Fair And Reasonable Compensation Means Just That: How § 253 Of The Telecommunications Act Preserves Local Government Authority Over Public Rights-Of-Way, Jennifer Amanda Krebs Aug 2003

Fair And Reasonable Compensation Means Just That: How § 253 Of The Telecommunications Act Preserves Local Government Authority Over Public Rights-Of-Way, Jennifer Amanda Krebs

Washington Law Review

Section 253(c) of the 1996 Telecommunications Act expressly preserves local government authority to require fair and reasonable compensation from telecommunications providers for use of public rights-of-way. Although local government authority to require compensation for franchises is based in state law, some courts have overlooked state law when evaluating the validity of franchise fees. In addition, courts have interpreted § 253(c) narrowly, allowing local governments to recover only direct costs. This narrow interpretation of § 253(c) contradicts its text and legislative history, as well as analogous United States Supreme Court precedent. Further, this interpretation could lead to unconstitutional results, by allowing …

Strengthening Historic Covered Bridges To Carry Modern Traffic, Rex A. Cyphers Aug 2003

Strengthening Historic Covered Bridges To Carry Modern Traffic, Rex A. Cyphers

Graduate Theses, Dissertations, and Problem Reports (ETD)

The focus of this study was to develop means and methods to strengthen timber superstructural components of historic covered bridges using Glass Fiber Reinforced Polymer (GFRP) composite materials. The strengthening methodologies developed during this research project were designed to conform to the Secretary of the Interior's Standards for the Treatment of Historic Properties. More specifically, tension and bending tests were conducted to establish bond strength of GFRP rebars embedded in wood, and to establish bending strength and stiffness of large-scale beams reinforced with GFRP pultruded plates, and GFRP rebars. The GFRP rebars were developed to be used specifically as reinforcing …

Undercutting Premises Liability: Reflections On The Use And Abuse Of Causation Doctrine, Julie Davies Aug 2003

Undercutting Premises Liability: Reflections On The Use And Abuse Of Causation Doctrine, Julie Davies

San Diego Law Review

This Article discusses the California Supreme Court’s affirmance of summary judgment for the defendants in Saelzler v. Advanced Group 400, a case in which a victim was attacked on property where she worked because of negligent security measures. Normally, these tort cases are resolved by looking at the element of “duty,” but this case was decided on causation grounds. The author begins by analyzing the Saelzler case and its implications on future litigation. She argues that the decision erodes the balance between judge and jury and conflicts with every goal of tort law, whether corrective, compensatory, or deterrent. The author …

The Bajagua Project: Finding A Solution To The San Diego-Tijuana Sewage Crisis, Ross Campbell Aug 2003

The Bajagua Project: Finding A Solution To The San Diego-Tijuana Sewage Crisis, Ross Campbell

San Diego Law Review

This Comment discusses the problem of raw and partially treated sewage flowing from the Tijuana River into the San Diego region. The author begins by explaining how the problem was created by a population growth in Tijuana and a lack of an adequate sewage system. The author then goes on to discuss historical developments and lessons learned from past attempts to alleviate this problem. Next, the author examines the Bajagua project, an effort to solve the problem by constructing a large secondary treatment in Mexico. The author argues that this is the most comprehensive solution because of the added benefit …

From Theory To Practice: Developing And Implementing An Asset-Building Program For Milwaukee Public Housing Residents, Stephanie Montgomery Jul 2003

From Theory To Practice: Developing And Implementing An Asset-Building Program For Milwaukee Public Housing Residents, Stephanie Montgomery

Student Research – Stevenson Center

Beginning in August 2002, I had the opportunity to complete my Professional Practice in Community Development at the Housing Authority of the City of Milwaukee (HACM), a mid-sized public housing authority, which provides affordable housing to low-income individuals in Milwaukee, Wisconsin, through public housing, rent assistance and homeownership programs. In recent years HACM has shifted its focus away from bricks and mortar (constructing and managing low income housing) towards a more comprehensive strategy, designed to not only provide low income families and individuals with affordable housing, but also assist to residents in achieving long-term economic self-sufficiency and in escaping poverty. …

Falun Gong In The United States: An Ethnographic Study, Noah Porter Jul 2003

Falun Gong In The United States: An Ethnographic Study, Noah Porter

USF Tampa Graduate Theses and Dissertations

Falun Gong, also known as Falun Dafa, has been described in many ways. It has been called qigong, one of many schools of physical exercises that aim at improving health and developing "supernatural abilities". Scholars and mainstream media have referred it to as a "spiritual movement" or religion, although practitioners claim it is not a religion. It has been called a cult, in the pejorative sense rather than in a sociological context, by the Chinese government and by some Western critics. In the writings of Li Hongzhi, the founder of Falun Gong, it is referred to in different ways, …

Advice For The Secretary Of Agriculture About Management Of The Giant Sequoia National Monument, J. N. Clarke, D. M. Graber, K. M. Nissen, D. D. Piirto, N. L. Stephenson, D. R. Tormey, P. E. Waggoner

Natural Resources Management and Environmental Sciences

Landscapes held in public trust are difficult to manage; a living National Monument subject to increased public use presents additional challenges. These landscapes are subject to regional and global effects outside the manager's control, such as global climate change and air pollution. They are also subject to innumerable local variables, most of whose effects are difficult to predict. The giant sequoia groves and their surrounding ecosystem are fiercely loved by many; although the goals may be broadly similar, the objectives and policies of these giant sequoia lovers are often sharply at odds.
