Soul Sisters: Origins And Accomplishments Of A Unique Partnership, Linda L. Lyman Jan 2003

Soul Sisters: Origins And Accomplishments Of A Unique Partnership, Linda L. Lyman

Journal of Women in Educational Leadership

Leadership in poverty schools is essential for success. This article chronicles the partnership of a principal and a speech and language pathologist who have, together and with some angst, brought teachers in the school together to link language development with reading success. Since 1994, Aurther Perkins and Pat Lindberg have refined a program that is based on common beliefs that children can be successful in schools, that poor parents care much about their children's victories at school, and that reading is the key to success in every subject. Clearly, this documentation of a successful collaboration between a content expert and …

Change As The Convergence Of Energies: Using The Lens Of Postmodern Thinking To Examine Change In Higher Education, Linda Hamption Weston, Jeanne Gray Carr Jan 2003

Change As The Convergence Of Energies: Using The Lens Of Postmodern Thinking To Examine Change In Higher Education, Linda Hamption Weston, Jeanne Gray Carr

Journal of Women in Educational Leadership

Post modern thought, in particular dynamic systems theory, offers explanations for the profound era in which we live. Defining myself as an educational leader with a post modern visionary perspective, I have deconstructed a change effort in higher education to demonstrate the developmental process that took place within me when I acted as an educational change agent. As part of this story, I have added the voice of an executive coach, who volunteered her services to the university and worked with me during the second semester of this change effort. This effort is analogous to a river that is constantly …

The Professional In Legal Education: Foreign Perspectives, James Maxeiner

All Faculty Scholarship

Japan is about to change its system of legal education. In April 2004 Japan will introduce law schools. Law schools are to occupy an intermediary place between the present undergraduate faculties of law and the national Legal Training and Research Institute. The law faculties are to continue to offer general undergraduate education in law, while the law schools in combination with the national Institute are to provide professional legal education. A principal goal of the change is to produce more lawyers. Law schools are charged with providing "practical education especially for fostering legal professionals." But just what is professional legal …

Court Review: Journal of the American Judges Association

Upon assuming the presidency of the American Judges Association at the 2002 Annual Conference in Maui, I indicated that it was one of my goals for the AJA to have a greater participation in the activities of the United Nations. We have an association with the U.N. as a Non-Governmental Organization (NGO) affiliate.

Court Review: Volume 39, Issue 4 - Editor's Note

Court Review: Journal of the American Judges Association

Before describing each of the articles in this issue, let me take a moment to comment on the sorts of problems that arise in editing a journal intended for both a United States and Canadian audience. The American Judges Association was formed in the United States and has most of its members there. It also has a substantial—and growing—membership in Canada. As our Canadian readers are well aware, there are some differences in the way the English language is used in Canada and in the United States. (For an entertaining and enlightening discussion of some of the differences, prepared by …

The Law And Economics Of Critical Race Theory, Mitu Gulati, Devon W. Carbado Jan 2003

The Law And Economics Of Critical Race Theory, Mitu Gulati, Devon W. Carbado

Faculty Scholarship

Legal academics often perceive law and economics (L&E) and critical race theory (CRT) as oppositional discourses. Using a recently published collection of essays on CRT as a starting point, we argue that the understanding of workplace discrimination can be furthered through a collaboration between L&E and CRT. L&E's strength is in its attention to incentives and norms, specifically its concern with explicating how norms incentivize behavior. Its limitation is that it treats race as exogenous and static. Thus, the literature fails to consider how institutional norms affect, and are affected by, race. To put the point another way, L&E does …

On The Psychology Of Punishment, Cass R. Sunstein Jan 2003

On The Psychology Of Punishment, Cass R. Sunstein

Articles

Are juries rational or irrational? In the context of punitive damage awards, jury decisions suffer from serious problems. Jurors are intuitive retributivists, in a way that produces departures from economic theories of punishment. Their decisions are rooted in outrage, which they cannot easily translate into dollar terms. The result is a degree of unpredictability and incoherence. An understanding of this point casts light on several problems with existing institutions and offers some clues about how those problems might be solved.

Beyond The Precautionary Principle, Cass R. Sunstein Jan 2003

Beyond The Precautionary Principle, Cass R. Sunstein

Articles

The precautionary principle has been highly influential in legal systems all over the world. In its strongest and most distinctive forms, the principle imposes a burden of proof on those who create potential risks, and it requires regulation of activities even if it cannot be shown that those activities are likely to produce significant harms. Taken in this strong form, the precautionary principle should be rejected, not because it leads in bad directions, but because it leads in no direction at all. The principle is literally paralyzing-forbidding inaction, stringent regulation, and everything in between. The reason is that in the …
