juries and district court judges should play in determining obviousness of a patent. The current state of health and biomedicine includes an enormity of heterogeneous data ‘silos’, collected for different purposes and represented differently, that are presently impossible to share or analyze in toto. The greatest challenge for large-scale and meaningful analyses of health-related data is to achieve a uniform data representation for data extracted from heterogeneous source representations. Based upon an analysis and categorization of heterogeneities, a process for achieving comparable data content by using a uniform terminological representation is developed. The debate about creating so-called intellectual property (“IP”)--legal monopolies--over indigenous information (a product mostly of Third World countries) is habitually (almost stereotypically) characterized by qualifications that such monopolies really don't fit, and further qualifications that although they don't fit they are the best alternative. But underlying both sets of qualifications is often a confusion about what the real problem is. Because of a frequent failure to analyze closely the problem (and sometimes because of misinformation mixed with an unhealthy dose of romanticism), critics far too often jump to the legal monopoly solution to problems that ironically may be in large …

Search of international DNA database, Genbank, produced eight barley cDNA EFlα sequences with unique accession numbers. The length of these sequences varied from an incomplete 502 bp to a full length 1646 bp encoding a 447 amino acid protein. The knowledge that there are four EF-lα gene family members in barley led us to query whether all four genes were represented in the group of eight database submitted sequences. Also of great importance was the correct assignment of gene family member to its mRNA and protein expression profiles. Before we could begin to address the expression studies, we undertook the …

The 1-adrenoceptors (1-ARs) serve as an interface between the sympathetic nervous system and the cardiovascular system where they are mediators of systemic arterial blood pressure, initiators of positive inotropy, and regulators of cellular growth responses. There are three subtypes: 1A-, 1B-, and 1D-ARs. This dissertation research investigated the trafficking properties of the 1-ARs at the cellular level as well as physiological relevance of the 1-ARs at the tissue level. In vitro studies using transiently transfected 1-AR/GFP subtypes revealed distinct basal localization patterns and different agonist-mediated activation and desensitization properties. A Comparison Of Learning Styles Among Seven Health Professions: Implications For Optometric Education, Patrick C. Hardigan, Stanley R. Cohen

Educational research and development efforts are most often directed at the improvement of teaching while neglecting students’ learning styles. Besides being marginally effective, an exclusive focus on improving teaching methods may lead to reinforcement of inappropriate and nontransferable learning strategies. As such, this study is being undertaken to determine if differences in personality style exist among health profession students. This retrospective-descriptive study tested the null hypothesis “there is no difference in personality traits between osteopathic medicine, pharmacy, physical therapy, physician assistant, dental medicine, optometry and occupational therapy students.” Differences as well as similarities were discovered across all seven professions. Feral hogs (Sus scrofa) recently have been introduced to Illinois. They are important to resource managers because of their potentially negative ecological and economic impacts. We assessed the distribution, habitat use, and body morphology of feral hogs in Illinois. We confirmed the occurrence of feral hogs in Fulton, Hardin, Johnson, Lawrence, Massac, Pope, Randolph, and Union counties. Forest and croplands probably are the most important habitats for feral hogs in Illinois. We found free-ranging hogs in Illinois included four previously described morphotypes with distinguishable physical/cranial characteristics: domestic hogs, feral hogs, hybrids, and Eurasian wild hogs. Chronic wasting disease (CWD), a fatal transmissible spongiform encephalopathy of deer (Odocoileus spp.) and elk (Cervus elaphus), presents a challenge to wildlife managers because little is known about its transmission, yet it could severely threaten wildlife populations if action is not taken rapidly. Published mathematical models predict that CWD could devastate populations of free-living deer and elk, prompting wildlife managers to attempt large-scale eradication of deer in hopes of containing CWD outbreaks. Our objective is to critically examine the theoretical and empirical support for current models of CWD epizootiology, in light of herd health-management actions. We identify …

This paper is based on a research project carried out to study the collection and marketing status of morels in the remote HinduKush-Himalayan regions of Utror and Gabral, Pakistan. Eight species of morels were found to be collected in the project area during the months of March to July. Morchella conica and Morchella esculenta were the major species collected in the area. These morels are sold in the local markets of Madyan and Mingora, from where they are exported to France, Belgium, Switzerland, Austria and Germany. Medicinal herbs constitute an effective source of traditional (Ayurvedic, Unani and Homeopathy) and modern medicine. The plant is a biosynthetic laboratory, not only for chemical compounds, but also a multitude of compounds like glycosides, alkaloids etc. These exert physiological and therapeutic effect. The compounds that are responsible for medicinal property of the drug are usually secondary metabolites. Alkaloids, glycosides, neutral principles, resins, oleoresins, sesquiterpene lactones are some of the common active constituents of medicinal herbs.
