Model State Land Use Legislation For New England, New England Environmental Finance Center, Muskie School Of Public Service
Model State Land Use Legislation For New England, New England Environmental Finance Center, Muskie School Of Public Service
Legislation
Sprawl is neither the ordained nor the inevitable outcome upon the New England landscape. A coordinated response to sprawl by the public and private sectors is possible, and could dramatically improve land use patterns and reduce the cost of local government. For the New England states, such a response would include, among other elements, legislation to eliminate existing gaps in the land use laws of each state – gaps that presently encourage or sanction sprawling development. It would also include incentives for municipalities to think beyond their borders and to act with greater efficiency and effect. It is the purpose …
Parental Understanding Of Miranda Rights, Abby Callis
Parental Understanding Of Miranda Rights, Abby Callis
Masters Theses & Specialist Projects
The current research focuses on parents' level of understanding of Miranda rights and parents' likelihood of encouraging their teenagers to waive their Miranda rights. The previous research suggests that parents alone may not adequately protect juveniles' rights during interrogation and waiver. Prior research also suggests that parents' and juveniles' past experience with the justice system may not help them during their current interrogation and waiver. A 17-item questionnaire was used to assess the two dependent variables and the two independent variables. The two dependent variables were parents' understanding of Miranda rights and parents' likelihood of encouraging arrested teens to waive …

The chance to view wildlife draws millions of visitors each year to the national parks of North America. The combination of a large number of people and abundant wildlife leads to a variety of wildlife-human interactions. In this paper we explore the nature of those wildlife-human interactions, theoretical frameworks social scientists are using to understand those interactions, and approaches used by national parks across North America to manage those interactions.

Court Review: Volume 40, Issue 2 - Judicial Report On The Adjudication And Sanctioning Of Hard-Core Drinking Drivers, Robyn Robertson, Herb Simpson
Court Review: Journal of the American Judges Association
Impaired driving is the most frequently committed crime in America. It has been an issue of debate and concern for the judiciary, as courtrooms across the country hear cases involving a majority of the 1.4 million annual DWI arrests. Since the early 1980s, concerned citizens have lobbied for and won considerable changes to the way these cases are approached from a public-policy perspective, often resulting in legislative initiatives and changes in criminal practice. Until now, however, little comprehensive research has been conducted on the implications of these system-wide changes for criminal justice professionals. In December 2002, the Traffic Injury Research …

Court Review: Journal of the American Judges Association
In criminal cases, this term of the United States Supreme Court had several important decisions, but no landmark cases. The Court continued to favor law enforcement. One significant development was the substantial impact of section 2254(d) of the Anti-terrorism and Effective Death Penalty Act is having in closing the door of federal courts to state prisoners petitioning for the writ of habeas corpus. Here are several of the important criminal decisions decided this term.

Restricting The Flow Of Funds From U.S. Charities To International Terrorist Organizations - A Proposal, Mindy Herzfeld
Restricting The Flow Of Funds From U.S. Charities To International Terrorist Organizations - A Proposal, Mindy Herzfeld
UF Law Faculty Publications
This paper argues that the Internal Revenue Service should take a more active stance in denying tax exemption to organizations that finance terrorist activities abroad. The paper explores the well-established principle that organizations granted U.S. tax-exemption must act consistently with national public policy, and the application of that principle to charitable organizations that send monies overseas. To foster that policy, the Service should apply special guidelines to charitable organizations that channel contributions abroad, similar to the special guidelines in effect for tax-exempt private schools. In addition, legislative changes should be made to advance such a goal in order to provide …
Economic Currents: The State Of The State Economy, Alan Clayton-Matthews
Economic Currents: The State Of The State Economy, Alan Clayton-Matthews
Public Policy and Public Affairs Faculty Publication Series
The state economy appears poised for future growth, but serious issues remain. The “unwinding” of the economic excesses of the 1990s is delaying a genuine economic turnaround, but many other issues are weighing heavily on the economy. These include the risk of terrorism, weak global economic performance, a weak dollar (this issues cuts two ways), and the threat of deflation. When a recovery arrives, job growth will probably lag, and be modest when it appears. We should not expect to return to the heady days of the late 1990s anytime soon.

Civic service is a long-term, intensive form of volunteering. This article reports on a global assessment of civic service, which identified 210 programs in 57 countries. Program goals and administrative partnerships suggest that civic service is a social development intervention. For civic service to achieve its potential, research is recommended regarding server inclusivity, goal accomplishment, and the nature and effect of partnerships.

Community Leaders' Perceptions Of University And College Efforts To Encourage Civic Engagement, Richard A. Brisbin Jr., Susan Hunter
Community Leaders' Perceptions Of University And College Efforts To Encourage Civic Engagement, Richard A. Brisbin Jr., Susan Hunter
Civic Engagement
"Students who volunteer in the community often end up staying or coming back after they graduate because they find out they can make a difference;' reports one economic development director in West Virginia. He and other community leaders agreed that getting college students involved in community activities not only had short-term benefits for the community but that often their experiences led to long-term gains for community life. This finding is important in a time when scholars, politicians, and pundits argue that a crisis of civic disengagement affects American politics. As a partial remedy for this crisis, educators have linked partnerships …

Acquisition And Deacquisition Of Museum Collections And The Fiduciary Obligations Of Museums To The Public, Patty Gerstenblith
Cardozo Journal of International and Comparative Law
The article examines the legal and ethical implications of museums' restitution of stolen or looted cultural artifacts, arguing that such restitutions do not violate fiduciary obligations but highlight the importance of proper acquisition and deaccessioning policies. It emphasizes that museums, as nonprofit entities, must balance their educational mission with legal and ethical duties, ensuring transparency and accountability in managing cultural heritage.

Foreword: The Political Geography Of Race Data In The Criminal Justice System, Andrew E. Taslitz
Law and Contemporary Problems
Several months ago, there was a heated discussion on CrimProf, the listserv for criminal law professors, about the disproportionate representation of minorities in the criminal justice system. Few participants in this online discussion contested the reality that racial and ethnic minorities, especially African Americans, make up a far larger percentage of those arrested and incarcerated than should be expected from their percentage of the country's total population.
Study Habits: Probing Modern Attempts To Assess Minority Offender Disproportionality, Sharon L. Davies
Study Habits: Probing Modern Attempts To Assess Minority Offender Disproportionality, Sharon L. Davies
Law and Contemporary Problems
Oregon, Washington and Utah have recently taken empirical steps to assess the extent to which minorities are overrepresented in their respective criminal justice systems and to seek out the root causes of any overrepresentation observed. Davies contrasts and critiques the disparate analytical approaches utilized by these states and offers some thoughts about how people might improve the chances of success of future similar efforts.
Ethical Impact Of Changes In Health Care On The Role Of Medicine In Society And The Physician - Patient Relationship, Albert Simon
Ethical Impact Of Changes In Health Care On The Role Of Medicine In Society And The Physician - Patient Relationship, Albert Simon
Internet Journal of Allied Health Sciences and Practice
Patients contact a myriad of different health care personnel in their trek through the American health care system. In the 1950s on the numerous TV shows about medicine, it was easy to discern “who was who” in the health care cast of characters in these portrayals. The physicians, like Dr. Kildare, were always male, clean cut and serious looking. Nurses wore starched white dresses with nursing caps and distinctive pins; they instantly obeyed the doctor’s orders (including the one to make the doctor a cup of coffee). For better or worse it is a different world now than it was …
